I'm with NR&S out of cleveland and I pulled my shoulder out while lifting a 50 lb. propane tank and now my shoulder pops and hurts all the time the doctor told me I could go back to work a week later and I told my boss no so I had no choice but to quit and the BWC in ohio will not pay you nothing if you quit your job so its been 16 months now and the stress of this is so bad its unreal so now I see yet another doctor for the stress to be honest I would not wish a work injury on anyone thank you for the information.

Does what ever medical expenses you had get deducted from your settlement? Are the weekly workers compensation checks, while your out the only thing that’s deducted from the settlement? Thank you!

That is a good question. In Georgia, nothing really gets deducted from settlement. But, the money that the insurance company has already paid (weekly checks, medical expenses, etc.) do not really get factored into settlements because the insurance company has already paid them.

I got hurt at work. Got hit by cement truck. Had strained neck, wrist and had surgery on shoulder. I went to company doctor like a idiot and after surgery I’m in more pain almost 2 years later. My lawyer has me goin to another doctor but seems like he either doesn’t want to help and prev doctor says he has done all he can do. I don’t know what to do and current lawyer keeps giving me runaround. I don’t k ow who to trust

Hi Joseph... it sounds like they are doing or trying to save a bucks by not helping you. If you didn’t recover or the surgery that was performed didn’t help and worst case scenario it even triggered the condition that surely is NOT normal. When things like that happen insurances/employers hope you go away on your own. Don’t do it. If your current attorney seems like he’s no good... speak with a new attorney and see what options he has for you. Explain to him everything from the gecko. Also if you plan on hiring a new attorney...go on his website and check out his reviews. If everything looks good and he’s legitimately helping injured workers then he might be the right one to get you what you deserve. Hope you get compensated and the treatment you deserve!

I’ve been on wc for over 5 years. I had shoulder surgery, neck surgery, and brachial plexus injury suet. How does wc settle with multiple injuries?

One factor that will come into play is whether your injuries all arose from the same accident or from different accidents. Can you reopen a worker’s compensation case after a settlement and few years go by if your shoulder gets worse and have proof of MRI ?

Generally, a settlement is almost always final and would prevent you from reopening the case. That being said, there could be exceptions that would allow you to reopen a Georgia workers' compensation case settlement in some situations. Also, different states have different workers' compensation laws with different rules, so I could not comment on what could be done in other states. The best thing to do would be to reach out to a workers' compensation attorney in the state where the case was settled to find out what, if anything, could be done.
