Our justice system is not about proving innocence, it is about proving guilt. The judge who said there wasn’t sufficient evidence to prove innocence has his head on backwards.

@@bjkl4520 this is the problem with remembering or popularizing simple catchy phrases such as "innocent until proven guilty". It doesnt capture any of the nuances of the actual situation/system leading to people getting riled up when the poorly made "rule" is broken.

@@SteveCarras he was released from custody and and the higher courts are reviewing his trial, with the case against him flimsy at best and nonexistent at worst, and with no prosecution against him, it’s pretty safe to say he’s in the clear

This makes me sick. Can you imagine being in this poor poor fella's shoes? He had his life stripped from him. And I echo the sentiment of others in the comments section, those "witnesses" who lied need to face criminal repercussions for their role in incarcerating an innocent man. ​@@noahjones9833 Once you're convicted of a crime, you're considered "guilty" no matter what the evidence is. Yeah, morally, he's not guilty, but legally he is. Once you're convicted and therefore (no matter the evidence) "proven guilty," the only way to get out is to prove your innocence.

That's the thing though. He *was* technically proven guilty in the first trial. The presumption of innocence flips then and now he has to prove he's not guilty.

This. Lying in court should get you the sentence the person you tried to get locked up would have got. Exceptions obviously for misremembering (it happens) but people like that lady who know they saw nothing and even had it proven to them still sticking to their guns and the other 'witnesses' should have trials and be put in for life when found guilty.

Sure I think so too. But think of the consequences. If witnesses knew they'd be put in jail for being wrong. How many people would come forward if they're not 100% sure of what they saw

i know a man who was accused of a horrible crime by a girl and sentenced for 32 years. the girl said that she was lying but he still has to finish his sentence. he is the nicest man i’ve ever met, with a loving wife, some people are just looking for someone to blame

In America there is only 1 situation in which you are innocent until proven guilty, that is a wealthy, powerful, and very much white person with no priors, and maybe on a very rare occasion just plain lucky. If someone is missing any one of those traits or may a Supreme being help them if they're missing more than 1 of those traits, they will be considered guilty until proven innocent. The American justice system may have better living conditions than other countries but is a terrible system when it comes to providing "fair" trial...

Unfortunately this happens far more often then anyone is willing to accept. There's never any true justice in cases like this which is horrible. It makes me so sick and what's worse the majority of people think cases like this are 1 in a billion when it's far more often. It's a problem I don't even think you can truly fix

@@mrluigi9923 if it isn't a for profit prison, the parole board will look at things like anger management, compliance with mental health medications, educational achievement, etc. If he spent all his time proving his innocence and didn't do any of that, the parole board will reject it. If it's a private prison, they will reject just to keep their numbers up and ensure profitability.

Without forensic tests or pleading guilty, witnesses are not enough because some random citizen that says they saw it can easily be wrong or lying.

U guys know you can be released after being convicted it has happened before. This is just a very rare case. Also the judge didn’t decide if he was guilty it was a jury. The jury may have had bias that the Defence didn’t realize when selecting the jury. Also this guy probably had a public defender for his case which may be why he lost an easy case.

Not really, it's innocent until proven guilty to a bunch of ordinary people who are conscripted to act as jury, and then you are guilty until you can prove your innocence unless a judge or governor realizes a gross miscarriage of justice and chooses to issue you a pardon.

NO it's not. Once you are assumed guilty, the burden of proof is on the prosecution to provide evidence, sometimes that evidence is only a so called 'witness' (who COULD be lying). But it works like this (for an example) Hypothetically lets say, IF you are suspected of a crime, and enough evidence can be found/created/presented to arrest you (could be a witness on the spot), you are taken to jail to wait for a hearing. The taking to jail part is your fist clue you are guilty and must prove your innocents. Now they give you the information that they have that they are using to PROVE your guilt so YOU can PROVE it's not true in order to get out of jail. So, in actuality you must prove your innocence before you can be released. .. I want to add a couple of things I use to work on some years back.. to entertain one's thoughts. #1 is your Miranda Rights. I have asked many people including police officers if they "know" what their Miranda Rights mean. I had an officer of 12 years who was in trouble call me, I asked him the question during our conversation. Funny, but neither him nor any could answer, all they could do is recite them. they mean: You have the right to remain silent BECAUSE everything you say WILL be cut up and used against you in a court of law! Anything you SAY that they can use against you they will, anything you say that can be used as a defense is for your attorney to defend. And there were examples I used. If you had a court hearing on Monday at 8am but got into an accident on the way and was rushed to the hospital, then explained later to people of substance, "I was unable to make it because ..." the petitioning party will only tell the Judge "You said you were UNABLE to make it".. the rest is your defense. So the Judge is deceived. It would also be your job to notify the Judge they intentionally deceived the judge and then prove that. #2 NEVER EVER PLEAD "NO CONTEST". No Contest not a plead that can be appealed without EXTREME circumstances and you have 30 days to prove and 'request' an appeal, so.. a No contest plead is explained that you may NOT ever for any reason except proven extreme circumstances reversible and it IS used as a guilty plea. "Nolo Contendere" which translates as: you do not with to contend or argue against the complaint. In actuality you are stating to the court that you are incompetent (as a 2 year old child) to take a plea on your own, and therefore you are allowing the court to do so for you; which because of your own incompetence you will never appeal, because.. well.. you are incompetent. (that's not exactly what it means, but it is about the equivalence).

Human society operates based on different principles than nature. In the real world it would be almost impossible to convict members of mafia/criminal organizations of something without witnesses/snitches. "Scientific" approach would actually totally ruin the justice system. Also, forensic science is proven to be very unreliable.

I was just being myself only to still get banned out of nowhere, permanently with no chance of appeal, all because a bunch of shittalkers behind my back complaining anyway that I somehow made them "uncomfortable". Then these same people would have the gall to call me "defensive" say I don't accept responsibility simply for defending my innocence.
