"Right to pass by permission" is a legal term of art. The sign itself actually gives anyone passing by it permission to use the road as an easement, but PREVENTS anyone, including the public, from adversely claiming a permanent easement. It's basically a way to grant a TEMPORARY public easement, which can be revoked at any time by the property owner. Yes, it's a REALLY awkward phrase and probably should be done away with.

The sign informs any one using the private road that they have permission to do so, it does not imply you must ask for permission walk on it, the land is owned privately but a easement must be provided.

Private roads in California MUST have a gate and it must be closed at least one day a year. That is not a private road so the cop is wrong

Private road? That's the most public looking "private" road that ever existed. How come the police officer knew INSTANTLY to bring up the private road sign? Do they entrap people with Trespass on that sidewalk often? Never mind that the criteria for Trespass is no longer a legal one, just something a cop pulls out for contempt of cop crimes.

Strangely the 3300-3600 block of Redondo Avenue - while it looks like any other road - is apparently a stretch of privately-owned road. It seems to fall under CA CIVIL CODE TITLE 2. OCCUPANCY, Sec. 1008: "No use by any person or persons, no matter how long continued, of any land, shall ever ripen into an easement by prescription, if the owner of such property posts at each entrance to the property or at intervals of not more than 200 feet along the boundary a sign reading substantially as follows: 'Right to pass by permission, and subject to control, of owner: Section 1008, Civil Code.'" What's that mean? My wild guess is that the owner could opt to close the road (and sidewalk) without getting permission from the city ... but otherwise regular use is permitted. HOWEVER... U.S. v. Grace might give public forum rights to the sidewalk. "...where the sidewalks forming the perimeter of the grounds are indistinguishable from any other sidewalks in Washington, D.C., they should not be treated any differently, and thus are public forums for First Amendment purposes..." However, I see similarities with the shopping center case in California, which went to the Supreme Court, and which guarantees your right to go into a shopping mall and exercise your first amendment rights inside without being trespassed EVEN THOUGH its private. Something to do with the implied consent to use the common areas as publicly accessible areas. Seems that this would be similar, though of course it’s something that an attorney will gladly charge you $500 to research.

Couple of things on this one. First, was that really a polite officer who actually understood how trespassing section 602 actually works? Looked like it. As for the private road and permission to pass. Section 1008 appears designed to prevent the establishment of long time use permissions which have previously been the basis for justification of canceling property owners “rights”. Example: land parcel with no frontage on a roadway has been accessed by a driveway on another property for many decades but new owner of property attempts to deny use of that driveway. The decades of prior use have been found to negate the new owner’s attempts to block the driveway. I suspect the right to pass by permission is legally implied, perhaps as a condition for the roadway to have been built within the city street grid. But the property owner, by posting the 1008 required notice, therefore retains legal control of their property. Example: writers often use, as generic terms, copyrighted names such as Kleenex and JetSki instead of facial tissue and personal watercraft. Copyright owners’ long term failure to enforce or renew their copyright will negate that copyright in a legal sense. Remember when the bell system, or was it AT&T, found they had lost the exclusive use of the term “Yellow Pages”?

There is logic behind that sign. That sign makes sense when you understand the law on land forfeiture. A perfect example is in NYC Rockefeller ( rc ) center buildings have streets between them that have in the sidewalks plates stating the street isn't public , its private. One day a year rc closes the street off to traffic completely. If the complex does not do that then the street will become part of an open street to the public all the time. Example : Mr Jones yard is used as a short cut for students going to school . After time Mr jones wants to put up a fence to stop the kids using his yard as a short cut. Well it has happened already where courts have ruled he can't put up a fence to stop the kids . But must allow the kids to keep using his yard as a through fare. In NYC you will see a lot of buildings with signs in the sidewalk stating what is private. I suspect this has some exceptions EX: a post office or a municipal building or some other government building on private property . I would think the owner of the property would not be allowed to stop anyone from having access to the government building.
