Family Settlement is an agreement by which on mutual consensus the movable or immovable property dispute may amicably be settled between the family members.

Sir bahot acchey se samajhaya aapne, aap mujhey ye bataye k agar zameen dadaji k naam ki ho or inkey 4 bacchey hoo, jinme se 1 (Badey ne) 1st floor ka half portion banwaya ho (no proof), or baki tino bhaio ne other half portion ko banaya ho(no proof) to is case me partition 1/4 he hoga ya kuch or bhi hoga kaanun k hisaab se? Hi sir, we have a property which was bought by great grand mother between 2 childerns i.e. my real dada ji and cousin dada ji but the property is registered on my cousin dada ji but it is a mutually decided that the property is divided between two parts 50/50 between my dada and cousin dada ji. We are planning to sale the property but finding difficult to make the things legal and cheap for the selling purpose. Can you please help what we can do?

My mother expired in 2010. I was living in the house with her. An affidavit required by Nagar Nigam was prepared In my favour by two sisters and one brother agreeing therein that "the house may be given to me and they have no objection if the house is transferred in my name and let me be owner of the house and transferred her name and number there will be no issue in future also also.

The ownership was transferred in my name with mutation by the Nagar Nigam. There is no issue at all and I sold the property. Hlaf plot sold and half portion is on SPA.Now the person whom I have given Special Power of Attorney ask me that his loan is not being passed by bank. 1) Is it my duty to get the loan sanctioned for him? He again argues why you did not get registered the Affadavit by your brother, sister registered? Also he says that the mutation is illegal. Pl clarify and help. Thanking you

Need some legal advice. I am staying in a dda flat from last 34 years. My neighbour flat is lying vacant from last 27 years. No one had even came once to visit this flat, electricity meter, water meter both got disconnected in the year 1998 due to non payment of dues. I had tried my best, went to the dda office, sdmc office, sub registrar office, but all efforts gone into vain. Actual owner is not traceable. who will be the new legal owner of the flats whose actual owner are not traceable? Is there any process to know the actual owner of this flat?

@@LawnLaws the land records for complete Halqa are seiezed in vigilance office. My residential flat is 900 Sq ft and residential plot is 3000 sq ft but we are two heirs. So in this case ,will the family settlement get me the EWS?

Mere chacha ne 20 saal pehle kuchh paise contribute kiye the mere dadaji ko ek plot lene me... Wo plot dada ke naam pe hi hai. Par chacha bol rahe hain wo plot unko milega separate aur iska koi share nahi hoga... Is it justified? He doesn't even have any proof that he had paid some amount to my grandfather... Sir My father transferred 8 lac eupees to my wife account. I requested her if i can buy flat for us. i took some loan and used this 8 lac as downpayment, did buy a flat on my name only. After my father death, my brother is asking for a claim. I am not getting one thing, has he even got right to claim as i have taken money from my wife and bank and not from my father. I have already repaid loan to bank. The transfer from father to my wife to me to builder can easily be shown as transfers. Also if i transfer this flat to my wife, will he not be able to claim anyways, as its wife's property from thence upon. Kindly reply.

If that Daughter's name is not there then as per WILL u will become the Sole owner of that property. Also That WILL should be registered and approved by court.

@@LawnLaws sir kisi bi samjhute ke liye teyar nahin hai. Ek maa baap nahin hai. Wo 2009 main expire ho gaye the tab se bahi ush ghar main hai or main rent par reh raha hoon. Meri wife apne maa baap ke yehan hai. Or hamari apas main banti nahin. Na hi dono bahi behan ish bare baat karne ko teyar hai bas yehi kehte hain de denge par aaj tak ish par koi baat nahin kari. Kya karna chiye.

before my grandfather's death (nana ji), he left a will where its stated that the land will be equally divided between my mother and uncle. But after his death, my uncle stole the will and its been 13 years he still has it. My mother tried to ask for the division of the property but my uncle is not willing to hand over a copy of the will neither he wants to divide the property as per written in the will. He is adamant to inherit the entire property. so please advice me on what to do in this situation and how to handle it peacefully?

डिक्री (decree) सिविल न्यायालय द्वारा दिये गए निर्णय के बाद जारी होती है जिसमे पक्षकारों के अधिकार निर्धारित होते हैं। यदि सिविल न्यायालय से मिले ऐसे डिक्री को अपीलीय न्यायालय में चुनौती दी जाती है और निचली अदालत का फैसला पलट दिया गया हो तो डिक्री का प्रभाव भी स्वतः ही खत्म हो जाता है अथवा संसोधित डिक्री जारी होगी

सर नमस्कार मेरे पिता जी ने बटवारा किया था हम उस हिसाब से काबिज है ओर मेरा भाई जमीन का बटवारा नही कर रहा था तो मैने न्यायालय में अपील करके ग्रामीण कैम्प में अपने हक की जमीन नाम करवा ली ओर अब मेरे बड़े भाई ने उस जमीन पर केस लगा दिया फर्जीवाड़ा कर दिया गया मामला न्यायालय में है मुझे ये बताये कब्जेअनुसार बटवारा सही है या नही क्यों कि हमने पूरे खेतो में दीवारे करवा दी है हमारा सब पैसा लग चुका है मेरी बहन मेरे पक्ष में है अपनी राय देवे हुकम

सर यु टयुब पर आपकी वसिहत के बारे मे आप जो बाते बताते है वो हम सुनते है मेरा एक सवाल है मेरे पिताजी ने वसीयत रजिस्टर की है मां और पिताजी गुजर चुके हैं संयुक्त परिवार मे पिताजी ने अच्छे दिनों में दो बड़े भाइयों को( 89आर) जमीन लेके दी थी तब मै 12 साल का था और उसी जमीन में पिताजी और मां (90 आर ) आधी जमीन के मालिक थे पिताजी ने वसीयत में लिखा है मेरे मरने के बाद इस जमीन को बेचना याने बिक्री करना और आने वाले रकम पर तीनों लड़कोका समान हिस्सा रहेगा लेकिन मेरा एक बड़ा भाई कहता है मै सिर्फ पिताजी का ही हिस्सा दुगा । वह खेत 1हे 79 आर है । तो क्या मुझे मेरे दोनों भाई के बराबर हिस्सा मिलेगा

Sir किसी मजबूरी में किसी के पिता ने थोड़ी सी राशि के बदले करोडों का हिस्सा बाकी सदस्यों के पक्ष में छोड़ दिया हो और वह संपत्ति बिना वसीयत की हुई है तो उन पोतीयों का क्या राइट्स है जो उनको मिलना चाहिए थी दादाजी के सामने ही जिनका जन्म हो गया रहो.और उस स्टाम्प की कोई रजिस्ट्री नहीं हुई है और वो संपत्ति भी बेच दी गई उन लोगों को कोई जानकारी नहीं जिनके दादाजी की ये संपत्ति है. पिता जी चुपचाप है भाइयों के विरूद्ध कुछ एक्शन नहीं लेते हैं.
