Woman who fired warning shots to scare intruder says Oakland police treated her like criminal 

You know what else is illegal? Breaking into homes and cars. She was standing her ground.

I'm on the ladies side, she can't just let somebody break into her house!

You gotta be your own police, doctor, lawyer, and more in this world. Nobody wants your safety, good health, and freedom more than you.

Firing a gun in the air in a residential area actually made her a criminal

Yes, I learned the hard way too. You don't call the police when something like this happens. The same thing happened to me. An attempted murder, or attempted strong armed robbery almost happened with me. A BMW parked behind me as a woman distracted me while I sat in my vehicle. I was aware of my surroundings and got my gun in ready position. Said man in BMW quickly came up to my window with his hand in his pocket of his hoodie. Looked like he was holding a gun. I beat him to the draw. Got out my car. He stayed there in that position while I held my gun at him telling him to leave. He wouldn't leave. His woman accomplice came at me from the side and snatched my gold chain from my neck and said "shoot him." I'm sure she did not mean me to shoot her bf. I never took my eyes off the perp. They now had my gold chain. I thought I was going to die even though I had the drop on him. I told them to leave. Told them go ahead and keep my chain. Taking a life was not worth more than my chain. The perp would not leave. I told him not to take out his gun. He called my gun fake. He called it a bb gun. He was going to draw on me. I told him it real. Then when I made a choice that he was not going to listen and he was going to draw on me, I decided to shoot a warning shot. The perps finally left. I called the cops. The cops arrested me and took my gun. I had to hire an attorney. They treated me like I was the villain. California sucks. You don't call the cops. That's what I learned. And they wonder why it's getting this way.

“They were inside for hours looking for weapons.” Instead of being outside looking for the criminals that broke inside her home.

"I discharge my firearm with a warning for this person to leave. They don't do it." I'm 100% 2A and her right to defend herself and family but warning shots are reckless and put innocent people at risk. By her own words, her warning shots didn't even deter the criminal. That's why finger off the trigger until you are ready to fire and you shoot to end a threat (kill if necessary). Self defense goes beyond scaring criminals with a loud bang, you have to prove you mean business by slinging lead in their direction, not into the air (and potentially on to an innocent). Better a criminal end up in the hospital/jail or dead (since they chose crime) than an innocent who had nothing to do with it get hurt.

Living here in Oakland is rough. The police aren’t doing anything. We are out here on our own. Protect you and yours at all cost. Anyone who thinks otherwise should move out here and learn their lesson.

"The right to bear arms" this is the very essence of America one could never put their safety in others hands especially with it comes to your home and family

To the Oakland Police Officers: You had the description of the true suspect but you treated an innocent woman as though she was the suspect when all she was doing was protecting her home. In fact, you should all give up being police officers if you are only going to treat victims as suspects.

This should be a Teaching and Learning experience for Everyone involved. Thank God nobody was injured or killed.

It's too dangerous here in the Bay to rely on 20 minute police response times. I applaud this lady for defending her home and children.

I called 911 on some guy waving a gun across the street in front of a hospital around a block away from where I live and the police had the AUDACITY to grill me and treated me like I was making it up. How ridiculous. Like sir, you’re just scared and don’t want to do your job

As a gun owner you never discharge your weapon into the air you can kill someone. You tell them you have a gun and you will shoot them if they don’t leave. But the treatment she got from the police was also criminal. You don’t treat a victim like a criminal regardless.

The time the police spent questioning her and her actions, could've been spent looking for the criminal that will likely be breaking into other peoples shit on the next block

I really hope that this young lady gets this message. I am a 64 year old white male and I hope she is vendicated. She did NOTHING wrong protecting her family. Maybe she could have fired the shots in the grass, but in the moment, she did what she needed to do. All of our laws need to be reviewed to see if they are applicable to the situation. The same thing happened to my dad. He saved our lives and got jail time. Dude shot the front door knob down with a tec 9, my dad was waiting on the first set of stairs inside and caught him in the leg, but he shot at him when he ran out the house. So they arrested my dad and tried to give him like 10 years, he was completely legal. I understand. A stray bullet is dangerous but damn. Even the detectives that arrested him were like we think you're a hero, but we have to do this

I have sympathy for the homeowner but to be factual it's extremely dangerous to do that. You may shoot the intruder but to shoot into the air is not sensible.

I was being harassed by a bunch of dudes in Oakland long ago. Cop showed up and told me to leave while the aggressive party was telling the cop to eff off. I asked the cop if he could at least escort me back home and he said no and hauled ass. Cops are people to, not all of them are brave.

Irresponsible firearm owner, teach her what to do and when. But don't take her defense away. The handcuffing of unaggressive people in the presence of MULTIPLE officers needs to be reevaluated

Never EVER fire "Warning shots". It can land you in trouble. It will be looked at as "Intimidating with a deadly weapon" "Unlawful negligent use of a firearm." If you're pulling a gun to fire warning shots, it pretty much says you were not in immediate fear for your life, or else you would not have fired "warning shots". So, don't pull that gun out unless you mean to use it against a threat. If she would have shot the intruder, she likely would not have ended up in trouble.

I don't blame her at all whatsoever, however her mistake was shooting in the air instead of in the grass because what goes up must come down (and that bullet could kill and innocent bystander walking by, thankfully it did not). Having said that, it doesn't justify her treatment by police, she and her family were still victims of a home invasion. Smh

There was a young woman in San Leandro who was killed by a falling random bullet. I understand she was acting by mama bear instinct, but I hope she'll do it differently if she should have the need. Thank goodness everyone is ok!

The police treated me like this when someone kicked my door I when I lived in an apartment. And I didn’t even have a firearm then, It’s just ridiculous and a lot of times when you call they get there 8 hours later. That’s why I am now armed.

Oakland lets all sorts of nonsense slide. I just don't see it being a productive use of their time chasing down a homeowner who recklessly discharged their firearm in the air while protecting themselves from a burglar. Maybe in another city, but not in Oakland. Oakland is quite the dysfunctional city, and their police force is seemingly on the brink of collapse. If you can even connect, you'd be lucky to get a 911 operator in less than 10 minutes. Dispatch is buying used equipment on Ebay, and the Crown Victoria was discontinued 12 years ago. I don't even think the ones in this video are 2011 models either😆 Does anyone remember seeing 80's police cars still being used in 2003? I don't. If they think social workers are a good idea for domestic violence situations, then a gun re-education class for legal owners in a situation like this isn't too far fetched. Maybe make a local gun range conduct the classes. A win for everyone.

I lived in Oakland for 18 years and just recently relocated to San Leandro. Oakland is wild right now and to some extent always will be. This woman is just defending herself and her family.

No, that was RECKLESS!!!!! She should NOT have gone outside and definitely NOT fired into the air!!!!! I know of a child who DIED when someone did that, and across the subdivision, the bullets came down on the church, with one hitting and killing the child. Had she stayed in her home and fired at the woman while the intruder was still in her home or was moving toward re-entering it, Mrs. Gillam would be in the right. Mrs. Gillam was probably not thinking clearly and acted recklessly out fear for her family. We do not think clearly when our children are threatened and in danger. My prayers are for her.
