These are all just blanket statements which courts have been making time and again. But the reality is that courts encourage women and girls to file false cases and by letting them go even when they are found wrong. In a recent case of Delhi High court left a woman for falsely accusing a man of rape charges where she had not told him that she was married and when he came to know he refused to marry. She then accused him of false rape charges and after a long fight and all losses to the man he was proved innocent.But when it came to penalising the woman the court did not punish her because she said that she was married and she was having children and what would happen if she went to jail? The court then left her because she was a woman. Was it not the biasness of the courts favouring them filing false case ensuring that there would be no penalty for them even if they file false case? Would the court show same favour if a man asks for forgiveness after committing a henious crime?
Seema bai got convicted for 10 years of imprisonment for making false rape accusation in MP. The laws have always been there,they are just being used now.
@@PhDincriminilogy only 10 years? What if the person would not have been able to prove himself innocent? How many years would have he been sent to jail for? Do you think 10 years is sufficient? Would not be surprised if the courts would reduce her punishment to a year or several months after some weeks or months. Because such things have happened women getting their punishment reduced or no punishment even for grave crimes like murder.
@@PhDincriminilogy in most of the cases women gets away pretty easily and 10 years is nothing a men would have been made capital punishment if he couldn't prove his innocence
@@RakeshKumar-sw5do2 Woman or man getting their punishment reduced with the help of court because our laws allow any convicted person to challenge his/her sentence. Also, their jail terms get reduced due to their good behavior in jail as per law. Law allows such things. And when did you know that no punishment was given to woman for murder? I am law student, around 1 year back, SC dismissed appeal of woman convicted for murder of her own child citing evidence. She played victim card in SC by saying that she got provoked by her husband/in laws as they were abusing her and having frequent quarrels with her. SC rejected her argument by saying that prosecution proved beyond reasonable doubt that woman committed murder of her own child. She was already serving life sentence under section 302 IPC.
As per my understanding of Indian Penal System.....The court can give judgement for the concerned section of law which is mentioned by the IO in the FIR. It is the responsibility of the accused to file a counter suit & for damages separately. Then only judgement can be passed on punishment to the false accuser.
Good Initiative Specially for Who File False Rape Cases & other False Cases. It Must Be Done Earlier, Although it's too but initiated it's Good Step. Have to take Action against who done False Cases in Past As Well. Request to Arjita Chaturvedi Ma'am To Focus on this Point also.
Section 344 crpc have minimal punishment and fine 😢😢such false accusers should be given a minimal of 10 years of regerous imprisonment as well as a fine upto 10 lakhs💯💯 they are trying to hamper a guy's public image as well as career atleast 10 years of imprisonment should be given 😇😇crpc 344,have 3 years of imprisonment which in my openion is not enough😢😢 for such fake rape accusers,For such false accusers a seperate law should be implemented for atlease 10 years of imprisonment and 10 lakhs of fine along with the person will ask apology publicly to the victim of false accusations and make a video admitting that she had falsely accused a person and ask public apology then only should be considered that true justice is given to the victim😊😊

victim's name (men) shouldn't be revealed ,the offender woman's name should be out in open so that an example is set . Such women bring shame to other women as well .

Mai tumhe yaha politely correct karta hu. India me laws extremely biased hai towards females. Yes mujhe pata hai ki things are changing aur kuchh laws ko gender neutral kiya gya hai e.go., Law against Rape of Children. Kuchh judgements me bhi male victims ko justice mila hai. Mujhe pata hai ki bahut ladke aur ladkiya suffer karti hai injustice se aur is se fark nhi padta ki kaun zyada suffer karte hai. Crime is a crime. Thank you for supporting people irrespective of gender. I believe genuine men & women should fight against toxic men and women😊.
Mama male or female relastion ship main rahte hai or usame mahila pregnent hoti hai bad us ladaki ko bachha bhi hota hai or usake bad agar ladaka kahi or shadi karta hai to ky ladaki rape ka case kr sakati hai
फैसला तो बाद में आएगा, ट्रायल में ही इतना भुगत लेता है लड़का की सज़ा मिल जाती है... और बेगुनाह साबित भी हो गए तब भी कोई इज्जत नहीं बचती... और इन फेक केस करने वालीं लड़कियों को कोई सज़ा भी नहीं मिलती... इन्हें बस डांट लगाकर छोड़ दिया जाता है...
