In this video, I'll take you step by step through each type of document above and explain in detail how you can show proof of a bona fide marriage when submitting an I-130 Petition.👍
Many people think that all you need is a marriage certificate when submitting an I-130 form. Unfortunately, this is not the case under federal immigration law.
While a marriage certificate does demonstrate that you are married in a particular state under state law, the U.S. Citizenship and Immigration Services (USCIS) requires much more documentation to prove a real marriage.😱
When applying for your green card through marriage, you should definitely get experienced legal advice from an immigration lawyer. You'll save time, money, and get peace of mind knowing everything's being done right.💯
Did you know that USCIS says it takes approximately 1200 hours to complete just one form (i.e. I-485 form) including preparation, gathering all the documents, and drafting supporting documents!
If you value your time, money, and convenience, you'll understand that a competent immigration lawyer brings tremendous value when helping you with the green card process.❤️
For example, if you made just $10 per hour, that means it would cost you over $12,000💸 of your time to complete just one form. Subhan Law Office, LLC, can complete all 7 immigration forms for you within 3 business days.
We are the only immigration firm in the USA that offers an on-demand learning center that walks our clients step by step through the process on how to apply for a green card through marriage.👍

In the I-485 application, we asked that a Social Security Card be issued concurrently with the Green Card. Banks require a Social Security Number in order to add your spouse to your bank account. So when you say to show joint bank accounts, that is really difficult under current bank rules.

Hi Thomas. Each bank has its own internal policies. All banks and credit unions do not require an SSN nor ITIN to open a joint bank account. You can also add your spouse as a Payable on Death (POD) or Transfer on Death (TOD). Ask your bank for a POD or TOD form. Hope this helps.

Will USCIS accept it if the couple presents evidence a federally subsidized joint health insurance policy?

Hi Mac-Paul. Under the "public charge" rule, use of public benefits could be considered a negative factor in a public charge inadmissibility determination. This means it could affect your chances of admission or adjustment of status. I would highly recommend that you consult with an experienced immigration attorney before filing. Here are some resources for you: www.healthcare.gov/immigrants/lawfully-present-immigrants/ and www.uscis.gov/news/public-charge-fact-sheet To discuss your case in more detail, book a call with us here subhanlaw.com/book-call-page

What about long distance relationship? We simply won't get to live together until I can move to the us, but I can't move to the US unless I get the GC ... So really, we will only have documents such as flight tickets, picture, skype logs, letters from our family/friends maybe.. would that be enough?

Hi Tereza. Thanks for your comment. Congratulations on your marriage! It sounds like you are applying for a marriage visa through consular processing through a US Embassy/Consulate. When applying for a marriage visa, it is the petitioner's (i.e. US spouse or green card holder) burden to establish a valid and genuine marital relationship. You do this by providing supporting documentation of your valid marriage. Flight itineraries, pictures, skype logs, and letters from family and friends is a good start, but in our experience USCIS and DOS will want more documentation. There are many ways to get you added to additional documentation. Have you already filed an I-130 petition?

@@Subhanlaw Thank you so much for your answer! We're not married yet (I'm still studying), but I'm trying to figure things out in advance (it's all pretty overwhelming). I'm Czech so we can't do the direct application through embassy. We haven't obviously filed any applications yet either. So the US spouse has to put together all the evidence? (I always assumed it'll be up to me, also I'd actually enjoy that, not so sure about him :) ) Is there any preferred format (number if pages, pictures, etc) ? I haven't been able to find any information on this either. As far as documentation goes, we'll have the plane tickets/visa stamps (we have visits every winter and every summer), letters, pictures, we write a journal to each other so that as well, chat logs and PayPal statements of him sending me money for the flight tickets. Also I think he put me as the person to receive the insurance money in case of his death (not sure what you call that). And obviously the marriage certificate once we get to it :D since I'm still a student and will be practically until I leave, I don't have anything (no mortgage, no loans anything like that) and he only finished school last year so he doesn't have much either besides some savings. Obviously we can't have a joint account until we're married and I'm in the us, so that won't be an option. Thank you again for taking the time to answer 😊
