Uhh we ain't doing this. I ain't rubber stamping and putting my name on it.an honest judge might think. Nope Nope. If the process of being prosecuted is done for fines and fees to the jurisdiction and to bully some, as is common in local corrupt systems, in our larger courts, we are sinking as a society. Larger courts used to be not doing this much or at all.

From the news I was reading, the alleged victim is a troublesome person according to the neighbourhood. I hope the court fines this particular neighbour with wasting the courts time and resources

Police are obliged to answer a complaint. If the complainant wishes to press charges, they must file it with the prosecution service . Up to the prosecutor to go ahead or not. dont blame police for doing their jobs.

Let’s say a neighbor yelled loudly, maybe saying the word, HELLO!” If the neighbor spoke in a way that I actually felt their breath impact my skin, that breath contains water particles. Would a police officer be required to file charges? The answer is obvious. A competent police officer is required to use discretion on the job, even though this quality is absent in many officers and members of the public.

It was a heckuva takedown for sure. Water Balloon Squad called in, I'll bet. PTSD. Dr. Soggypants, PsyD, got an officer to release their medical record, bravely sharing their experience: "There was water everywhere, man, it was between damp & moist, I called for a helo' to make sure the lady with the green & sky blue hand-canon didn't rabbit. I saw a cat....this dry, nervous cat...a kitten, really, just adorable. Fur was fluffy, a nice light grey - well when the suspect fired, she didn't even aim - I saw that kitten retreat & scramble, the stream of water kind of cascaded onto its fur, a small rainbow, it would have been beautiful had it not been so horrific. I'll never forget that kitten's eyes, doctor, I wake up & it's like I'm there - the light grey fur now black from water. How is that cat ever to trust humans again? I keep a water gun under my pillow in case they let the suspect out. I saw kids the other day, when the temps went over 30C, and there they were, squirting streams of water like it was fun. They'd go back inside, I learned later, though, it was to RELOAD! Their own mothers helped them reload. It was bad in the 60s & 70s when the squirt guns were transparent & sprayed 3 feet tops. Now, my gawd, the assault water guns they have, you tell the firearms minister, what would you hunt with that? Why would you even HAVE something like that, unless your intention was to soak the whole community????!??? O the humanity!"

My small town pays the OPP to nap in their cruisers behind the Legion and to do the occasional radar trap on long weekends. They have never once caught a car/boat/ATV/RV thief though.

The reality of law is that they can always charge you, no matter how ridiculous, because laws are generic enough that with a little dishonesty you can say anything fits the crime. Runkle is justifiably incredulous about these charges, but in theory you could intimidate someone with a water gun (simple example if you paint it to look like a real gun and then use it to rob someone). Theory is all well and good but what matters is the fact of what happened here, and there's no credible way under these facts that the neighbor was honestly intimidated.

And then the RCMP dude, who was caught drunk and sleeping inside a RCMP car at a Burger Kings drive thru, had a can of beer in his car, resisted arrest, showed his middle finger to the camera at the police station didn’t get arrested, didn’t lose his job, and was sent to a treatment centre because alcoholism is a mental health issue. Of course it’S this lady fault! This lady has the wrong job! She is an EA. Perhaps, if she were a RCMP officer… 🤔

marc, i'm not up on all the laws, i watch for entertainment mostly. because the neighbour wanted to press assault charges on the lady are the cops not obligated to arrest her and take her in for questioning? or if not obligated to arrest her, are they not required to investigate this fully. maybe take her to the station. but then i agree with you on the incident being dismissed as according to the information it was an accident. no charges and no other actions. well, maybe just a stern warning! lol i think it's incredibly wrong for the neighbour to potentially ruin this lady's career because of accidently being caught in the cross fire of a water gun. i hope karma is watching. thanks for answering with positive information, not putting me down if you think the question is dumb. i truly would like to know.

Sadly, I saw her on tv stating she'd been suspended from her job in the schools system, & this is now on her record permanently. It may cost her her job just being charged. This is a ridiculous state of affairs, & the local cops need to be put on the carpet to answer for this travesty.

Losing a job is no joke. Having this on her employment record is no joke. I hope the judge throws this out but then again this is the new clown world where common sense does not prevail. If she gets exonerated if the charges I hope she sues for damages. She is certainly within her rights to do so. I’m sure this has become a real shit show for the OPP it wouldn’t surprise me if they don’t try to get her to plead to a lesser charge like mischief or something. Hope she doesn’t take it and hauls the lunatic neighbour along with everyone else involved into the court room.

I’ve summoned the courage to seek charges against little Timmy Thompson for squirting me with his watergun when we were five. He was last seen in his escape vehicle, a bicycle with distinctive training wheels. Timmy is a known repeat offender and may be accompanied by his accomplice, a tiny little puppy named Bingo. I know this is a cold case but I’m counting on the Canadian government to engage in its usual overreach.

Judge should censure prosecutor for wasting the courts time. Accused should be given leave to sue city for loss of job and wages as well as award for inconvenience. The complainant as a person who wastes police time with frivolous complaints and given some community time cleaning the streets.

A 9-year-old boy accidentally squirted a motorcycle rider with a hose. The motorcyclist was angry because he could have lost his balance, and he even said the f-word, The boy started crying; I told him to apologize, and he said sorry. The motorcyclist did not mean to make the boy cry. He accepted his apology and drove away.

My neighbor soaked my children over the fence for playing to loud. Always was an a$$hat, called the police, they arrived looked at the hysterical children that were literally dripping wet on a cold day and charged him with assault. Went to court, crown wanted to reduce to mischief, I agreed, as long as he apologized to the children. In court, he turned around and said one word, sorry. Judge said that's it? Sent him to holding cell for a few hours with pen and paper. We came back a few hours later and she made him read it out in court. Then she accepted the reduced charge, found him guilty, he got a fine, kept his job and didn't loose custody of his kid to cps as he was already dealing with them. Do in think it was a waste of time? Maybe in the short term but not in the long term. You must understand that as an educator working with vulnerable populations (disabled children), the proper procedure here is to put her on paid administrative leave. A school board can not be put into the position of having to try to adjudicate all the facts of an alleged crime, especially given that the facts are not available to them. You can imagine the parents' potential concerns, as well as insurance issues, and liability issues. Further, all it would take would be an unscrupulous parent to accuse her of assaulting their child, and now it gets really messy, so this is protecting the defendant as well. Therefore thought they may be sympathetic, the proper procedure here is to put her on paid leave, which is what they have done.

Amusing, but not really how it works. Anything can become a weapon if it is used as a weapon. So the ice scraper and charging cable in your car can become weapons if you use them to hit or choke someone, but they are not weapons unless they are employed as such, and you would not reasonably present them as weapons to a border agent. In fact I would caution anyone against it, because it may be perceived as a threat, because the only way those items would become a weapon would be because you intend to use it as such, and you don't want to imply that to a border agent or police officer for what I think would be very obvious reasons.

As a teen (more than 30yrs ago, closer to 40yrs ago) a friend and I went into a donut shop at around 3am with a water gun. We “shot up” the place, soaking each other and the clerk, leaving the place a lot wetter than when we got there, cleanup was needed… As we walked down the highway towards home, a cop stopped us, hand on her gun and yelling to put our hands up… we were arrested, taken to the station for a few hours, because the clerk reported that we had a gun. He omitted the fact that it was a water gun. We were released with no charges, and on their way to “discuss with the employee” about the details of his claim… not sure if he was charged with anything, but the cops were more annoyed with the claim than they were with a couple juvenile delinquents creating mischief at 3am 🤷‍♂️

We have the same idocy in the UK. Almost anything can be classed as an 'offensive weapon'. Water pistols can also be classed as an 'imitation firearm' which attracts firearms and offensive weapons acts punishments. Children in the UK have been swarmed with armed response police because somebody has called 999 and reported 'child with gun'. Even as recent as the early 2000s and the 90s, kids played on the streets with cap guns and other 'imitation firearms', it wasn't illegal and no one cared. The way western society has become so soft, mollycoddled and dumbed down is insane.

I delt with this in Canada. The police charged my friends mom for spraying someone with a hose. They charged her with assualt with a weapon. The charges stuck too cause in canada you have the right to die and nothing more. Any defense is considered assualt even if they coming at you with a gun. You cant even call them a name, or they could charge you with a hate crime.

My friend and I were out doing drive by water gunning in a small town and someone called the cops on us.(Don't hate it was summertime) The OPP pulled us over and asked my friend to see the "gun". The officer opened it and smelled the contents, looked at his partner and said "it's water". They let us go after that. I guess they just wanted to make sure it wasn't bleach or something nasty.

I’m going down to the police station with a lawyer and a priest to confess to the many times I attacked my neighbours growing up. The when was weaponized water as I feel my crime must be far worse also this will include the gang style attacks the we perpetrated on police vehicles. Our weapons were the same as the accused but we used not on water guns yes guns don’t tell Trudeau about my water guns as he will add them to the list of guns to be banned. The far more serious charges I will likely face are from the solid water projectiles which were frozen water hand grenades known as snowballs. Yes I clearly remember that yellow police car number 5505 from the I think Coxwell station. So now being older and hearing this is now a criminal act I will surrender
