Or maybe the surveyor is incompetent. We had a surveyor do a survey so wrong our house was almost entirely on someone else’s land. We didn’t find out until the farm our land was next to was sold and the new owners had a survey done. We had our second survey done and they both said our house was 90% on their land. We were on 5 acres and able to give an acre at the back of our land to the new owner in exchange for the acre was house was on, but it could’ve went really bad. Thankfully, they were understanding that we had no idea. I found out later there was at least two other times he surveyed properties so badly that homes were built not totally on their lot. One was a double wide they actually had to take part and move.
I talked to a real estate agent about thing once. And get a lot of this. There is something some call Phantom Land. It is land that only exist on paper. If you was to add up all the land listed on paper it would far exceed the amount of land in the real world. I now forget how many square miles she said it was the last time she heard about it but it was in total over the US of something like 1000 square miles. I asked how this was possible and talked about over laying property lines. Now this was back in the 90's. There is no telling how bad it really is. A few inches here and a few feet there add up
In Oklahoma we have senior rights for whatever description was filed first. If two descriptions overlap the one files first gets the overlapped area because you can’t sell what you do not own.
Where are you located? My dad's been looking to have someone come survey property he bought last summer. The neighboring property's surveyer did some wild shit now they think it's their land. When it's clear as day on the plat everything is straight lines. Every line this survyer did has a huge belly to it and they sure as shit don't belly to give us more land. 🤔
