I've had this happen - "new" that clearly isn't (especially from Guitar Center). So I get all prepared to reflexively rerurn it and - to my great surprise - it turns out to be a great instrument & a keeper.
For all intents and purposes I never ever buy anything on Amazon that is not at least shipped by Amazon and ideally, sold by and shipped by Amazon because returns are simple and easy. 3rd party seller returns can be a real hassle. I had a bad experience with a seller. They wanted me to pay return shipping and wanted to deduct the original shipping cost and a restocking fee from my refund for a pricey wooden framed wall clock that was sold as new but had obviously been used and had a big dent and splintered wood. Since then I pretty much avoid 3rd party sellers on Amazon. Hopefully your seller will do right by you. Cheers!
Amazon is so weird. I've similarly gotten listed new yet clearly used items supposedly at a 'deal' price. Similarly I've gotten brand new unopened stuff buying 'used - like new' from the warehouse, with not even the advertised packaging damage evident.
The guitar world is a crazy one. A lot of what are considered "industry standards" wouldn't fly for any other product (e.g., if it still has a warranty it's "new" - even if 500 people used and abused it at Guitar Center, or even bought and returned it). Then again, there *are* the upsides - like obviously-new "used" product (talking to you PAS).

Sweet looking guitar. Do you have any reviews for the Harley Benton stuff. They look like good quality guitars, but mostly made in china. They got some more expensive models made in Indonesia. Harley Benton just might be the go to brand for affordable guitars.
Music Man makes AMAZING guitars, and none other than Philip McKnight has even stated that, having visited nearly every major guitar factory out there, he found MM’s QC to be second to none, and in some respects even better than PRS!!!
Please do not take this the wrong way, but I do think that you are being overly nitpicky. Your issue that the box was opened is (generally) a positive because someone at least took the time to have eyes on it OR did a quick set-up and checked the guitar for damage as many places do the same like Sweetwater for just one example. Having the battery installed is also not a big deal because most systems need to have an instrument cable plugged in before it starts draining the battery. Go to any mom and pop or Guitar Center and just because it may have been a floor model it is still the same price and considered (New.) You may disagree with that and consider them as used but many people prefer the guitar that was on the floor because they bonded with that pedicular guitar just like I would never buy something like a Les Paul online if I never played it first because the quality of Gibson is all over the place. Yes, this could have indeed been a floor model and they just put it back in the box and shipped it out to you OR they just did a quick glance over the instrument before they shipped it out but in any of these two scenarios the guitar is still considered as new. If this was indeed sold and returned, then yes it should be considered (Used) and if that was not disclosed at the point of sale that is wrong. From the sound of it you already got a good deal on it, so I do not really understand the whole point of this video. You are going on about an open box with some fingerprints on the guitar with the accessory pocket on the gigbag that was compressed??? You do know that they stack these things when they get shipped correct? Just a thought but maybe just maybe the 9 volt was installed at the factory OR the place that you purchased it from to check for proper operation??????? My Schecter also came with the 9-volt installed for the Fishman Fluence pickups as it would be kinda hard to check to make sure that the system worked and was wired correctly. What do you want them to do may I ask? Take the battery back out and put some bubble wrap on it.
While it’s clearly wrong to resell as new a guitar that’s been shipped out already. Isn’t a floor model what every instrument at your mom n pop shop is?
Issues aside, nice looking, Joe! Locking tuners. The boost … I see it spec’d with active pickups although they look like passives?? Please clarify and then, if you want to keep it … ask for $200 back for false advertising and for your pain and suffering:)
I have a Ernie Ball Music Man axis and the battery isn't for a boost it's a noise canceling circuit. Some have a battery for a boost some have a battery for a patented noise canceling circuitry. I suggest you research what the batteries for to be certain
This is a lightly used guitar. The seller was dishonest, but priced it down. It shouldn't be an excuse, but the economy isn't that good. Hope that everything works, Judge Wapner rules that you deserve $50 to $60 in cash or guitar merchandise.
