As of now, NOTA is absolutely worthless. Because of course, why will the MPs implement (or let someone else) a successful NOTA system. I knew one case from Hyderabad where in a matrimonial dispute husband killed his wife who was troubling him. And after 3 months he got out of that case without any prove against him. He married another woman and living happily.

Her father, father in law, brother, brother in law or male relatives have to pay.. In many cases, court have asked father in law or brother in law to pay maintenance to widow living in the same house
I gave up on relationships 20 years ago, and you know what it's gotten me? A stress-free lifestyle and money in the bank. Best of all, I come home from work pop a beer, sit on the couch, do nothing, and leave that used paper towel on the coffee table.
This law is very good in muslim countries because in Sharia law, if the husband initiates divorce (talaq) the husband has to give 3 months maintenance to the wife which is a reasonable amount too whereas if the wife initiated divorce (khula) 0 maintanence is given to the wife and moreover the husband has the authority to take back the mahr amount which he gave to the wife. We need to implement something similar here too

1. Not legally, but we never know what happens behind closed doors. Influential lawyers with good rapo with judges get favorable judgments. 2. Only if you're a resident of Goa. 3. I don't understand how the court can not see that. They simply don't give a fuck. It's just a job, one case after another, just get it over with. No one is gonna come and question their judgment. I don't know how much commission not so honourable middle man takes (aka judiciary) and I don't think there are solid prenups in india but I know there are quasi prenups but they're not that great. This law is just like PMLA where anyone can be punished based on statement, and then the person is guilty until proven innocent, in PMLA person suffers in jail, and here suffers financially and socially

Read through the judgment, the man should stake a claim in the immovable assets bought by the woman, during the course of the marriage... And the amount of time given to him to pay 2 cr is ridiculously low...and pray which school charges 75k/month?

Seems monthly maintenance of one lakh for 16.5 years for mother n child. The judges have certainly shown bias and if only they could be sacked, they must be.
@anilauece they considered that his parents are settled in USA, annual income of parents-28lacs, parents have immovable assets in New Jersey, he earns 8lpm not to mention he has also paid 52.5 lacs in interim maintenance. Not to mention the legal fees...

Don't you think with rise of divorces, men are becoming targets of alimony. Even this case child is of 1st husband and he being 2nd husband on road to divorce. There is a need to have legal pre-nuptial agreement registered after marriage or at time of marriage a must to prevent long court dispute for divorce and any alimony. Men are being made easy targets for marriage and divorce settlements for a quick windfall. Men should exclusively think hard of remarriage to women with children of previous marriage.

Mostly laws are abused than use, victim mostly doesn't choose the court to further extend its suffering to add end less time and money on cases. If you closely look into the system, it is not meant to help out but to extract out money and wasting precious years of life.
US has a law in which a wife just has to say she feels not safe in the presence of her husband. The court will grant TRO. In the TRO hearing only one party’s presence is necessary. The sheriff’s department serves the TRO, in most cases husbands get blindsided with TRO as women are masters in hiding things. He has to leave the house with just a go to bag. Additional hearing takes place after 2-3 weeks, in that time he will have no contact with his kids, so the wife becomes primary caregiver for the children thereby making her custody care even stronger. The guy has to bear legal fees while most likely the lady’s legal fees would be borne by some women’s rights NGO. In most cases the TRO is lifted after the hearing but it remains permanently on the guys record.
Women who are greedy for alimony can never be called an independent women even though they have degree and caliber to earn. They are still a burden to someone... After such enormous alimony, who will hear the advice to get settle, yes may be for her, who will get such kind of money despite being on wrong side or right side, but man goes. Saying the step daughter must be taken care, then, will the same court grant visitation right and succession right. Suddenly the mind changes, who are you. Let's reverse it, the man have children from past marriage, can the second wife be made to pay for upbringing if she is working. As someone who grew up in the USA, the bigger issue I see here is that this is a highly inefficient use of the time of the Supreme Court of a country. Why is the Supreme Court tasked with resolving marital disputes? Just sounds extremely crazy to an outsider.
