I believe he'll be successful in appealing the murder conviction. The state already failed to convict Zach Anderson when the original trial resulted in a mistrial. In this 2nd trial the lead prosecutor was ordered out of the courtroom by the judge after it was revealed he'd met with a witness weeks before the trial and her story changed after that meeting, a meeting which was never revealed to the defence pre-trial. The prosecutor was reprimanded by the judge but the witness was allowed to testify with her altered recollection of events albeit with the prosecutor absent from the courtroom. The same prosecutor while questioning another witness, a felon testifying against Anderson in return for a reduced sentence, was clearly caught on camera mouthing the reply he wanted from the jailhouse witness who hadn't yet answered him. He mouthed "Die! Die! Die!" before the witness uttered his identical reply (allegedly said by Anderson describing his outburst during the murder to the witness in his cell) and again the judge brought this up and noted the defence's complaint after this coaching of the witness was caught on livestream. There was no evidence presented that placed Anderson at the alleged crime scene and the speck of DNA (not blood) belonging to Gutierrez Jr found in his van proved nothing. The daughter testified she was in the van on many occasions often for whole days traveling from place to place with her dad Zach and she lived with her mom and Mr Gutierrez Jr who stayed there regularly so the speck of DNA could easily have been transferred to the daughter in the home and then into Anderson's van. There was no CCTV evidence of the van on the night of the alleged murder yet it was claimed the van was used to transport the body to its final destination. No speed cameras, doorbell footage, cameras from shops and local businesses etc caught Anderson's van in the vicinity of the crime scene that night. No witnesses who saw him. He was clearly guilty of stalking his ex and his involving of his young daughter in this was despicable and criminal behaviour that he was rightly convicted and sentenced for. But murdering the alleged victim wasn't proved beyond any reasonable doubt and the facts the prosecutor was out of line twice at least for coaching witnesses before and during the trial plus there were other men with the motive to hurt/kill Mr Gutierrez Jr but who police didn't investigate leaves the opportunity for an appeal and possible 3rd trial for the muder allegation or acquittal wide open.

Such a misscarraige of Justice for both sides. RG family doesn’t have answers and this prosecutor was allowed to manipulate a child (with the mother) and put a 14 yr old on the stand. So many inconsistencies. Prosecutorial misconduct as he lied many times to the court and jury about “facts” evidence. GPS didn’t put him there. Text messages didn’t. How do you dispose of a body with 13g bags? Blood evidence was misstated. Etc etc

Jury should be absolutely ashamed of themselves. They get a little leeway because the prosecution was allowed to tell them multiple outright lies, but even then there was no evidence he did this, and all kinds of common sense evidence that he could not have killed Rosalio. Not only is an innocent man in prison the rest of his life, but if Rosalio is dead, his family does t have justice.
