I closed deals before without a real estate license, I got my license & still wholesaling, listing is something i can offer, & I can get into rooms with people who’s been in R/E for years that can introduce me to their network & more opportunities. Wholesalers as a community is really just 1 vs the world. It shows, NAR is capable of sending out 250 minions, & although us wholesalers are very self driven, & self taught, we can be too overly focused on self & be isolated. No group of wholesalers are going to show up to stop any of these laws being passed, but best way to go about it is to follow the trend & be prepared, By listening & following a Flipping Genius like Jerry !

@joaquinporter9313, Solid comment. I respect wholesalers for this very reason. Are there crap WS in the business? Of course, just like in EVERY other industry. Just have to do the proper vetting and DD to mitigate risk. I'm not a wholesaler but I help by funding their EMDs so they can get more deals done. Keep on crushin'!

Wholesaling is just like the pawn shop of real estate. Some people like to use pawn shops. It's their choice not the choice of the government or some third party.

The difference is that pawn shops are very niche, and real estate is not since everyone needs a home.

Even pawn shops have regulations. They knowingly can not accept stolen goods. Further, if they think it's stolen they, in most place, have to notify the police. Second, they need to catalog the items, just in case the police show up. I found a bunch of stuff stolen from me at a pawn shop. Caught the thief through that regulation.

Banning contractual agreements between parties is unconstitutional and therefore any case against a legitimate wholesaler will more than likely be thrown out of any legitimate court

Thanks Jerry, Now we are talking. They are worried about wholesalers going out there working hard to deliver for the seller. After, the realtors have been signing contracts, going back into the office sitting on the seller, then canceling contracts because they could not move them. We wholesalers do bring a lot of value to the sellers and I’ve had sellers tell me, they did not want to work with the realtor. People should have the right to sell and sign with whoever they decide. They wholesale all across America in cars, grocery, clothing, tools, Sam’s, Walmart, Auctions but the problem is in real estate

As a licensed Realtor & wholesaler, maybe if Realtors got better at finding buyers this wouldn't be an issue. Simply throwing a property on the MLS & waiting for a buyer is lazy. Get better at your job.

As a Realtor, Wholesaler and buy & hold investor, I have Realtors ask me all the time, "How do you find these deals?", I just tell them, it fell into my lap from a friend of a friend. I never tell them my secrets. I love being the Realtor on my own fix & flips, I saved $12K on my last 1 that I close tomorrow being my own Realtor.

Well agents are nothing more than wholesalers with a license, they've got no interest in what's best for the seller, just a way to make a quick paycheck. I get what you're saying, but unfortunately, in a money grab industry, no one wants to do anything unless they're getting a cut. So just adjust and move forward and let others figure it out themselves. Keep putting content out. I really enjoy your stuff

I'm with you Jerry! I signed up last time. I cannot tell you how many times clients have come to us to sell their home because the agents previously involved could not sell their home and meet the criteria they were looking for in order to move. We go above and beyond in order to make the transaction happen from: Negotiating with the lender, negotiating with the listing agent of the new home, helping move, walking them through the transaction, remodeling the new home to suite their needs etc etc etc. We wear so many hats people have no idea. Our clients are very well aware of the process and what we bring to the table and gladly sell to us below market. There has been numerous times agents have been involved before our clients came to us and they couldn't help them. JERRY I STAND WITH YOU AND I'M WILLING TO PLEDGE MY TIME , SUPPORT, AND EVEN MONEY TO SAVE OR SALVAGE WHATS LEFT OF THE WHOLESALING INDUSTRY.

I still don't understand how they say we steal equity when two sides came to an agreed price...we aren't going door to door saying, "Hey! You're gonna sell us your house or else!". Give me a break.

@@unofficiallydamon So what? The seller got what they agreed to. It's a free market, dude. Not anyone's fault but the seller's. Why do you want government intervention? The government shouldn't have a say in private transactions, especially when both parties executed an agreed upon contract.

@@alexcameron2880 You needn't ask me if I know what theft is, you need to ask the legislators because that's what they're calling it when they're announcing these laws. Next, they'll go to townhalls and share the extreme examples N.A.R. is giving them, like the examples I shared above. People are going to hear those numbers, and they're going to remember they're grandmother or their co-worker's mother who got scammed, and they're going to say, "Good job, Mr. State Senator." You can cry consenting parties all you want; at the end of the day the public is going to decide what's theft and what isn't. And overreaching government gets its power from the fear and then the anger of the public. See 2020 if you need an example.

Wholesaling is going nowhere. Just buy the property via transactional funding, private money or hard money. The government can't ever outlaw you buying property (Taking title). Your offers will have to be lower in order to offset the costs you have to pay for transactional funding and closing costs but you can still Wholesale. My market is Texas and I wholesale properties with agents all the time, all through assignments(The assignment is not dead). Just adjust if your state makes changes. No need to panic. Again, wholesaling is going nowhere.

The assignment is not allowed without a license/disclosures in several states. Yes - double close is a workaround (for now) Buying with HML/PML is not wholesaling, that’s flipping (regulation does not apply)

@@FlippingMastery in several states? That's exactly why I said when any specific state changes the law just adjust. In Texas, my market, you don't need a license to wholesale. You do have to disclose but I have never had a seller or an agent ever mention my disclosure. 99 percent don't even read it. If necessary, just take title, the government can't stop you from taking title. I'm assigning all day long in my state of Texas and if that changes I will adjust. Again, wholesaling is going nowhere. No need to fear. Buying with HML/PML or transactional funding still gets the job done if the spread is big enough. There is a wholesaler I know who buys all his houses with PML and still makes 20K to 25K per deal after all the fees. Wholesaling, flipping, whatever; as long as the transaction gets done it's all good. Again, just adapt if your state changes the law.

More than likely, the seller who places their home on the MLS is STILL gonna get the same purchase price offer that he would have gotten OFF Market. However, it's very possible that the seller will walk away with less money in their pocket after paying off realtor commission, title fees (closing costs), and possibly seller concessions. It's also a strong possibility that the seller's distressed property will be tied up on the MLS for a few months without selling. There is a reason why Wholesaling is a viable option for many sellers. Most of these distressed properties do better off market and let's face it most Realtors won't do open houses or work half as hard to sell a POS property vs a brand new home. We all win with Wholesaling. The realtors who hate wholesalers are just not doing enough business and instead of figuring out how to fix their process, they are blaming someone else for their lack of business. I doubt busy agents care about wholesalers.

I’m a busy realtor & the majority of the wholesalers that contact me say they are cash buyers instead of just saying they are wholesalers. I run into so many wholesalers who string agents & sellers along and then last minute while in escrow they say they are assigning the contract. I don’t mind working with wholesalers but when you start a business relationship lying, it leaves a bad taste in my mouth.

Powerful constituencies employ full-time lobbyists. That means organizing enough to create a fund and fund the right individuals to lobby the government. I watched this exact process play out in Washington State with marijuana legalization. I was in the room with a rag tag group of medicinal marijuana growers who pitched in together to make the change. Two years later there was a bill in the legislature. Four years later the state legalized. Say what you want about cannabis-- that's not the point-- the point is that if they can do it-- so can we.

NAR argues that wholesaling is basically brokering. WRONG. Wholesalers don't have a fiduciary duty. That's the key difference. Two parties should be free to contract on their own.

Knowing your rights to operate and contract as you choose is inalienable from the most high, we’re not subject to the stuff the agents are and they’re mad 🤷🏿‍♂️ they need to focus on their own pockets and wholesalers need to do good business.

All the major wholesalers with financial backing should pay 1-2 lawyers to bring this to the supreme court or something. At this point it is obvious that they just want to have it banned which isn't fair because all major stores do the same thing with goods and sell daily to Americans. Take gucci and LV for example they make those bags for 50 bucks and resell it for 1000.

Jerry hot take…. You’re videos on cold calling agents has littered the industry with a bunch of people don’t treat this like a business. Fly by night guys who don’t give a crap about a seller or a buyer or an agent. I have had more of those types call me than anything here in California and none of them have money to close or know how to properly underwrite deals. This isn’t a dig at you, it’s more of a heads up warning, change your tactics and who you market to.
