So Toby never attacks Michael even after the most insulting of insults because he takes that hatred and disdain out on his victims as he strangles them. He knows if he kills Michael, he would be suspected first, plus it's like a never-ending hate-fuel source he can use towards his victims. The Scranton Strangler is still free...
