The plaintiff says he hired the defendant to do some siding at his property, but he claims all the workers were recovering addicts who didn’t know what they were doing. He says he had to hire someone else to fix the job, so he’s suing for the cost. The defendant says the plaintiff’s partner agreed that the residents of a sober house would be paid for their renovation work, and he claims the defendant has money troubles.

We had our roof reshingled by a company who only hires ex-cons. They did an amazing job and were so pleasant to work with. Everyone deserves a second chance and opportunity to make their lives better.

@@ashiajohnson1740 You can still be aware just because their ex con doesn't mean they're any more dangerous than the neighbor that's lived next to you for 10 years the only difference is that didn't get caught yet you don't realize how many people you interact with every day are just as dangerous if not more dangerous most ex cons r cons because of drugs, dealing, even driving while revoked..not every ex con is violent either

I have been in recovery for 32 years. I also have been a Chemical Dependency counselor for 25 years. Lived in a sober house early on. Everybody deserves a chance but... On my side there are so many people like the Plaintiff that take advantage of skilled recovering people for cheap labor out there it's ridiculous! He is so wrong! Defendant is a good guy who was taken advantage of. I have seen it so many times as a counselor and as a friend. Good job Judge M 👏 👍 Thank-you 💜 😊 ✌

No, but it was the plaintiff's fault in a way. Yes, it is horrible to find out your partner took you for a ride, but leaving a guy in AA run your liquor store would be considered irresponsible, so how is the plantiff not considered irresponsible for allowing a recovering drug addict to have such unchecked power in an environment where drugs and alcohol is the binding subject on everyone's lips?

I would not feel too bad, from all the testimony they were doing the job on the cheap thereby making the house less fit for the recovering addicts they were supposed to be providing shelter for.

95% of "addicts" are functioning. Many raise kids, go to work, and study. Being crap at your job is not synonymous with being an "addict"

“Functioning” is a loose term. Being an addict does mean your brain fires differently, it means poor choices, lacking ethics, changed behavior and disconnection with reality. A clean or recovering addict is different than an addict.

Yeah I'm sure they have lots of skilled / lifelong tradesmen, roofers, carpenters, etc. who have had lots of free time in their past to pursue these things currently living in a sober house.

One of the first things I learned volunteering with Habitat for Humanity was offsetting seams. Something to do with moisture? I think the judge said before that her family members are in construction.

My husband is a Contractor. He always makes a contract before he does a job and gets paid in increments as the work is done. He always leaves a chunk of money for the end of the job and he gets that when the job is done. His dad taught him to do that and he always has happy clients.

That is a sad situation, but there's a few things that stood out to me as the cause of the issue, ones I can't overlook: - the plaintiff had, as I understand it, 3 recovering addict houses (so houses where drugs are the hot topic) where he left a recovering addict, Ricky, with unbridaled access to money and power in hopes Ricky will fix the drug houses. -Both the plaintiff and Ricky wanted to save money by hiring recovering drug addicts blindly, failing to add the support needed for the addicts not to fall off the wagon. -Yes, the defendant was amateurish for laying the siding straight, as all the pros I talked to for my siding have told me this allows water to run straight down the seam should something go wrong. However... - The defendant was paid about 1/4 of the cost it took the guy to fix it. This means that Ricky was not only looking for a young buck to do the work, but for said contractor to cut the corners that the defendant claimed he was asked to cut. -Again, though everyone deserves a second chance, why did the plaintiff not be more active in Ricky's dealings to avoid all this mess?

@Kre410 K that might be what they call them where you're from, but please rememeber that there's a whole world outside the US that don't have slavery on their mind. In my country, as well as many others, calling someone a young buck refers to the characteristics of deer; a young man whose got his first antlers, a lot to prove, and not much experience to prove it with. They are usually rather ambitious and a little impulsive, but not ill intentioned. And much like a young deer, they tend to learn best by stumbling a few times into the wrong answer before gaining the humility to calm down and learn from others.

Every siding/contractor I spoke to explains that it is to avoid leaking... If anything seams fault due to age or something, you're not getting a big long line of water damage. However, they do admit that they often deal with amateurs who think either brick (every second row staggered half ways and in line) or straight layout (like she said) to make it "look nice"... I know nothing about siding, but when I needed to fix some, that was the first thing I was told.

@@Maninawig Looked to me like he did a really shoddy job, both on the seams and along the bottom of the house. It's a shame the plaintiff did not have evidence of repairing the bad workmanship. If he had paid a licensed person to do the repairs & shown a receipt for that, he would have won.

@@JamieM470 you can blame the defendant, but there is a hint there where the defendant's hands were tied (beyond his nieve skills) : 1) he was paid $1100 and forced to hire two addicts in order to complete the job. 2) it cost $1000 for the father (the only pro in the story) to spend a day fixing the windows. This means the defendant had $100 left to split for supplies and hiring even less qualified people. (Ones who could have easily caused the window issues in the first place). 3) the plaintiff's handiman charged him $4500 (nearly 4 times what the defendant was paid) to do the work correctly. All that applied, I would have to say that, while the seams are an issue if inexperience (not shoddy, as I have seen it done by apprentices who did everything else correctly), the defendant's claim of being told to cut so many corners was valid, to the point that his work reflected how he was treated by both Ricky and the plaintiff, who later took out all of his fustration towards Ricky onto the defendant. Had the plaintiff offered the extra money to fix the issues and do it right, not only would have the guy pulled his resources, but have been an amazing character witness to state how shady Ricky was.

It's really hard being a alcoholic or drug addict over 90% usually relapse n me as a recovering addict who stood sober for 8 years prior to my wife passing in 2018 I know how easily it is to relapse. I actually relapsed on the same day she passed away n stood on alcohol n drugs for almost 3 years I just recently started getting sober again I been clean for 2 weeks now which is the longest period of time I been sober since she passed away n I struggle everyday fighting my demons n trying my very best not to relapse again but everything becomes a trigger when you been on alcohol/drugs on n off most your life it's just extremely tuff to stay sober

As a former factory trained employee of a siding company, I can tell you that without a doubt the work is unacceptable! The seams of the panels SHOULD BE STAGGERED! This is so you don’t see a distinct line in one place where the panels overlap. The panels closest to the front of the house should overlap the panels closest to the rear. Wood siding expands and contracts less so the boards are butted and the seams don’t show. Vinyl siding has to be overlapped because it has to be able to move because it expands and contracts more. The object is to make the seams the least noticeable as possible. You NEVER strip the old siding from the house. In fact, you must replace any rotten wood BEFORE installing vinyl siding. The foam insulation is to increase the R-factor of the house and to smooth out the walls so the vinyl siding lays as flat as possible.

My dad did vinyl siding for many years. I worked many jobs with him. The seams where siding comes together should NOT be lined up. The defendant doesn't know what he's doing.

The term "Domestic partner" has been around for a while. I first heard it when LGBT became prominent. This was also the legal terminology used to add your partner to your insurance plan at work. Not a husband nor wife; rather, a "domestic partner".

Harvey's question about being "ok" with recovering addicts doing the work...lame. The fact is there are recovering addicts EVERYWHERE in all walks of life, in all socioeconomic classes. There are many insurance companies that cover treatment for those fortunate enough to be covered by such insurance. Whether he's aware of it or not, he's really asking if people are ok with recovering addicts who are not economically stable doing the work. It just shows how often class is a factor and that it's simply not recognized.

Im not no siding expert but I can tell you 100% it needs to be staggered. I grew up with a large family and friends that are contractors and my parents have owned many income properties over years.

Siding seams should 100% be staggered…… the fact they even laughed at this was telling. That being said, I have zero issues with hiring ex cons. My Dad hired a lot of men to work his construction site who were deemed unhire-able by other people’s standards and they were almost always grateful for the opportunity and worked their butts off.

You stagger the siding for one looks so you don’t see a line at each connection and two to help the structure of the siding so seems don’t pop out and siding fall down from wind.

I was in the roofing industry for nearly 30 years. Worked on a few prisons. One time while we were in there and they ran background checks, three guys wound up not being able to leave because they had active warrants. 🤣

I'm going to break this down for everyone. I've roofed my entire life. Literally. I'm a 2nd generation roofer. Started helping my dad when I was 8 by cleaning up trash. It's almost a requirement that roofers are either on probation, have baby momma problems, be addicts s/recovering addicts, have a suspended driver's license, have no transportation/very unreliable transportation,a felon and a bad attitude. If you have a combination of any of those you have a great shot at being a roofer. Roofing is hard, hot, unforgiving work that normal people are smart enough to leave alone. Unless your one of the very few who have sense enough to clean up and open their own business it's not worth it in the long run if you plan on living great in old age. It's not. But at the same time a roof is one of the most important things humans need across the world. They may not have power, plumbing, ac/heat, running water or even walls but they always have a roof. Even if it's made out of reeds, mud, ice, shingles, metal or solar panels. Shelter consisting of mainly a roof is vital. At that's left up to people who usually can't get along doing any other work.

@@oldageisdumb if you can afford one then that's what you should get. Shingles are getting more and more expensive so it's an easier decision these days. Shingles are made from asphalt which is a petroleum product. So if the price oil oil goes up you can just about count on shingle prices to follow. shingle prices don't fluctuate as much as gas prices but the same principle. There are different types of metal roof with a pretty wide range of pricing. The cheapest metal roof you can put on has exposed fasteners (screws). Still a much better roof then shingles. Usually has a lifetime warranty but you will still have to change out the screws every 15 or 20 years because the washers on them dry out. But if you get a standing seam metal roof your literally one and done. No fasteners showing but takes a good bit longer to install and can get pricey. Well worth it if you have the money. I personally would stay away from getting a colored metal roof for 2 reasons mainly. First one is once you choose that color your limited on what you can paint your house in the future to match. The other reason is no matter what they tell you the color always fades over time. I always advise that people just go with standard galvalume color (silver) because it basically stays the same shade and it's cheaper then colored metals. Usually substantially cheaper

@@oldageisdumb yea, it's not as bad as they used to be. These days our roofs are decked in solid with plywood or the metal is installed over the existing roof with a perlin system. Which is essentially 1x4 screwed to the existing roof then the metal screwed to that. In years past if you were in the attic you could see the bottom side of the metal. So when it rained it was similar to beating on a drum. Not much of an issue these days. It's not much different then any other roof these days as far as noise. Definitely do your research on the contractor you choose. That's the most important thing I could advise. It can be the best purchase you've made or an absolute nightmare if you have the wrong people do it. I made a living going behind people fixing what they said they could do. Anytime a roofer has to go behind another it's becomes very expensive.

Okay non-carpenters here's the drill: those seams absolutely should be staggered. Her assertion that it is like sewing is laughable. So much for her father's 60 years experience, it obviously didn't flow down to her. The difference in the siding height is due to the bay section probably having been added later. It does not have a foundation under it. It would have been very easy to add a piece of wood and make sure the siding is even. Insulation board is not adequate under vinyl siding (although you can make it work if you make sure you nail in the studs.)

I was in construction for over 35 years, and that is a lousy job ... and yes, you have to stagger the seems, and the siding should line-up equally around the house ... staggering the seems, helps with strengthening the siding in place, as one sheet overlaps the other, and a full length overlapping that seem for strength ... placing all the seems in one place, not only looks awful, but weakens the whole of the siding ... as the wind may get under one of the seems and lift the whole lot off the side of the house .... and if you need to add a base to even things up, then that should have been included in the estimate ... holy shit ... LOUSY JOB PERIOD! It nice to help recovering addicts ... but only in the trades they know well ... like I would not hire a recovering butcher to build a house ... one that has never done so before ..... or at the least make sure to be there, so the job is done well ...
