First off, this is not INSIDE someone's home. It was a University event making it an open event. Did anyone teach YOU the law. The law professor committed assault the moment she laid hands on the young woman.

First of all, the Dean and Professor invited people to their home for an end of year event, it was NOT sponsored by the school, it was not on UC Berkeley campus, not on the law school campus. It was in their privately owned home. The Dean's home is not public property. There is no First Amendment right to protest on someone’s private property. As Chemerinsky correctly notes in his statement, “my home is not a forum for free speech.” You don’t have a First Amendment right to go into someone else’s house and hold a protest just because they work for a public university. Malak Afaneh shows up takes the mic and that's where the video starts. The Dean is repeatedly telling her to leave and saying they will call the police. The Professor is trying to take the mic from her. If a person is on private property and is asked to leave & refuses to comply, they are a trespasser under California Penal Code 602 . The professor did not ASSAULT Afaneh, under California law, a property owner or lawful occupant has the right to use reasonable force to eject someone who is unlawfully entering or occupying their property. If you are convicted of Penal Code 602, the legal penalties include up to 6 months in a county jail and a fine of up to $1,000. So the Professor and Dean were both within their rights to take the mic, and physically escort her out of the property. And if all else fails, they weren't following the time place and manner restrictions; and did they have a permit to protest? my guess is no.
