The three defendants in the Ahmaud Arbery murder case are scheduled for court Friday morning. You can watch it in the player above at 10 a.m. ET. The Law&Crime Network’s Brian Buckmire will host live coverage.
Gregory McMichael, 64, son Travis McMichael, 34, and neighbor William Bryan, 50, are accused of chasing down the victim in a tragic confrontation on Feb. 23 in Brunswick, Georgia.
The question before the court is: Is this murder? Prosecutors and attorneys for Arbery’s family say yes. The McMichaels chased the victim in a Ford F-150, while Bryan drove a Chevy Silverado pickup truck, authorities said. Bryan filmed while father and son confronted the 25-year-old Arbery, and Travis shot the victim with 12-gauge shotgun, according to the indictment obtained by Law&Crime.
At the time of the killing, Gregory McMichael allegedly told police that they believed Arbery was involved in several burglaries in the area. But there was only one reported burglary in the area in recent weeks: a January 1 alleged theft in which a gun was stolen from a pickup truck outside Travis McMichael’s home.
911 audio from shortly before the shooting showed a caller reporting a black man in a white T-shirt at a nearby house under construction.

i don't understand what something that happened years ago have to do with the man being murdered. those 3 murderers don't know his past and even if they did it does not justify them hunting down a man and murdering him for what they thought might be trespassing that they did not see that day.

Amazing how the defence is saying that they have a right to private calls trying to enable the covering up of the calls that arrange tamper with evidence on Facebook etc.The attempt to put a twisted spin on rights to cover up relevant evidence.

The entire purpose of these pre trial proceedings is to work out what evidence is admissible. This happens prior to every trial. Each side will argue their position and the judge will make a decision.

Since inmates are aware that all calls are recorded, typically only those related to attorney-client privilege, or those deemed irrelevant are excluded from being able to be used as evidence

Don't inmate phones have a sign that explains that calls are not private and are recorded? If not, have these lawyers never watched a criminal procedure TV show? Even I know there's no expectation of privacy in jail. Mail, visitors, phone calls...everything except communications with lawyers is monitored

I'm having a lot of trouble understanding how these well-seasoned defense attorneys are keeping a straight face during argument on an already heavily litigated issue that inmates have no expectation of privacy, particularly as it pertains to jail calls. Furthermore, it is CODIFIED in the frickin statute!!! They want to make this a novel issue and try to persuade this trial court to overrule existing settled law, but it's not going to happen. I predict the judge will rule against the defense on the jail tapes and once convicted, the defense will raise this as a potential reason for an appeal, regardless of whether the State moves to admit any tapes into evidence. They are litigating an issue that's not even ripe yet in this case... and if I had to guess why, I'd say there is something on those tapes that one (or all) of the defendants, in retrospect, don't want the government to hear.

It's really unfortunate that the defendants have the worst possible attorneys, the Hoeuge's were just totally incompetent. Sighting the 14 amendment as a due process is just outrageous is another sign of their inability to defend their client. It is clear and written that all phone calls are recorded with the exception of calling an attorney registered number. The McMichaels were idiot's right from the start..knowing your being recorded, still make incriminating comments is just another example of their recklessness and disrespect for the entire process. They think their above the law.

I believe it said "current balance" was $1K and offered payment options, which leads me to believe it was a balance owed for calls already made for that particular inmate

The person has a balance to use of $1000.00. Basically they can make a $1000.00 worth of calls. It’s not an owed for calls previously made, nor is it the cost of the call their making.

Defense attorney is an idiot! He’s repeating questions regarding requesting jail call records. Guess what, genius, it’s literally the job of the DA to request the calls. Continued questioning of each of individual request only serves to prove they have no case and no defense. Their clients guilty A F.
