@@mikeostrom583 Legally safest maybe, but 'best' is a qualitative judgment based on individual values. Gang banging drug dealers each and every day make qualitative judgments that say it is better to shoot people on the street over illegal drugs and some of them never even see the inside of a cop car [either because people never report them, or because they end up in a body bag instead] and they seem to think that is the life. Some people believe in collecting gold instead. Some people have this twisted hybridized mixture of being a thug who wants a lot of money, so they come steal a person's gold from them. So... Do you really think being put into a cop car is going to stop a claim jumper? Do you?

Law enforcement is tasked with keeping the peace. That IS (should be) their primary duty. If law enforcement fails to uphold the law, people are going to take that upon themselves. Especially way out in the sticks where prospectors do their thing. My childhood friend was murdered on his legal claim by the drunk a-hole on the neighboring claim. The sheriff's office knew about this a-hole. The a-hole was smart enough to turn himself in when he sobered up the next day. He knew exactly what would happen otherwise.

One point in my mind to bring up, … is that it was the original owner, who called the authorities, not Dan, … why? Because at that time, he did not own the cell, or leasing the property, after the 3 day, in addition to the squatter(s)/claim jumpers, are shown to have been using an illegal sluice, & yes the authorities must be called, … in order to protect Dan, or previous owners claim, … from any government lawsuits, … C Y A, … ALWAYS!

Oh the vile squatters. They moved into my empty home without me knowing about it. Could not get them out of my house they would not leave. I told the sheriff I was going to go replace all my doors and windows and he told me he was going to arrest me if I did. ( well it was wintertime). they should have left in the summer when I began the battle and the sheriff would not do anything about it I ended up taking them to court the judge asked the dumbasses if they believed they had a claim on the house, he paused for a few moments and then said well no the judge said then get out 3 days. 3 days later they were still there and the judge had the Sheriff forcibly remove them

I was working on my uncle's claim and he found squatters on his claim and it took the act of the law enforcement to get them off and out of the of the claim and after everything was said and done the claim was full of trash and burn pits and then to add insult to my uncle's claim someone dumped trash and oil on the ground in the area of the claim where the digging is being done and here in Southern Arizona there isn't much water and with the oil dumped in the digging area it has really been a Nightmare not to mention the trash that we've cleaned up. I feel your pain Dan with claim jumpers and squatters and the problem that comes with them. Good Luck with your situation up in Canadian Wilderness

But the thing is, back then, if a claim wasn't being worked it was basically treated as abandoned. I'm not defending these folks, I'm just saying that the now popular mentality of "this is my claim and you can't take my gold" has been used to claim spots, but never even work them. I know people who have claims that are 10 plus years old, yet they've never worked them a day. That's not right, but the government loves it because it keeps actual mining from ever taking place. I think it's high time that the 'rules' of having a claim are changed, at least here in the US.

Because I dare say a WHOLE LOT of the people on THIS channel would no ascribe to it!] As far as how 'right' it is for a person to hold a claim and not work it, or how much the government 'loves it' [seeing as most governments always get a cut of the profits by law] aside, that in no way makes it 'right' for people to go out on that claim and illegally mine it. If I have a beautiful rared hotrod car in my garage, even if the garage is falling down around it [and I use this example because I have seen it and watch many a 'barn finds' type automotive restoration video, and witnessed a super rare old car suffering this exact same fate first hand] even if said car 'crumbles to the ground in a pile of rust' you are never at liberty to go in and sit in that car, drive that car, restore that car or do anything to that car, be it for good or for evil, because it is NOT YOUR CAR. As frustrating as it might be, it is the law, it has always been the law, and best I can tell, will always BE the law. A thief and a trespasser is and always will be in violation of the law.

I can't believe the authorities let them leave - Shouldn't all the illegal mining equipment be confiscated immediately? From my neck of the woods, anything used in illegal activity is fair game (and should be) for confiscation.

Good for you ,you did the right thing...some people just think they can do anything they want ,no matter who owns the land...in the old days they would of been hung for doing what they did..those people telling you ,you're in the wrong would do the same as you, if it was their claim. Dan, here in Washington state what they are doing is aa class "C" felony. We got that law passed when I was president of the North Central Cascades Miner's Assn. The "Resources Coalition" were very important in lobbying for this law. I'm a mamber of that too.

i have been asked to stop panning and told to leave ground that was not posted, or claimed. After talking with them and acting like a normal person, offering to give the small gold { flour gold } back. We were able to get along. I was friendly and now have been allowed to pan in most for those places. Leave no trace, no trash, preserve for the next to enjoy. Dan and i would have gotten along so well. Be polite and you will make many friends. They failed to do any of these things. Dan was above and gave so much that he did not need to allow them to have. Hats off to Dan for being such a good hearted person. He was well within his rights. I would only hope to meet a person such as him. GOOD JOB DAN

The law is something that some think only applies to someone else. Claim jumpers are the lowest of the low in relation to property rights. I despise those who say "rule of law" except when the "rule of law" makes someone else comply with the law. I am on your side 100%.

The law in Canada does tend to favor the squatters to a degree. This is because in most cases it really is people without much other options, and just evicting or arresting them doesn't actually solve the real problem. However; you get assholes who purposely abuse these laws. They know the laws around squatting and use them fully to their advantage. These people likely are nomadic "sovereign citizen" types who just kinda think everything belongs to them and travel claim to claim squatting like this and milking every second of the time they can out of the squats.

The weather is just starting to break here in montana. So I'm out all the time prospecting. When im 100% sure im okay on the piece of land I will bring the tools in and sample. But if the land is questionable I only arm myself with the gps and camera. I run into alot of land owners / claim owners. I talk to them and see what I have with me and 90% of the time the land owners give me permission to prospect there land with the condition I leave there cows alone. And yes when I get that permission they point me some good out crops. It's people like the ones you ran into that create all most of the issues. Keep rockin and stand your ground. After all once a claim if filed it is private land for what was claimed. Great video dan !!!!

Here in Canada it is not private land when you have a claim. Claim ownership only gives the owner rights to the minerals which means people can trespass to a certain degree such as to access the river to fish or swim or hike. Another thing that you may not know is there are 2 types of claims,mineral and placer,which can both be filed on the same cell. I might have the placer rights while you have the mineral rights imagine the problems that could arise in such a situation. The long and short is you do not own the land when you file a claim here in Canada,nor is it private,nor can you build a permanent structure. Hope that enlightens you a little😉
