The defendant definitely knew there was no new timing belt on there. He probably asked his alley mechanic to fix it just enough for him to drive the car to the plaintiffs because he didn’t want to put anymore money into fixing that car.

Just because your vehicle is being sold in an as is sale, specific repairs you write in your advertisement are considered a warranty. Anything else is just puffery.

We are a VW family. Our daughter just bought one used. My husband gave her 2 rules. No turbo and no sunroof. They fail a lot with Volkswagen. She bought one with both. It's been in the shop 28 days out of the 40 she's owned it. Can you guess why??

The judge also neglected to mention the fact that because the kid was 17 when he purchased the car that he can't be contracted with and they could undo the deal unless of course the deal was done with the mother but if it was done with the kid then he could've had the option of undoing the entire contract.

Now Judge Milan wrong for this cuz she tells everyone else as is. Smh

the plaintiff should have had the car inspected before he spent his hard earned money, BUT , im glad he got his money back for the TIMMING BELT,, due to a techalcality, thats VERY rare.

He could have gotten his money for the entire car back since you cannot legally contract with anyone under 18 years old in the U.S. I’m surprised that wasn’t brought up in the case.

Word to the wise: don't buy a car with a turbo as a daily driver unless you're mechanically inclined. Turbos sound cool but as they say: the more moving parts the more likely it is for something to break

Getting the car inspected wouldn't detect the timing belt. The thing that sunk the defendant was that he he said it had a new timing belt.

She failed to mention that the seller can’t transact with the buyer because he was underage at the time of the sale. But maybe it was a moot point because he didn’t want to undo the sale.

The Judge always says for the private used car cases they should have brought a mechanic. At least where I live, you can't just go to a repair shop and ask a worker to come with you to look at used car. It would be better to negotiate with the seller and get something in writing giving the buyer a couple days to go see a mechanic.

Parents failed this kid. 156k on a car that sucks from the jump. No inspection. Stupid.

It's very possible he had the car repaired by a shade tree mechanic. The problem is they don't warrant or give receipts for their work .

If he really had a mechanic make the repair then he should get copies of the plaintiff's evidence and sue the mechanic and get his money back.

Lucky Plaintiffs had that photo from the mechanic otherwise they wouldn't have gotten jack sprat. I don't know whether Defendant was aware his mechanic did that unsafe thing of putting that plank under the car smh.

A couple of things... Who in their right mind buys a 10 year old German vehicle with a quarter of a million km's on it and doesn't get an inspection? People like this should just lose out of stupidity by default. Having said that, the 1.8T with a manual IS pretty fun to drive as evidence in the plaintiff's face when he talks about it. He also better quickly brush up on his mechanical skills if he wants to keep that thing on the road, with those miles that thing will need a constant diet of parts and upkeep. My guess is the defendant towed the vehicle, owner never claimed it, he put a lien on it and then got it in his name and flipped it. The fact that he had or had someone rig it with a piece of wood says it all. Plaintiff is lucky it didn't splinter or shift out of position while he was driving it - buh-bye engine!

Judge marilyn reads out loud the repaired items were nowhere connected to any timing chain repair work. In every other case involving a use care purchase and " Buyer beware" clause applied, the ruling is found against the buyer. This ruling appears very suspect. Thats unfortunate when these rulings can and may involve one's personal bias. Open injustice in this ruling for sure.

Judge is wrong for that. It's an as is sale period . He drove it a month with no problems and how does the judge know he didn't have some one fix something on it and they did that. Judge was completely wrong on the verdict

As is means you purchase at your own risk unless you're black. Because in this case Milian disregarded the law by going rogue and issuing an unfair ruling! This was an as is purchase, yet she completely ignored that and ruled for the plaintiff. I knew something would happen like this because of the color of the defendant's skin. She sat there with bias talking about I wanted you to enjoy your first car. Foh man!
