I started this law firm for several reasons, the biggest of which was that I myself, though a father and a husband, didn't have a plan in place to take care of my family if something were to happen to me, to my wife, or both of us. To me, estate planning isn't just about passing on things and avoiding taxes, it's about protecting my family and creating generational wealth. Most of us out there believe generations after us should have it easier than the generation before. For some this happens through education, but for all of us it should happen through the accumulation and distribution of wealth AND knowledge. It's not money that makes the next generation better, it's the money combined with knowledge, family values, mission statements, family history, and all of the things that make your journey through this world unique. Our mission is to help our clients create plans that protect their families and create generational wealth, both while they are here and when they are gone.

I have 2 cars under my mom’s name and she just passed, I’m co-signer on both I believe but can’t make payments. How bad can this affect me and since I don’t have god credit already not sure if they’ll refinance and I’ll be able to pay same amount

My fiancée died 2023 and left me a handwritten Will, making me the executor .. I 'm dealing with one of my fiancée cousins who has a type Will with no signature nor dates and has already asked me to get out of my fiancée home without going to probate court first .. I have been mentally tormented and terrorized by the cousins and family members and even physically hurt over this .. What can I do before the first hearing, or should I tell the judge in the courtroom ?

This old man says financial elder abusers and greedy trustees using the estate plan Trust to steal our legacies is a far bigger problem than getting sued. So, hire an administration Lawyer who carries the NICER forgery proof crime free inheritance transfer with a Permission Validation Trust administration instead of an estate planner who promises peace of mind and refuses to help when the estate plan cost 50% in litigation court. Great video. Comments and questions - a lot of high networth family with assets more than 10 millions will think it's very tempting to create an irrevocable trust to gift the extra exemptions before the 2026 sunset, but the more I think about it the less I am sure of that. First, I would need to gift away "a lot" more than 6 millions to take advantage of the extra exemptions as you explained. Actually the more I gift away now to the irrevocable trust, the more I save from this extra exemption, up to 13 millions. If I simply gift away 7 millions now, I am not really saving much estate tax at all. The question then is - do you have a lot more than 13 millions in your networth to feel comfortable to gift away that much to your children and not spend it yourself? If you do, say you have 30 millions and above, then I am sure you can use other more advanced financial legal methods to avoid estate tax anyway. The only other good reason to gift away that much money now is if you are only 60 and you anticipate that 13 millions you gift away now will grow 2x or 4x in 20 years..... than that's indeed a big amount of estate tax to save. Comments?

Giving away only a part of the 13m is only going to reduce what you have post 2026. For example, if you give 6m now, in 2027 you don't get 13-6m or 7m. If the new exemption is 6m, you have used up all of your exemption. That's what makes this difficult. It makes the most sense to take action if you are willing to give OVER what you think the new exemption is. To continue with the example, if you gave 7m instead of 6m, and the new exemption was 6m, you have effectively captured an extra 1m of exemption. And, you don't have to give it all away to your kids. If you're married and trust your spouse, one solution is a SLAT - spousal lifetime access trust. Great questions!

Can you recommend an Administration Lawyer who does his job great instead of an estate planner who does it well. We want a Permission validated and certified complete administration not just the plan. And without the dozens of estate plan mistakes, we want the added steps to avoiid the quit claim jumping financial elder abusing title deed thieves please!

Wait a minute for years your fellow estate planners have been funding it by recording it exist at the county recorders and now your telling us not to so an inheritance thief has full access to it. Are you now telling us your the only estate planner giving full access to legacy thieves who forge the trust without a quit claim ot grantors deed transfering it into the Trust. If it's an individual, appoint someone you trust. If it's a professional company, they probably are more concerned about staying in business and out of jail than in your money.

I am about to buy a business that essentially owns the property upon which it operates... but I would prefer to purchase the real estate separately from the business. New Business pays the Real Estate Holding Business to pay the mortgage payment. They're trying to sell it all lumped together (has the realtor basically drooling) but seems smarter to reduce my property tax liability by purchasing the business separately, thereby reducing the real estate purchase have price... doesn't matter except that one way has $6-12,000 more fees!!!

You're probably going to have to buy it and then split it. Why not just reduce the fee that goes to the realtor? You can negotiate your side (i.e. the seller can pay more if he wants but it doesn't have any effect on you - you don't have to bring more money to the table)...

Dang. I'm setting up a New Market, LLC and a New Property, LLC -- is it really so troublesome for the New Market to buy the Market assets outright, rather than lumped into a Seller-Financed property transaction, and the New Property to buy the real estate for a smaller down-payment on a lesser valued piece of property? I am thinking about Seller's realtor fees, capital gains taxes, my future property tax assessment liability, might actually hurt me in future cap gains, but I'd 1031 if I don't keep it forever and develop it further down the road. 🤔

No clawback in WA for deathbed gifts. Just remember you''re not getting a step-up in basis with those gifts - sometimes paying aa 10% estate tax is worth avoiding a 20% capital gains tax...

@@CMSLawFirmLLC Great! I was worried when I heard at the 14 minute mark you mentioned WA state could do a three year claw back on gifts and count them as part of deceased's net worth. The ability to do this in WA state on one's deathbed without a claw back is important to confirm as I would assume that there are many folks in our area who have a net worth >$2.2M. And it would seem logical to gift every penny over the WA exemption amount prior to one's death; unless you really enjoy wasteful spending 🤑 (sorry about the dig on our governance ) I assume that for those with loved ones who may not be cognitively aware of these escalating estate taxes above $2.2M; that a POA could also make those gifts (if so written/granted) to avoid WA state estate taxes and there would be no recourse the state of WA could take to try and claw back and count those monies as part of the deceased's estate. I have a question. My dad has a trust in place I am the beneficiary. He is 55 he has now decided to get married to a 35 year old (younger than me!!) will this marriage affect his trust that was written 5 years ago?

If he changes it, it will. If he gives everything to her while he's alive (i.e. joint bank accounts) the trust won't matter.

Scenario 1. My parents bought a house then got divorced 4 years later. 2. The judgement ordered mom to remain in the house and dad to pay mortgage. 3. Dad never pays, mom pays 4. Mom adds me to deed, so we are coowners 5. Mom passes.away 6. Mom gives house to me and half sister as Co owners 7. I move into home and make mortgage payments 8. Dad wants to be removed from mortgage loan 9. Half sister is married has a mortgage already, does not want to assume loan 10. I have $0 and mediocre credit Can I assume loan by myself or am I stuck? #relatives #suck

How would I go about getting a gun auctioneer audited to see what guns were sold from this estate in question. Were all the same on court inventory or are there more that were sold off record as the executor admitted at one point? I know it but need the evidence to prove it. How do i get that info from auctioneer thats not going to have an opportunity of fudging it? Can i request the pics of each action item and the bids from executor or feom auctioneer? Whats the best plan? How do i get her accounts checked to see money flowing before and during?

Cost me $5000 to attain a lawyer to object to a partial distribution which included overvalued assests and home inventory that was over priced and inaccurate. The attorney and excuter threatened me that theyll up the value of the house from 50k to 120k if i dont sign that partial distribution. Shes robbing my inheritance and even this 5000 attorney is not representing me how i need him to. I want all auctions, property divids and sells halted and her removed once i show proof shes mishandling and diminishing the estate and suspecions she embezzling. What should i do to get this done? I cant afford to keep paying attorneys to talk to them in consultations...300 for a consult. These prices are waaay to high for low income Missouri. Cant afford to be treated fair. How do i get her investigated and the assests recovered for the estate? Does that mean she forfeits her 1/3 portion if found to have commited crime against estate?

Clients caveat to stop inheritance thieves and deliver Legacies requires dozens of administrative steps in addition to appointing guardians for minors, preventing conservatorships, medical directives, plan, forgery proof, fund, amend, inventory, appraise, gift small expensive items and weapons legally before they march, mentor grantors, monitor trustees and grantees, tell everyone not to fight everyone gets their share, yearly checkups, validating and transferring titles, defending distributions from pink slips to IRA Roths, instructions to trustees and grantees, and the list goes on including contacting NICER and Sherifs on call with permissions ledgers to expose and arrest inheritance and legacy thieves.

You are the grantor and trustee to start, you'll need a successor trustee to manage it and take care of you when your vulnerable so wait a few months and hire an administration lawyer not an estate planner. To install the forgery proof NICER permission validation Trust with dozens of security provisions to keep your successor trustee honest. I'd consider paying an extra Nickel on top of the Prebate Nickel to have a Paralegal Trust Guardian fill the Successor Trustee position, if the Administration Lawyer is NICER authorized to do that.

What about a holding LLC? When would form that to hold of/when you have multiple LLCs in trust. Would you create the holding once youve accumulated multiple LLCs?

Just depends. If you know you're creating a bunch of LLCs, best to do it at the beginning. You can also, in some states, create "series" LLCs, which is like multiple LLCs for only one admin fee.
