@@johnjames4567 I do agree that 870.044 is unconstitutional, but by no means does .043 authorize the sheriff to declare a permanent state of emergency. The law only allows the state of emergency to be declared while there is a clear "and present" "imminent threat" to peace &c, and the state of emergency automatically ends after 72 hours (870.047) without an ordinance being passed to extend it (which ordinance would likewise need to be in response to an ongoing "imminent" and "present" danger).Theoretically a city council could overstep and extend such a state of emergency indefinitely, but the law doesn't really allow them to and certainly not just the sheriff on his own.

As to other declarations of other unrelated types of emergencies, they need their own statutes requiring their own set of conditions. I have no doubt Florida has a statute that allowed the COVID emergency declarations to stand. But that wouldn't prohibit carrying firearms.
It's ridiculous how consistently cops show themselves to be irritated that because they're dealing with someone who knows the law, knows their rights, etc, they can't infringe upon their rights under color of law. The police don't know how to read. He tries to imply that 870.044 subsection 3 is the rule at hand. This entire statute is "pursuant to s. 870.043". 870.043 pertains to a state of emergency declared due to an act of violence. The state of emergency referred to in this video was due to weather. Thus, 870.044 has no bearing on this situation. Solo Yaker was still 100% within his rights.
You’re right. If you Google Volusia County’s website they have every emergency declaration available back to 2020. The only ones in effect on March 23, 2020 deal with social distancing in public. They do cite FL Section 252.38(3)(a)(5) for authority. That section gives counties added authorities outlined in 252.31 to 252.90. That whole section mostly just deals with cutting through administrative red tape to make it easier for different agencies to work together and speed up decision making and logistics. There is a section that allows for counties to place restrictions as needed, but they have to be explicitly outlined and posted publicly. As noted above the only published orders pertain to social distancing.

870 lists affrays, riots, routs, and unlawful assemblies. It doesn’t mention when the governor list a state of emergency because they want federal help for a natural disaster. You could see where the cops or the government might not want people to bring weapons to a riot or an unlawful assembly. But it doesn’t look to me like this law has anything to do with a hurricane. The governor's declaration allows resources to be more efficiently and urgently marshaled ahead of the hurricane's arrival.

870.044 stopped is the sale of firearms or ammunition, or the intentional display of open carry in a store/shop. Unless the person is except a duly authorized law officer or military service acting in an official capacity.

They left their good citizens defenseless against the gangs. After that, a handful of states in the next legislative session passed into law that, there could be no confiscation of firearms from lawful possession due to a state of emergency and that open carry was allowed. Louisiana and Texas both pass that, IIRC. In the nearly 2 decades, since both Texas and Louisiana have constitutional carry.
