Energy Drinks do not contain any alcohol. My own nephew used that excuse before and it's completely false. They make alcoholic drinks with caffeine but those require ID to purchase.

The defense lawyer spoke so fast but I think he said the energy drinks contained a "derivative of alcohol." So, he could be referring to artificial sweeteners, more specifically "sugar alcohols" like xylitol, sorbitol, and mannitol. Those shouldn't show up on a breath test. Based on about two minutes of research, however, it appears that sugar alcohols can be fermented by bacteria in the mouth and produce small amounts of ethanol, which is detected by a breathalyzer. I'd think the amount of ethanol generated from sugar alcohols would be insignificant.
