Hi, I'm Darren Findling of The Probate Pro and when a person creates a will and disinherits one or all of the children of the deeded they have every right to do so and a child does not have an inherent or automatic right to inherit from their parent a parent who creates a properly drafted estate plan can include or exclude one or all of the children from the estate plan it doesn't matter if they're the firstborn last born whether they had a lot of love or lack of Love they have every right to include or not include children within an estate plan now that's quite different than a surviving spouse who has a right through statute to elect against the will if they are excluded from an estate plan now with out of will we call that situation intestacy all of the children of the deant inherit equally in equal shares whether they're a full sibling or a half sibling whether they're the firstborn or last born whether the parent love them a lot or love them a little they all take equally that's why it's so important that if you're going to treat the children desperately and and want to favor one over the other or exclude or omit a child it's critical that you create an estate plan if you've got questions about probate related issues visit us at theprobatepro.com or call us at 833 PROBATE.
