On October 23, 2021, a car accident occurred when an intoxicated driver failed to yield while leaving a driveway. Upon arriving at the scene, the officer assessed the vehicle and engaged with the female driver, who initially appeared calm but became aggressive. Noticing signs of intoxication, the officer administered field sobriety tests, which the driver abruptly stopped. Despite her resistance and denial, she was arrested and taken to the police department. In court, she was charged with DUI and sentenced to 120 days of confinement (90 in jail and 30 on house arrest), DUI school, 50 hours of community service, a $1500 fine, and a six-month license suspension. This incident underscores the severe consequences of impaired driving and the importance of responsible behavior.

90 days jail plus 30 days house arrest, 6 months license suspension, DUI school, 50 hours community service and fines. Compared to other cases we've seen here, she had an inept public defender. The court slammed her. Good on the judge. The bf can wear her bras while she's gone for a little support.

Most states have a mandatory sentance for DUI. Everything you listed is the exact same sentance you would get as a first offender for DUI or refusal to test. Your lawyer isn't there to make sure you face no consequences, they're main goal is to make sure your rights are upheld. Facing no consequences is nice, but isn't as common in the past as you would believe. With DUI, I say it wasn't enough punishment. She admitted that she was driving. She was marandized. She admitted to being drunk. I fail to see how Perry Mason with the ghost of Johnny Cochran assisting could ever get her out of any if this. Id say that her public defendet did an excellent job because the fines were pretty low with nothing in the sentance and fines saying that anything extra was truly punished for. In the eyes of the law, refusing a breath test is admitting you are drunk. Even though she said she was drunk, the breath test is actually required. She screwed herself. Don't talk to police, don't admit to anything, comply as much as the law requires you to, ask for a lawyer at the soonest possible time. Ignore all idle chit chat, comply as much as the law requires you to, and most importantly, shut the Ole yapper. That is advice she should have known. That's advice that everyone should have known.

I absolutely love him!! He was incredibly polite and had the patience of a saint with everyone involved! How is beyond me considering their rude, entitled and obnoxious behavior, but he did! And he didn't stop there...while being polite and patient he actually did his job thoroughly and got a dangerous driver behind bars where she belongs! We need more cops like him! He really should be teaching other cops how it's done!!

Yeah, the entitlement with so many of these people is outrageous. I just want to get on with my day. I don’t need to be ‘more right’ and keep arguing over a point you won’t win. Just keep your mouth shut and listen. And if you don’t drink and drive or drug and drive. She would have gone on with her day. The officer doing the DUI test and interaction with the guy that wanted things from the car us FANTASTIC. He communicates wonderfully with her and the guy. His explanations are complete, concise, not rude but firm. He explains everything multiple, multiple times which is almost always the case in dealing with the intoxicated drivers but obviously is required this time with the argumentative and uncooperative guy, who by the way completely expresses his views on the use of MJ by his very easily read t-shirt.....duh! There are a couple of NM State Troopers who also do the same fantastic job of administering FST's and dealing with intoxicated drivers through the arrest and opportunity given at the station to give breathalyzer test. The officer's instructions in both this case and the NM Troopers cases are complete, succinct, and not fumbled, never varied, etc. Great, great job officer!

By the way, the car probably would've stayed parked there and the cop probably would've given him the vape if he hadn't been suck a d!ckh3ad about things. It's like anything in life, you do a lot better by not being a total jackhole. When you do, people start exercising options that they normally wouldn't. In a restaurant, it can mean the difference between a refund & apology or being able to order a different dish versus "Just shut up and get out." With the cops, it can mean the difference between getting to keep the car parked versus "Nope, it's being impounded and you're not touching it. No you don't get her vape. K thanks bye!" If the cop is just stinking it up, doing his job wrong all over the place, it'll come out of his ass later in court. You do a lot better by staying relaxed and saying as little as you can.

100% I’m an RN and when I worked on the floors anyone who smoked/vaped would be miserable because patches do nothing. Vapes have much higher nicotine levels, I could physically see the withdrawals more with those users. I’ve now seen 2 spontaneous collapsed lungs from vaping and it’s very hard on the body to recover from that. We are only beginning to learn what these can do sadly. ❤

That’s what’s so upsetting, that people under 30 are facing chronic lung issues at unprecedented rates and yet during an election year it’s crickets on tobacco yet again. There's a little known bit of case law that applies here: If you are going to 7-Eleven AND you're turning left out of a driveway AND you subsequently hit a car -- specifically if you collisioned with them -- and the police don't do their DUI until hours later, it's okay. You get to go home. No harm, no foul.

People need to understand if there is a car accident and a suspected DUI the police address the accident first AND then deal with the DUI investigation. Here she is acting like she got away with it. She actually got jail time. Were there previous charges or something? I don't understand why more drunk drivers don't get jail sentences. I think there'd be less repeat offenders if instead of just a few hours in jail, bailed out, and then maybe a short license suspension, court costs; they actually got sentenced to at least 30-90 days on a first offense (based off the level of intoxication), and time if they resist, obstruction, are violent, etc. Most people aren't "about that life", and a lot of these fragile "Like, literally Bro, call my mom, dad, lawyer, I know my rights", male and female Karen's would change their tune if there were some actual consequences. Jail time will reverberate into other aspects of their life. They might lose their job, lose income, a criminal record, etc. Instead of continuing to give them a pass until they eventually kill one of us. Just the past two weeks a drunk guy, driving on a suspended license, hit a bus, killing 8 and injuring 45. Woman who crashed into a birthday party and killed two kids. Drunk 21 year old going 127 mph in a mustang crashed and killed a teen.

Why is that cop lying? Declining to do the FST does not get held against you in court, declining the breathalyzer does. Don’t get so butt hurt because someone declines to do the FST and lie through your teeth.

She should have completed the sobriety test and kept her mouth shut! And maybe even have admitted, that she had drunk alcohol. Would have looked much better in court! In my language, Dutch, we have a saying that translates into English "If somebody is shaving you, sit still". Just undergo this situation, do not make it worse by talking too much and learn from it.

Should have arrested the home owner. He was repeatedly told the vehicle was evidence in a crime. He tried multiple times to access the vehicle. I suspect his motives were to remove evidence.
