In our next Conversation, Floyd Abrams explores the views of two legal scholars--Linda Greenhouse and Stephen Sachs-on Mark Lemley's article "The Imperial Supreme Court," published in November 2022 in the Harvard Law Review. The article argues that--within the last few years--the Supreme Court has newly arrogated power to itself across a wide range of fields and disciplines. This new era of the court's history distinguishes itself from past accusations of potential over-encroachment, the article continues, because rather than simply using the court's authority to side with one party in governmental disputes (e.g. Congress versus the president, the elected branches versus the courts, the states versus the federal government, or the government versus individuals) the court is now broadly enacting its own solutions.
Linda Greenhouse is the Knight Distinguished Journalist in Residence and Joseph M. Goldstein Lecturer in Law at Yale Law School.
Mark Lemley is the William H. Neukom Professor of Law at Stanford Law School and the Director of the Stanford Law School Program in Law, Science & Technology, as well as a founding partner at Durie Tangri LLP.
Stephen Sachs is the Antonin Scalia Professor of Law at Harvard Law School.
