Yes, I like this. I need this. I lose concentration , tend to ramble, and have difficulty being concise. Plus I get super nervous in a confrontational setting (no matter how benign), which ends up with my mind going blank. The pretrial Q&A is just what I need. I am unable to discern time frames and spacial awareness, so quantifying is difficult for me, so practice is necessary. I appreciate you being frank and reiterating that we need to keep to the strict reasons of why we can't work.
My hearing is in December. I think it comes down to preparedness when it comes to panic attacks and anxiety disorders. I have a therapist I see twice a month. But I have to go over all the questions about laundry,housework,driving etc. I have to search every possible question and have an answer and understand the side effects of medicines as well as the diagnosis and get really good at learning all of the language involved in the diagnosis to be able to word to put into words how I am not able to work because of panic attacks and anxiety.
I ran into this very issue at my hearing this past week, I didn’t have a pre hearing interview with my attorney however I had already been through a previous hearing. I had an issue with one of my medical providers and had to switch providers. The timing couldn’t have been any worse. As a result that provider didn’t provide a very supportive opinion on the functional capacity report. When the attorney came in they didn’t introduce themselves by name. After a quick handshake they very firmly told me “this is what’s going to happen” During the hearing my attorney kept control over what I said and did. As you said absolutely no rambling on. When we came out of the hearing they were a completely different person. They said they were confident it went well and that I did well. I completely understand why this approach was needed. It’s a legal proceeding not a social hour. The hearing went exactly the way you described in your videos. Thank you again for all that you do. Your support is immeasurable.
LOL. I had a telephone hearing. The Judge told me to take my time. And he wanted to know everything I could tell him. He wanted me to start from the beginning of my problems from 30 years ago. My lawyer never shut me up. I knew I was rambling sometimes. I apologized. The Judge said do not worry. we have plenty of time.
Thank you for reinforcing this information. I struggle with this issue on a daily basis. Focus is the key! I'm in a disaster with my disability. My focus issues derive from chemo brain which most people are not aware that it's not happening just during your months of treatment. It takes constant practice to work with staying focused and not going off to lala land!

i just had my hearing and I kept my answers brief and wrote my notes down so I would stay on point. I would definitely recommend this and leave emotions out of the testimony they only want facts. My lawyer called me after and told me I did well and said I wish everyone could do as well as I did. Do NOT volunteer information. They ask a question, answer that question. Do not go into other stuff. stay on task.

Extremely helpful..My attorney is waiting to have a pre meeting with me and I'm honestly concerned. My hearing is in a few days.. 7- days I had to deliver something to him ..then he had me Sign forms that was needed.
My lawyer asked me to continue rambling through the hearing, with the idea they would approve my case just to get away from me. And stop their ears from bleeding.
On a job interview, i try to say what I think the recruiter needs to hear so i get hired. On a disability hearing, i should say only what i think the judge needs to hear so he is convinced i cannot work.
if anything a good attorney will prepare you for these questions. They may do a mock interview with the questions that typically get asked and then instruct you to use the same answers you _truthfully_ gave. Remember that a lie will come back and bite you!!
Past initial formalities, I think my attorney spoke a grand total of 1 sentence in my hearing. Not sure if that was a good thing or a bad thing, unusual or normal.
We humans LOVE to tell stories, typically 9 out of 10 people, especially in social settings😅 I learn this early on, so I just tend to listen to everyone who wants to be a center of attention or I remove myself (you see here how I go off the topic and rambling😂). Anyhow, given the reasons you provided why you will be “really, really” rude, I don’t agree with you that’s being rude. I just went to my disability hearing this past Tuesday and the lawyer told me I have a favorable case it would be hard for the judge to deny me disability , he said I should receive a letter in the mail in 30 days is that a good thing I always expect the worst that way I wouldn’t be as disappointed if I lose .. but it be nice to know for sure
there are many reasons, but none to want to hire old people who could be fall down or lose concentration or no working experience or lose memory; as polite, everyone showing up smile face but behind beat you around bush which I am sure.
I live in Eastern Washington and feel that I should release my current attorney and hire you , or someone like you! My attorney does not make me feel like he really has a handle on getting this done! Do go that far out of state or have contacts here that you would recommend?
Mike, I always suggest that folks try to work things out with their current lawyer before switching. As a practical matter eastern Washington is about as far from Atlanta as one could get. I rarely take cases where there has been another lawyer because 2 lawyer on one case will require both lawyers to file fee petitions and those are a nightmare.
I'm curious if SOCIAL SECURITY, denies people's disability case, Why are people simply not just asking for their retirement? Seriously, I fill like a 72 yr old man stuck in a 54 yr old body, if our government wants to recognize men as women, and women as men, then why would they not recognize me as an old man, I may be 54 but my body is failing me in the way it would a 72 yr old man. Would you recognize this as a valid point?
@@ssdattorney so if the Federal Government recognizes, a man's feeling that he is a Woman, or a woman's feeling that she is a man , why would they then discriminate against anyone who feels like they are 20 yrs older than they are? Wouldn't that be discrimination? They say it's discrimination to not recognize the other. I'm just saying the government has opened a very slippery slope . Whether you agree or not dosen't matter, it's the government who will have to explain their discriminating policies to the world on the subject.
i had a dissability hearing back in 2009 and my lawyrer told the judge that i was retarted and that i couldnt lift a glass of milk she even told me to shut up at one point lol

I don't like rude people but in that case you would be free to be the most rude person I ever knew!! I know a lot of people who are extremely rude and nasty too. I don't know their names at all. They are everywhere. I realize that you could keep it short and simple. If you make the Judge have to sit there and try to decipher a story he will understandably be irritable. He has other people to see or spent his day already listening to other peoples' bullsh!t stories a really just wants the facts that are relevant and nothing else. Even if you somehow happen to know the judge don't view him as your friend but say what needs to be said and nothing else. I am no judge and I can easily see why it is a terrible idea to ramble on about something that happened 30 years ago. Now if he happens to ask for something on what happened then tell him. Just don't take it as a free pass to go on and on about nothing. He will become lost in your testimony if you do. If I was the Judge I would be nearly everyone's worst nightmare with my short attention span. I would probably be fired for not maintaining the ratio of approvals to disapprovals. Some of them may even walk away weeping after they ramble and get a few harsh words even!! I can be really unpleasant when I am in a bad mood!! Not violent but potentially very hurtful with words!!
Google disability lawyers in your state or area. Then search them on the BBB. Look for one with little or no complaints. I researched mine for two days.
I had my hearing a month ago. I have anxiety and depression pretty bad. The judge had asked me if I have been to a psychiatrist and I said no, but the dr ssa sent me to gave me a gaf of 52 . My question is do you think me not seeing a psychiatrist for my anxiety and depression problems will hurt my claim. I have been seeing my family dr over this for a long time.I take medication for this and I also have spinal stenosis in my neck.
This attorney has posted other videos addressing these issues. If depression and anxiety are what your seeking disability benefits for then failure to comply with your doctors referral to a psychiatrist will go against you. Although your primary care doctor may be able to prescribe antidepressants and anti-anxiety medications, a psychiatrist is necessary for an actual diagnosis of these conditions. A judge will likely seek a current, documented diagnosis as well as compliance with your prescribed medications.
You need documentation. Every word you say to the shrink needs to be documented. Mental health cases are hard to prove in 2019. And taking a simple antidepressant isn't going to win your case. Almost everyone takes them now a days. Strong psychatriac meds are a plus also.
Colin, if you are still working then you can't also be "disabled." It sounds like your impairment may be in the ADD family - those are very tough. You would need extensive support from one or more treating psychologists or psychiatrists.
I’m sorry, I feel like I should clarify. I feel like I would likely have a panic attack in the courtroom. The thought of being in that environment, surrounded by people who are literally there to judge me, under bright lights with the judge looking down at me, is utterly horrifying. That’s essentially how I feel in most social situations or public environments, but a hearing would magnify all of that. So what if I can’t do it, or what if I have a panic attack in the courtroom?
And many applicants have mental issues that inhibit them from answering questions in a beautiful broadway performance manor. If you and or the judge have to resort to being impatient...rude and unproffesional then the problem is with you all not the applicant. In most cases applicants have patiently waited years for their hearing only to be made to feel like still no one wants to hear them. And iroonically it's call a hearing lol. If I was the jydge I would welvome and allow the applicant to talk all they wanted. Because they will probably talk thelmselves into a hole.
Sorry, Rocky, you are missing the point. Most judges schedule hearings every 45 minutes to an hour. You can expect that your lawyer will have 15 minutes at most to conduct a direct examination. If my client gets off topic I have to bring him/her back and if that means being a little direct or even rude, so be it. I want to keep the judge happy and get all my points into the record.
@@ssdattorney I agree the point was missed here. Time takes precedence over emotion. It doesn't gratify the lawyer to jeopardise a case by being rude so clearly there's a beneficial reason for this approach.

Back pay is real Sicily Morgan diagnosed 2017 October why would it be used in an active food stamp.case the IRS said I couldn't get it faxed until after February 15 so if it's true it works the 1099 is a blank page month format. Silly it's it's mailed I'm getting it faxed to lone Star legal
+Josh Paccar - it is possible but very difficult at such a young age. Your medical issues must be extremely serious and you would need strong support from your doctor.
Social Security Disability videos All my doctors agree am disable. My genetic disorder is listed on SS listing imparements. And I also have herniated disk. My doctor Agrees Am disable.
CAPAC I hope that you were able to obtain disability benefits, if not disability, than at least SSI. I HOPE YOU HAVE AN ATTORNEY TO DISCUSS THIS WITH!!! Good luck with your health problems. I feel for you, I have many herniated discs and had surgery in 2012 after being bedridden for years after L5-S1 disc EXPLODED THROUGHOUT MY LUMBAR SPINE ALL THROUGHOUT MY LUMBAR AND SACRAL SPINE. IT STARTED WHEN I WAS 25. I hope that you are in therapy for your injury to your spine, and that you are seeing the doctor regularly! Best of luck to you.
