Not necessarily, but for liability purposes it’s helpful. If you have a signed Bill of Sale that should be okay 👍

Had to do a bit of research and hope this helps. Assuming, you've inherited the vehicle after a will was fulfilled / estate assets officially distributed and it's not subject of any ongoing estate dispute. If so, this DMV document overviews what you will need to do ( (dmv.ny.gov/forms/mv843.pdf). Of note is the sales tax technicalities. It appears if you inherit the vehicle (i.e., didn't purchase the vehicle from the estate) you might be exempt from needing to pay a sales tax (www.tax.ny.gov/pdf/current_forms/st/dtf803.pdf) - under "7. Settlement of estate: The motor vehicle, trailer, boat, ATV, or snowmobile was acquired in the settlement of the estate of the previous owner, but was not purchased from the estate. " There are several technical steps, but the DMV has created an easy two page checklist to follow (here is the link again - dmv.ny.gov/forms/mv843.pdf). Hope this helps! my sister is transferring her car to me, so I just need her to sign the title? do I need a bill of sale, and for her to sign it? Does she also need to sign this form, Sale or Gift of Motor Vehicle, Trailer, All-Terrain Vehicle (ATV), Vessel (Boat), or Snowmobile from the DMV site?

If she is gifting you (or selling) the vehicle definitely create a Bill of Sale / Odometer Disclosure Statement that both of you sign, in addition to her signing the back of the title. The other forms where you’re transferring the vehicle to your name she doesn’t need to sign as the Title and Bill of Sale will prove she’s transferring it to you. Hope that’s helpful !

Yes, to both of your questions. On the NY DMV site, this is what’s officially written re gifting a vehicle. “If the vehicle is transferred as a gift, indicate this on the bill of sale and indicate that the purchase price is $0. You must also complete a Statement of Transaction- Sale or Gift of Motor Vehicle, Trailer, All-Terrain Vehicle (ATV), Vessel (Boat), or Snowmobile (PDF) (at NY State Department of Tax and Finance) (DTF-802) and indicate on the form that the vehicle is a gift.” Link: dmv.ny.gov/registration/about-transferring-vehicle-ownership-and-acceptable-proofs-ownership# Hope that helps!

I'm transferring the ownership of the car which I pay from my employer as a loan. I have the original vehicle registration, vehicle bill of sale form, and notarized lien release form. The vehicle has an active insurance bought by my employer. What other documents do I need before going to DMV?

Assume you’re transferring the Title from the employer name to your name? If so, you need new insurance documents (don’t cancel old one yet) with your name and you also need to fill out a DMV MV-82 form (simple 2 page form). We’re assuming your employer has signed the back of the original title (per this video). Basically, your employer is selling you the car you’ve been using (they were more than lienholder on the Title they are currently the listed owner on the Title)? Do we have that right?

@@voltaoliver3605yes, exactly. When you go to DMV they’ll make you hand in your old plates (you’ll get a “FS6” printout that you should save. They’ll then ask for the new insurance documents under your name, bill of sale to calculate & collect sales tax, signed Title and NY DMV MV 82 form which which is a very simple 2 page form to fill out. Hope that helps! Note: DO NOT cancel the old insurance until you’ve the transfer. You’ll basically have two active insurance policies. The new policy under your name and the company’s policy. Once the transfer is done, then you can send the employer’s insurance company the FS6 and they’ll cancel the existing policy. Good news is all of this is done same day at the DMV, so you’ll get new plates and registration at the counter.

My mother is looking to transfer title from her to me. There is no lien. Would all we need to do is sign the back of the title, bill of sale, and fill out a DTF-802? Additionally, my mother and I work hectic hours and it's difficult to find a time to go to the DMV, is my mother able to transfer without me present, or must I be there? vice versa Thanks in advanced!

That’s correct. Although the Bill of Sale in this case would just be confirming it’s a gift from your mother (signed and ideally notarized by your mother with a copy of her ID). Since the title is being transferred to you, it’s better that you’re there vs your mother, in our opinion. Although technically your mother could also do the transaction by herself. It’ll be simpler if both of you are there. If it’s between one of you attending, it’s better for you to be at the DMV as the transfer is to you.

Is the current registration in your mother’s name? If so, then yes the simplest way to do everything at once (in fact probably what you should do) is to get DMV insurance in your name and show up to the DMV with the old plates, registration and the new insurance page. They’ll then issue you a new registration and give you new DMV plates there. The title you’ll have to wait for 3-6 weeks to come. Hope that helps!

@@AutoMarketplace A little more context in hopes to clarify the situation a bit better. I am on an insurance policy with my family. Our insurance is expiring without renewal next month, and the insurance company is willing to only renew if I am not on the policy (unfortunate series of accidents on my record). Would it even be necessary to transfer registration or title? Or can I just go ahead and purchase my own policy for the vehicle that I drive (the car registered under my mother's name)? thanks in advance.

Yes, the buyer should bring the title to the DMV after the sale to technically transfer the title (the seller probably wants to make sure this is done too for the liability reasons you mention). Once done, the seller has no liability anymore as the ownership has transferred (also good to lay this out in standard Bill of Sale when the seller sells the vehicle). Hope that helps!

@@wagagagaggag if you're selling to a dealer it's common not to sign the title because the dealer doesn't want to add another owner to the history, especially if they're flipping the vehicle. As long as you have a Bill of Sale and received your money, you should be fine 👍

You can sell your car with just a signed *seller* on the back of the title and then the buyer could fill it in later. However, best practice is to create a simple Bill of Sale and Odometer disclosure statement and have both parties sign it (confirming odometer reading and any damage at time of sale), so no disputes arise after the sale. NY DMV has very simple templates you can use - dmv.ny.gov/forms/mv912.pdf & dmv.ny.gov/forms/mv103.pdf. This is all to protect a seller (& buyer) from “after the sale” problem and also to make sure the vehicle is no longer under your name (being paranoid but imagine the buyer doesn’t officially transfer the title and then uses the vehicle still under your name, to commit a crime). Always best just to make sure the buyer officially transfers title and buyer/seller documents signed 👍 Hope that helps!

Think you still have to fill out Section 1. Not sure if filling out both Sections has an impact, but you definitely need to fill out Section 1 in most cases, from our understanding. Hope that helps! Might be worth calling the DMV to confirm?

Hi, I have a question, what if the date you put as the seller is different then when you end up selling the car, like in the seller information you put June 1 but end up selling it June 15 would that be ok, that there are different dates?

It doesn’t need to be filled out by the vehicle owner. It says only to fill it out for a “reassignment” transaction if you are one of the following: Manufactured Home Dealer, Boat Dealer or an Out-of-State (non-NY) Dealer, which is different than a simple “transfer by owner” in Section 1. Basically, most people don’t need to fill Section 2 out. Hope that helps!

@@AutoMarketplace I purchased a vehicle with a NY title and I am a vehicle dealer (just became one) in CA. And trying to reassign it to someone here in CA. So the seller filled out the top, I fill out buyer on the top and I fill out seller on the bottom and I put the new buyer on the bottom? If trying to register it in CA?

Don’t think it’s a huge deal, but maybe the DMV says something to you (get is signed again / re-dated) or maybe they won’t say anything. How much over the 30 days have you gone?

This is wrong. Put the SAME address as on the front especially if it’s a different state otherwise you need a new title.

If someone has moved since they originally bought their vehicle AND is using their original title, what you can do it order a duplicate title which will reflect the new DMV address on file. The issue you’ll run into doing it your way with an old address, is on the Bill of Sale you show DMV, a person will not list an old address (to match the Title) as the seller (would be very odd). Imagine on the back of the Title you’ve listed an old address but on the Bill of Sale you’ve listed your current address? That will cause even more confusion. Better to just leave the address blank on the title and sign only and refer to Bill of Sale. Interesting point to flag though, to be fair 👍

@@AutoMarketplace just telling you what NY state DMV told me this morning. The address needs to match or you need a new title. I moved from Utah and am selling my motorcycle which has never been registered or insured in this state. They said to use the address of the previous state if that is on the title.

@@phatboom little bit of a quirky situation, just to confirm. (1) You lived in Utah and have a Utah DMV title for your motorcycle/vehicle? You *never* registered your motorcycle/vehicle in NY or got a NY DMV plate, although you live in NY now? (2) You're now selling your vehicle in NY and the buyer needs your signed *Utah* DMV title and Bill of Sale etc to complete the transaction and pay sales tax in NY We could see NY DMV's point re. just telling you to put matching addresses for your *Utah* DMV title. Out of curiosity what address is on the Bill of Sale? Always good to hear about different situations like this 👍
