Great video. Going through redundancy at the moment. I have a question: will my redundancy be based on my annual salary ie my basic pay or my total salary ie including commission? Also, will it be based on my annual salary (with or without commission) or the past 12 weeks pre-furlough pay? Sorry...two questions. Keep up the good work!

Hi, Ben. We are glad you enjoyed the video and hope the process goes smoothly for you. To answer your first question, your weekly pay should be calculated based on any commission you are usually paid. If your weekly pay differs due to commission, then your employer will need to work out your average hourly rate over a 12-week period to work out your weekly pay. Your redundancy payment would then be calculated based on your weekly pay, length of service and age. To answer your second question, your redundancy pay must be based on your pay pre-furlough. Hope that helps!

This was a great informative video , going through risk of Redundancy process at my current company , Could i ask please what if i have an new job offer and i need to start immediately but do not want to risk me not getting my redundancy pay ? how does this work around please. I only have a weeks notice if made redundant which puts me at a risk of finding a job so quickly .

Hi Lydia, if you are required to start your new job immediately then you would need to resign from your current role. By resigning from your current role, you are no longer at risk of redundancy and therefore you would not receive a redundancy payment; however, there are two alternative options: (1) you can ask your potential new employer to delay your start date (however, be sure there are no terms in any agreements that you have signed that prevent you from accepting an offer before your contract is terminated); (2) in the event you decide to resign with one weeks notice, you may want to try and reach an agreement with your current employer in the form of a settlement agreement - this is at the employers discretion and depends on the circumstances surrounding your potential redundancy - nonetheless, it is worth looking into further and discussing with your employer. *Reminder: this is not legal advice. You should go back to your company and talk to them about it, see why they have offered you less and tell them the amount you think you should receive! If you’re not happy with the reasons then you can ask your solicitor to negotiate on your behalf.

Great content. From an ethical and legal stand point, can consultation be done earlier before 30 or 45 days scenario especially if the business is slow in its business process or decision?

Hi, it is not mandatory for your employer to offer you an enhanced payment but you’ve been there for a very lengthy time so it would be nice if they did esp when there is no alternative job role offered. Have they explained to you why you are being made redundant?

@@thelawprocess5856 No, not yet. The building that I work at is closing at the end of the year (with most departments moving elsewhere) There's talk that my dept is not included, but no confirmation yet. Just wanted to be aware of my options, realistically!!
