Firstly I would like to thank you for initiating this channel, in my opinion it has a great positive impact for all HR professionals as well as the whole of working community. I have 2 questions for you Sir, would like to pick your brain. 01. can the employer temporary suspend an employee as punishment. This particular employee has a habit of not reporting to work without informing and during the work hours he goes missing. However, this is the first instance we came across this behavior with this person, we have already advises him but no improvement and warnings won't work, therefore in order to discipline the person with good intention can we suspend his work for a period of 3 months without pay. Will that be considered as constructive termination in the eyes of law or is there any other way to discipline the person in your view. 02. If a person can be suspended without pay as punishment, then how do we decided on the period. The intention is here to not to terminate the person but to get him on to the right track. Suspend without pay for 3 months can be consider as constructive termination. after giving charge sheet you can give punishments and if them are not work you can increase punishment gradually. (it call progressive discipline ) finally you can terminate the person but it should done after giving several warnings

There is nothing to prevent an employer to suspend a worker without pay for fraud. Of course employer need to conduct the case speedily without dragging it for months and months. If You find that the employee has robbed the company, and if you have evidence and could be proved at a domestic inquiry, as Ajith says is it necessary to further compensate the thief.? Don't try to learn an important matter from a "WENTA LAYER " or 1/2 backed lawyer to be.

Yes, According to labour law ( wages board ) It has to be given. if you request it employer has to give even as a report with signature and rubber stamping.
