Ill give you some back story. Basicly, what you hear in this clip is the last half of this whole event. Basically, the crosswind gusts on the ATC's preferred runway were 34knots, the technical limit the plane could handle by the manufacturer was 40, while the airline imposed limits were even closer to 34. The pilot asked 3 or 4 times to get the non-crosswind runway which was not being used at that time. The ATC refused. What comes after that is what you hear in the above clip.

You just don't vector yourself and directly ignore ATC instructions and say "remove everyone from our way" unless you're in immediate danger of crashing. That's a Mayday situation and not something you do over NYC airspace with an airplane full of passengers that has two good engines and plenty of fuel. He's lucky he didn't cause an accident. Let's also think about the delays and costs caused to other aircraft that were sent around, the ground stoppage on the airport, and having to roll the emergency vehicles for his landing. It's OK to not accept a runway assignment if it exceeds the crosswind component for the aircraft you're flying. In fact, it's more than OK, it's required. All you do is tell the controller that. The issue here was the manner in which the Captain handled this. When the controller told him to go around and gave him a vector, he intentionally and immediately violated the instructions and circled over the busiest airspace in the world and lined up to land on his own for the active departure runway. He most certainly caused an emergency situation when he did that as once the controllers figured out what he was doing, they had to move several airplanes both on the ground and in the air. If there was no "emergency" going on and this was a case of arrogance, I have to say I have never seen such an intentional violation of FAA regulations and disregard for passenger safety with a commercial airline flight.

JFK has been using its 4/22 runways during crosswind conditions more frequently since the March closure of runway 13R/31L for construction. There is no such thing as declare emergency in aviation. It’s either u declare mayday or pan-pan. Wats the emergency here? Pilot didn’t inform Atc? There will be investigation after he land. He will be sue if no emergency found.
