Hi there. It sounds like your interested in setting up a real estate business in the 🇺🇸. That's great to hear! There are many options for real estate investment strategies that can qualify for a visa including residential and or commerical, fix and flips, buy and hold, short-term and long-term rentals, remodeling, home construction, property management, real estate brokerage, etc. Buying and owning one residential property would not qualify for a visa because it is considered a passive investment. Buying one commercial property may qualify depending on the circumstances. Generally, our investors create a hybrid real estate investment company combining elements of the above. Please note you can purchase and manage U.S. real estate without a visa if you manage the operations from outside the U.S. See our other video on How to Invest in U.S. Real Estate as a Foreigner for more details. Hello Subhan, thanks for the very intresting and informative video!! But I have an important question?! Is this process allowed for Iranians as well, since we are on the most extreme sanctions??? Or are we are obliged to gain a green card first??
Yes. Iranians can own an LLC or Corporation in the United States and manage the business from outside the US without a visa, so long as the company complies with the Iranian Transaction Regulations, 31 CFR Part 560 (2011), the ("ITR") enforced by the U.S. Treasury Department's Office of Foreign Assets Control ("OFAC"). What about someone like me by example, i have a B1/B2 visa and i wanna open an LLC can that help me to have a residency or a green card when im moving to the US? Thank you for your reply🙏🏽
Yes. A person on B1 or B2 status can open a US LLC or C-corporation and engage in "preliminary startup activities" such as forming the company and opening a bank account. A person on B1 or B2 status cannot work for a U.S. company while "within" the U.S., unless he or she has work authorization. You can manage the company overseas without a work visa. @@pataranda9583 a valid passport, your green card, and depending on your citizenship a visa. If you are a German citizen, then only your valid passport and green card. Have a great trip!
Yes. Absolutely. There is no minimum to start a business in the U.S. The 100K we mention in our other visas are what we recommend as a minimum for E-2 and L-1A visas. But, if you are going to manage the operations from abroad, then there is no minimum to start the US business. I’m a foreigner and I have a Florida LLC that has an EIN and it owns an apartment in Miami. I’m looking at investing in more real estate in Miami or Texas, but I was wondering if I would be eligible for financing. What’s your experience on financing for foreign nationals in the US?
Yes. If you own the property in Miami in full, then you can use it as collateral to obtain loans on other properties or do a cash-out refinance or other alternative financing strategy. There are banks and private lenders who specialize in loans to foreign investors. Book a call with us to discuss your options here subhanlaw.com/book-call-page

If you are a South African citizen providing freelance marketing services to a client in the U.S. while living and working in South Africa, and your business is registered in the U.S. with a U.S. tax number (such as an EIN) how this works in terms of tax
Yes. A South African can manage a US LLC from South Africa and it may be able to operate tax-free under certain conditions. Even if a U.S. LLC owned by a foreign national can claim a tax-free exemption, the LLC still must file an "informational return." @@Subhanlaw I apply for my son adjustment of status since December only thing I got t is he receipt I got my greencard though vawa I thought by now he would have done his biometric
Hi Kerisha. I'd recommend creating a USCIS account and seeing if a biometric notice was ever sent. Also, check his USCIS case status online. Lastly, you can call USCIS Customer Service. Hope this helps.
I have an USCIS account and I check it all the time to see if they need out anything but it haven't shown I will give it again until the end of the month thank you
Please make sure that your son has a USCIS account too. He would need to check on the I-485 through his USCIS account to see if the biometrics have been sent. Hope this provides clarification. All the best!

Hi Nasir. Some benefits also apply to nonimmigrant visas. However, not all the benefits are applied the same. For example, Green card (GC) holders can live and work in the 🇺🇸 permanently, are eligible to apply for US citizenship in 3 or 5 years, can work at any employer that they are eligible and start or work at a separate business as well. H-4 holders cannot live in the U.S. permanently, cannot apply for citizenship, and are generally not able to work, unless they have an EAD. H-4 holders can own a C Corp or LLC, but generally H-4 holders cannot work for their own business, unless it is they have an EAD, otherwise they'd need to hire a manager to oversee the daily operations. There is much more flexibility and certainty with a GC than an H-4. With a GC you have many more benefits and peace of mind. Sir i want to close my llc permanently. Sir please tell me (BOI) is mandatory for me to submit (BOI) before closing llc permanently or not. Sir i am from India and i am a owner of a non usa resident llc in the State of NH. Sir please tell me what to do.
If you formed your NH LLC prior to Jan 1, 2024, then you can dissolve the NH LLC prior to Dec 31st, 2024, and you would not be subject to the BOI filing requirement with FinCEN. We also recommend that you send a letter to the IRS with your EIN stating that the LLC was dissolved so that the federal government is also notified of the dissolution, so that your EIN won’t get cross referenced with FinCEN. Please note that if you have been operating in 2024, then you may have a tax filing requirement for 2024 which would be filed in 2025. I would highly recommend booking a call with us prior to dissolving your company to ensure you do everything properly. Book a call with me here subhanlaw.com/book-call-page
@@Subhanlaw I am a citizen of India. I opened my non-USA resident LLC through myusacorpration, and it has been approximately 9 months since its formation. I established my LLC for Amazon e-commerce, and the address of India is mentioned on my LLC. So far, I haven't registered my LLC business on Amazon, not have I engaged in any business transactions. I haven't earned any dollars from my LLC business, and I haven't created a business bank account. Furthermore, I haven't filed any returns because I haven't earned a single dollar or conducted any transactions from my business. In essence, I've only opened the LLC and haven't done anything else. Sir, now I want to close my LLC because I don't need it. Do I need to submit (BOI) before closing my LLC, or will my LLC be closed without (BOI) submission? Sir, please explain in detail whether I might face any issues in the future if I close my LLC and whether there could be any penalties. Sir, I want to permanently close my LLC. Thankyou for answering me
To apply for an E-2 investor visa, the E-2 company must first be registerd through the U.S. Embassy in Turkey. Also, the E-2 investor can only work for the E-2 company. However, the E-2 company can own subsidiaries including overseas companies which may allow you to continue to transacting business from within the U.S. for your existing businesses. In addition, an E-2 dependent spouse can work for any company that he or she is eligible including overseas companies. Therefore, there may be a few solutions for you. I want to start a shoe business in the US (New Jersey) as a Dutch citizen. The business is basically buying shoes online mainly from Nike and then reselling them on platforms for a profit. Is this possible if I only have around 5-10k capital? If so what are all the steps? Will I be able to get a resellers permit?
Generally, you can resell any lawful purchased good and you can also identify the product by its brand name. You cannot suggest that you are authorized by Nike or are an authorized distributor, etc. We can help you with starting a U.S. LLC and obtaining a reseller's permit. Please note if purchasing directly from Nike Stores that their "terms of sale" state that buying for purposes of reselling is prohibited. Therefore, there is risk involved with the business model you proposed. To discuss your options in more detail, book a call with me here subhanlaw.com/book-call-page
@@Subhanlaw I tried selling two products on ebay and ebay told us we had a 600 dollar sale limit. But nike shoes get resold everywhere and nobody has faced a problem yet for reselling nike shoes on platforms. How much will it cost me to obtain a resellers permit through you guys or if I try to obtain it by myself?
Please note that each ecommerce platform has its own terms and conditions. Ebay places "selling limits," sometimes called selling allowances, on new sellers to protect its consumers. Google "Ebay selling limits" and you'll see Ebay's selling limits terms and how to request an increase in selling limits. I'd also recommend taking a look at StockX and Flightclub as alternative places to resell shoes. You may also consider creating your own website on Shopify to resell shoes. Also, Nike has brough actions against resellers. As I stated, Nike's "terms of sale" apply to purchases through its corporate owned Nike Stores. Buying from an authorized retailer may not include the same "terms of sale". For example, The Finish Line, Inc. does not have a provision in its terms of sale that prohibits reselling of products including Nike products purchased from its stores. In addition, the cost of a reseller's permit depends on the state or states in which you need a reseller's permit. To determine which state or states apply to your situation, we require a paid consultation. Thank you for your question. Unfortunately, no. The information in the video applies to foreign nationals who are considered "non-residents" under the U.S. tax code and who are managing their U.S. business from outside the U.S. A person on H-1B or H-4 is within the U.S. and after residing in the U.S. for 183 days aka the "substantial presence test" then a person on H-1B or H-4 or any other nonimmigrant status is considered a "U.S. resident" for tax purposes. See my other video on How to Start a U.S. LLC For Foreigners which applies to your situation.
Hi there. As we explain in this video, you cannot have any U.S. employees as well as meet other conditions, if you want to start a tax-free U.S. LLC. If you want to hire a part-time or full-time U.S. employee, then your U.S. LLC would be subject to U.S. tax. Please note that I stated a "U.S. employee". You can hire a manager from outside the U.S. and the U.S. LLC would need to pay the manager as a foreign employee or foreign independent contractor and in this scenario may not be subject to U.S. tax. To discuss your options in more detail, book a call with me here subhanlaw.com/book-call-page
@@Subhanlaw Thank you for your answers…..I want to hire a person and I’m ready to pay taxes but I was just wondering whether I can hire an employee part time instead of full time….cause I can’t be self employed in my own company due to my visa (f-1) status but I can hire someone to manage it for me…..so hiring someone partime would be more financially beneficial for me.
I'd recommend booking a call with me to discuss your options. Owning a U.S. LLC on F-1 status, you'll need to consider operating agreement provisions on management and immigration compliance, hiring considerations such as whether to employ the manager as an employee or independent contractor, tax considerations, etc. Hiring someone either as a part-time or full-time employee requires considerations on labor and immigration law, payroll, and tax, etc. Hiring a manager as an employee is not always the best choice. You will also want to consider if hiring the manager as an independent contractor is better under your specific circumstances.
