My fiancée of 5 years died in Jan 24.He left no will, nothing on paper or computer as to the divisions of his things. He n I had talked about something’s. Of course he didn’t get it put on file.So only child shows up breaks the door open n takes what he wants.Very valuable gun collection Best bud stops in n takes a antique ham radio collection dated back 100 years. Now the estate goes through probate, son not sharing any info.Has a letter sent to me from a atty. Since I’m not related this estate is none of my concern I’m out, This son visited his dad once n lives 3 hrs away. I bought all his dad’s clothes talked to drs nurses everyday I paid for plane tickets four times to get him a break.ok this isn’t about me! What gives both of them to take property without probates permission? His buddy, not related I I had asked to buy out the remainder of balance on his car. He n I had agreed on this. Again no paper work.I wasn’t taking or”stealing” I thought I would send something to probate n get a yes or no.Its June n nothing, was told by son it is not my business. They took without court permission both valuable things they knew was there.was their action legal? Iam sure breaking in the door wasn’t. Did I mention the deceased worked on the Sheriff s dept. I never got an appreciation card from his son who lived 3 hours away.Just sad
What do you do when a family members layer is directly intentionally defrauding the courts and directly disrespecting the courts and a honorable Judge, by intentionally covering up and keeping factual legal documentation and evidence from the honorable Judge and the courts and much more? Flatter me what would you do as a lawyer if your client comes to you with legal factual documentation & evidence that meets all the rules of evidence that supports the above mention? What would you do?
My lesson was pay yourself first, which means that you save from each paycheck then you pay your bills whatever is left is available to squander on yourself.
I was told by two different credit card companies when my mother died that they only try to go after the balance for one year from the date of death. If a probate hasn't been opened by that date, won't collect. In my state I had 2 years to open probate... Think about that. Also, in our personal situation, because Mom had no real property and hardly assets, AND had left a will, probate was not required at all. I simply closed her bank accounts and emptied her apartment into my garage... End of story. Do your research before you automatically start handing out cash that you legally may not have to hand out.
What if there are two beneficiaries and one of the beneficiaries dies first. does the deceased beneficiaries’s half go to their spouse or to the one surviving beneficiary?
There should be a 3 month policy under law that allows people to mourn the loss. People should also think about trying to put away money for instances like this.
So true. I cannot tell you how many meetings I've sat in and listened to executives read off of power points and never get feedback from people like me their manager/ supervisor who are essentially are the face of your company and engaging with the public who you want to purchase your products about what they want and their issues. But I guess when you make a mid to upper 6 figure income your only real concern is keeping the checks coming in. Not improving your business.
attorney "one who is legally appointed to transact business on another's behalf" does not have to be a lawyer, so anyone going to this idiot "Caveat emptor"
The language is correct. The part that's dumb is the part where we decided everyone who represents others in legal matters has to have a bunch of lawyer training and licensing, driving the cost into the roof so now only rich people can use a justice system that was intentionally created for use by ALL PEOPLE.
Unions use attorneys in fact and there are arbiters. But, as Franklin stated, a man who represents himself has a full for a lawyer and an idiot for a client. I paraphrased but that is the gist.
He's just mad that someone that never studied law (like me), schooled his dumb azz on the law...I have made this comment before, and it was probably him replying that I was wrong..."Oops?"
Michigan is full of dumb laws I'm not allowed to cut my hair without my husband's permission or tie my alligator to a fire hydrant can't put my ice cream in my back pocket horses not allowed on the street before noon on Sunday but hey dead bodies are fair game in the dating pool.
Why does the state have to get involved in everything? What happened to ordinary social ostracism and mockery? Don't give politicians any more fuel to their sense of self-importance.
In many countries that statute also covers other bad activities with dead bodies, simply defining the offence as "desecration of a corpse", leaving it to juries and judges to place various imaginable and unimaginable activities on the scale from legal to the max penalty . So a cheating undertaker who getd paid but skips the actual burial would be under that law, as would someone breaking into the crypt and graping the dead . A merciful court would be the way to deal with a widow not letting go of her husband or a religion requiring a differently shaped disposal .
It is my understanding that Melody's family pushed for the enactment of the law to ensure that other people would face charges. However rare this type of activity is, there could be a situation in which a murder does not precede the defiling of a deceased body.
