For withdrawing and distributing common Sinking Fund as well Fixed Deposit amongst Member during time of redevelopment, what is Process and required Documents for the same. We presume these funds can be withdrawn after old building is completely demolished. Correct us Incase wrong.

Sir , I have shop in Housing society, during Deemed Conveyance of society land and Buildings, society has not attached the OC of 9 shops and its total Carpet area approx 151 sq. Mts. But same area shown to illegally constructed Annex Building ground and upper 1st floor , at the time of Registration of society, Architect and Builders has not included the said 3 Occupants of Annex Building, my question is that should society included such unauthorized Occupants as members of the society and include such illegal members and Occupants in Redevelopment of society Building? Who will be responsible and liable for this fraud and mischief?

You have to file Criminal Suit before Hon'ble Bombay High Court and try to cancel the Development agreement between society and Builders under specific performance of contracts under Indian contract Act Specific Relief Act, 1963 Section 10 of the Act states that the specific performance of a contract shall be enforced by the Court subject to the provisions contained in sub-section (2) of section 11, section 14 and section 16. 3 out of 29 members of Pragati CHS, Ghatkopar had lodged a writ petition in Mumbai HC vs redeveloper, CHS and MHADA opposing redev on grounds of redeveloper not ready to give bank guarantee equal to valuation of the flats of the 3 members. Bench of Judges ordered redeveloper to give bank guarantee to the society, builder agreed to give 25% of the value of 3 flats as bank guarantee to the full society of 29 members plus 2 flats of sale component of to be redeveloped building as security to which Mumbai HC did not raise a query. Providing 2 flats of sale component of to be redeveloped building as security is a mockery , and shockingly HC found nothing wrong in this offer of redeveloper.
