I did my SSDI first. Submitted my claim and 4 months later i was approved, no exams, not even a single communication between me submitting the claim and receiving approval. I was 35 years old at the time and this claim was for PTSD only. The key, i believe (besides luck), is i had a great mental health provider who was articulate and documented my situation and treatment in proper detail. He sent them records showing i had been seeing him for the last 2 years consistently without missing a month, he documented that i had also been seeking outside therapy, and his notes over this time showed how we've cycled through almost every med available without much result, leaving me medication-resistant. Im finally doing my VA claim and can only hope for a process half as smooth.
most of the time i dont recommend going on 100% VA. it can hurt you. but in your case i think it will help you. im going to say that you have good medical history. thats why you got ssdi, plus the multiple medication changes (no success) or little success. people filing appeal for years end up learning how to articulate their disability. your medical record history articulates it for you.
If you don't mind me asking, were you already rated at 100% from the VA? And if so, do you have any idea why mine would have gone so wrong? I get conflicting info all the time..
I have 100% P&T with PTSD I have been out of work since 2015. I have been denied SSDI 3 times and 2 times with an Attorney. I have stage 3 kidney disease.
I am 100% T&P through the VA. Due to a TBI and severe PTSD and depression along with a host of other ailments. We were hit by an IED on my 4th tour in Afghanistan. That being said, I was told by the social security department personnel that it was almost a guaranteed approval for my SSDI. However, I was denied the first time. I obtained an attorney and was subsequently denied 2 more times, And was set up for a court date. I had my day in court and was denied by the judge. When I asked my attorney why I was denied, the attorney was not very forthcoming with an answer. My attorney only told me that it could have something to do with the amount of money that I receive monthly from the VA. So I asked the DAV representative that assist in matters such as this and he stated that Social Security doesn't consider the VA disability when making their decisions. Does anyone have any advice for me? I am 52 years old. PLEASE ANYONE WITH INFORMATION I WOULD APPRECIATE ANY HELP.
I am 100 percent P&T TDIU. I filed with SSDI 8 months ago. I have a local law firm who filed the initial documentation and have since found them to be completely useless by never returning phone calls to me or social security so I have been dealing with them on all matters and questions. One of the comments my social security rep said is that the VA is very lenient on handing out ratings. So far it seems like a rigged system against veterans. I am 60 Y/O and have been paying into the system for 40 years. Any suggestions on strategi at this point? Thanks!
I’m 90% with the VA, 70 for PTSD. I was put of work by my mental health dr and applied for social security and was approved. I am currently applying for 100% since I’m unable to work. Do you ever see VA go to 100% when you’re found disabled by social security?
My situation is the opposite of yours. I did my VA disability claim first and got 100% disability and now going for SSDI. I have been rated by the VA at 80% disability(70% PTSD) and when my employer found out that I have to attend group therapy, I was terminated from employment. I went to a VSO who helped me apply for a 100% disability due to me being unemployable because of my service connected disability (PTSD). It only took me 2 months to be rated at 100% P/T disabled. My actual rating is still 80% but been rated 100% because of being unemployable. Now, I just applied for SSDI and hopefully, I also get approved because we have the same disability. My advice to you is to seek help with a VSO in your area and show them your health records from your psychiatrist/doctor indicating that you are unemployable. Good luck.
Look into VA unemployability disability. You need a single disability of (i think) 60% or more. file for unemployability and, if approved, you will be paid at the 100% rate. Your actual disability percent will remain the same, you are just paid at 100%.
I'm total and permanent at 70% with individual unemployability through the VA. I'm paid at the 100% rate. I have a history of PTSD, bipolar disorder, anxiety, military sexual trauma and physical assulst in the army. Just contacted a lawyer to take my case for ssdi. Do I have a chance? What about a TDIU P&T rating? The VA has rated me Total disability based on Individual Unemployability due to PTSD w/ Major depressive disorder. I haven't been able to hold a full time job since 2017. The VA does not allow veterans with a P&T TDIU rating to work. Because of this, My VSO has encouraged me to apply for SSDI benefits. Does SSI look at TDIU differently than 100% since there is an emphasis on unemployability? Thank You.
My sc disability is kidney failure. The first transplant I wasn’t 100% P&T and I collected SSDI. The second transplant is when I was deemed P&T. I’ve collected SSDI since 1993. I wonder why wasn’t I P&T the first time since I will always have this condition.
im 100 p&t and my highest ratings are Anxiety disorder 70% , sleep apnea 50% and other at 30, 20 and 10... i was told i dont qualify for social security because i dont have enough credits, i only have 22.. but my anxiety condition says on my VA letter that it totally impairs me from working, holding a job or dealing in a work environment... if i cant ever work then how can i obtain SS credits?
You can pursue SSI but SSI is means tested and your benefits would be reduced by assets or household income. I don't have an answer to your question other than to say that SSDI is only available if you were able to work at one time but can no longer do so.
I am 100% VA disabled plus have a special medical condition housebound. When I called Social Security and told them my age 84, the person said I was too old to get SS disability benefits. True?
