Sir, resale men flat lete waqt hum kaise pata kare ki apartment ke saath amenities(jaise swimming pool, park) bhi included hai ya nhi? Kya koi aisa document hota hai jo common area k baare men specifications aur measurements k saath bataye?

Sir our society is not register so one of the flat owner is not staying in flat refuses to pay maintenance charges. So does he right or he has to pay maintenance.

New construction Society Comittee is formed around 2/3 years back before that no comittee. 70% member paid full amount now remaining members hv to pay balance payment but the construction work was not completed as decided because Builder died in between now the comittee is charging 21percent interest to remaining members is it correct or wrong . Can they pass rule of charging 21percent in AGM.

Sir agar hum 2014 se building me rehane aaye hai aur builder ne kuch nahi kiya kuch members 2014 se maintenance pay kar rahe hai aur kuch members nahi pe kar rahe aur 2023 me society ragister ho gaye hai to hum members se kab se interest lagayenge 2014 se ya fir 2023 se?? Please ans karna sir bcz humare edhar 280 flat hai 585sf 1170 maintenance hai thanks...

Misleading information given. One member one vote is th rule. Supreme court gave an order on a case where family members hold few flats in a society and mentioned that each flat will have the vote by referring clause 27 i.e. one member one vote. "Section 27 of 1960 Act in no unmistakable terms provides for one member - one vote. It is one thing to say that the object behind the slogan ’one family one vote, may be otherwise laudable, but what is necessary to be seen is as to whether the said concept has any root in the Act. If, the Legislative Act provides for the concept of ’one person one vote’, no bye-law can create another concept so as to defeat the legislative object. Bye-law provides for a member’s right to be allotted flats in the name of his family members; but the same would not mean that under no circumstances more than one member of a family cannot become member of the society. A difference between ownership of flat and membership must be kept in mind. When one member of the family within the meaning of Bye-Law 19 (iii) applies for allotment of another flat, he/she may be asked to disclose the details in regard to allotment of flat in favour of any other member of the family. But if the members of the family have been allotted flat or admitted to the membership of the Society, for the purpose of exercising the right to vote the statutory provisions shall apply."

Mera opinion aur experience. 1 bhk/ 2 bhk mey 6/7 person hey.... Toh water use jyada rahega. Rent pr owner dete hey. Jyada chhote flat hey rent pr person jayada. 3 bhk mey only 2 aged person / single hey toh water use kam rahega. Rent pr dete hi nahi. Mey secratory reh chuka hu... Mere pass e proposal written mey aya tha 1 bhk. Ki taraf se. Mene denied kiya tha with reason.

❤ sir maine flat liya 2 bhk uski maine transfer fee bhi bhar di par ab vo makaan repairing kaam ( tiles , kitchen , bathroom )karane ka hai. but society chairman mare se charge maang rahe hai ! 2500 rupees me pay karu ya na karu ?

Hello sir, Que:- If the house owner is not giving maintenance on the bases of they are not using any facilities like water, electricity and other, so it is ok or not? If not then what is the minimum charges we can tell them to pay if they are not living and using any facilities ?
