I own 3800 acres where I keep cattle, we have a lot of streams, creeks and ponds. Sometimes while out I will find someone (most always teenagers) fishing in the streams/creeks and I usually just walk over and say hi and ask if they caught anything. I tell them they are on my property and ask them to please not leave anything but have fun and good luck. Now if there are 20 people on my property that would be a problem, if a lot of people are showing up every day that would also be a problem but a couple kids or young men out enjoying nature that accidentally came on the property is definitely not a problem and is a great thing that I am glad to see and encourage.

My dream is to own a large tract of land on a year round creek or shallow river and have a campground for canoe and kayakers and wade fishermen. Want to build raised platform polebarns with posts for hammocks and open fireplaces for cooking and male and female bathhouse. And a few primitive campsites with fire pits and bbq grills, for people that want privacy. Maybe have a bus for picking up floaters at take outs and a boat rental.

I’ve this happen to me and my friends. The guy argued until the Sheriff showed up. Apparently he sold his house in a big city, and bought some land around a popular fishing spot. The Real Estate Agent told him he “owned” half the river. The Sheriff calmly explained easement rights and we fished away.

Most issues would be resolved if hunters and anglers researched the laws respective to the state whose lands they wish to hunt/fish. These kids obviously did not do their homework before they trespassed on this guy's land.

@@jennifer9528 I agree with you except there are occasions where it's difficult to get accurate information. I have used apps before and local knowledge to determine what is public v private. One fly shop owner in a Colorado spot we frequent assures me every time there' a five mile stretch of public fishing passed a particular creek and yet there are a bunch of private land signs posted in this area. I always err on the side of caution and I have a six pack in my car to give up as a peace offering. All of that said, I thought the lads handled it about as well as they could.

I had this happen to me a couple yrs ago. I kept the guy talking while my buddy called the warden. Long story short the Warden showed up checked our fishing licenses and gave the guy a fine and explained that he would be arrested if he came back. The DNR does not mess around when it comes to hunter/fisher harassment.

@Nomen Clature thats an assumption. i looked it up in federal game and fisheries. Regardless if the land under is in the deed it doesn't matter. its a public accessible river. Land owners hands are tied when it comes to public access. Anglers cannot cross private property to the body of water but from upstream or downstream it is lawful and the anglers have every right to do that. Wading in and walking on the rocks beside the stream are permissible by law. This guy is just aggravated because the anglers are fishing his favorite fishing hole. Nothing he or the boys can do about it inside of the law granted to anglers or recreational activities.

@Nomen Clature no, i didnt look up the wrong law. As long as uou enter the stream from a public access there is nothing the land owner can do. You can float and fish through private property and you can wade the stream up to the high water mark. Look up supreme court ruling HB141. And you will have your answer to your belief.

Couple of things from a state peace officer who has spent the last 19 years enforcing game and fish laws: you need to consult onX hunt or BaseMap before striking out to determine private and public property. Second, call the local game warden for the area you plan to fish and ask pertinent questions before striking out. Third, if you know you’re in the right, ignore questions and keep on fishing. Fourth, arm yourselves when going into the wilderness. Never go anywhere without a proper sidearm. Riverbeds are state property up to the median high mark: that is, halfway up the bank from low water mark during a dry year to the point at which the river overflows its bank at flood stage. Obviously, the median boundary changes based on the slope of the riverbank, so as long as you walk up the river in the river or what appears to be an obvious part of the riverbed, even if it’s dry, you’re ok. Lastly, record everything as you did and then report it to the local game warden and file a complaint for harassment of sportsmen.

This came up on another channel in New Jersey.....and apparently the landowners do own the river/stream bed, as long as it isn't "tidal" waterway. Funky law, but that's how they do it in NJ. Unfortunately, the boys were wrong here.

for sure. I own 80 acres of land and i got a border with a river right in the middle. I would not take kindly finding people right in the middle of my lot. I do own the are with the river with no separate lot coming off i, it is all one lot. I can see where the guy is coming from and technically he does own the river and it is trespassing. I also got dogs that may not treat the people nicely. If it was public land it would be different and the kids in this are saying it is. I would simply just show a map of my land and asking them to leave. I am like these kids, or was but now that I own land I would see where the guy is coming from if it was legit.

@@chadillac365 you seem to be a little unclear on riparian rights. It is actually entirely possible to own the river. It depends on the state, but most places you do actually own the land under the water. Yes, public water happens to flow through private property, but people accessing public water do not have a right to trespass onto private property and that includes hopping out of your boat and standing in the middle of the river on somebody's dirt. A lot of it has to do with mineral rights, you can't just kayak into somebody's private property and start panning for gold or fishing for gems, that riverbed belongs to the property owner and those minerals belong to the property owner. If the water is navigable, you may navigate to your heart's content in a craft, unassisted swimming is considered trespassing. In the case of this video, these two jackasses parked their car at the gate to his private property, walked 4 miles up his private road, stood on his private beach and started fishing from his private property... They're lucky they didn't get shot.

@@gasoven3759 Thats a negative, if you knew anything about New Jersey laws you would know Public Trust Doctrine. Public Trust Doctrine insures Public access to all TIDAL waterways and Coastlines. This means, as in clearly visible in that video, that the waterway in question is influenced by tides, Therefore under New Jersey law they reserve such waterways for PUBLIC ACCESS AND RIGHT OF TRAVEL. If you have the address for that waterway it would be even easier, as the GIS survey will indicate if it is public access or not. Whatever dumbfuckery you think happens when you "touch the bottom of the waterway" is actually hilarious and has no basis in law. From an actual Lawyer. And another thing, one also has the freedom to travel next to such waterways as there must always be a public easement or right of way to provide safe passage, regardless of if that easement or right of way is on private property adjacent to publicly navigable roads or waterways. One does not need to "float" on such waterway to travel, one can walk adjacent to it lawfully, as this provides safe passage for individuals who may not be able to swim. And as one states, if they are free to go they are free to stay.

@@itzahoax934 this is does not look tidal. Tidal new jersey is unlikely to have that sort of scenery. I could be wrong however. Also that "dumbfuckery" you speak so elequently about is known As king's Grant. And is very common east of the Mississippi. I'm not sure if new jersey is a Kings Grant state, but here in Virginia, exactly what that gentleman wrote is quite possible. Look up John's Creek access. Not only is the land under the water often included in a deed and enforceable by law, but in some cases the water running across/through is by right the landowners and even if these boys were sitting in a boat, they could be trespassing.

@@jpmc271 While the state may convey the private rights (jus privatum) associated with tidelands, it may never convey the public rights (jus publicum), and the private owner may never interfere with the public’s right to access tidal waterways and their shores adjacent to their property. While the private owner does have the right to use the conveyed property for the approved use, they must also be aware of the special nature of the lands and the public trust rights bestowed upon them. Tidal as defined by NJ state code is: Tidelands, also known as riparian lands, are all lands that are currently and formerly flowed by the mean high tide of a natural waterway. Barnegat Bay, a naturally tidal body of water, is an example of tidelands. However, New Creek, a tiny tidal stream that flowed through the city of Newark a century ago but has since been filled in and built over, is also an example of tidelands. New Jersey contains an extensive network of tidelands, both big and small. Meaning if they are affected by Natrual tides, they are considered tidal waterways. You can see this clearly with the debris along the waterway indicating there is a high tide.

@@itzahoax934 I think we're in agreement. My thinking is this is not a tidal waterway. The debris you speak of could be tidal, I'll take a closer look, thought it appeared to me to be nothing more than a high-water area caused by varied flows either from a dam or natural leveling changes. Virginia has similar rules for Chesapeake watershed areas, though in many cases the land owner still owns rights to the low water mark such as for duck hunting crabbing etc.

@@jpmc271 A lot of homeowners in NJ believe they own the waterways behind or adjacent to their property but 99% of the time its a grant on the title. Usually passed down from previous owners in order to build docks etc around the area. But its still owned by the state and considered Public Property, just granted to them for specific use. Also some get a bit confused and think "tidal waterways" are only beaches. But like I said above if they have the address I can pull the GIS records and confirm. If I'm incorrect then thats that, but the one guy was spurting ignorance. edit: Also even if changes were made to the waterway, such as additions of levies or dams are still considered tidal lands. Hence the inclusion of "currently or formerly flowed by mean high tide of a natural waterway". Meaning unless that man or previous property owners built that river/creek from the ground up or it is not connected to another natural waterway, either currently or in the past. Then and only then is it private property.

We own 500 acres which includes a very popular fishing stream! In our state and with this type of stream we own bank to bank! We almost NEVER run people off unless they are being disrespectful! This guy is a total douche and obviously has a chip on his shoulder! Making friends helps preserve the resource! Shame on him!

Regarding the guy saying he owned "half of the river", depending on the state, if it's a navigable body of water, he can't keep people off of it. For example, in Michigan, landowners can own the land under a river but they can't keep the public off of the water if it meets the standard of navigability.

In my state the private property ends at the river's high water mark, so where they were standing wouldn't even technically be his property. I don't know how it works in NJ though.

This is true in ALL states in the US... the only requirement is that the water is "navigable" and free flowing. Also at high water any islands that form are public easement unless there is a structure on the land.

In most areas, you can walk the riverbank. Is that not the case here.

Lots of unanswered questions with the self called owner of the world guy. And he has dogs running freely off a leash in State Parks Lands?. Obviously he has on waders and is actively trout fishing this stretch of river so with that in mind i would venture to say he is competing for the area which looks pristine trout habitat. My guess is he is over stepping his ground by making all these claims and his aggressive nature towards these young anglers.

Just so everybody knows, in the USA, any open water source is considered public property. Rivers, and lakes fall under this category. Depending on the state you live in, creeks and ponds may also be considered public as well, and if you don’t want people on your land, you have to pay to divert the river or creek off your land yourself. Edit: comes with the territory when you buy your land. Do your research before buying land with public property on it

Just so you know, this is not necessarily true. There are only 3 publicly navigable rivers in Kansas. There are many other rivers that are not public, meaning, land owners own up to the middle of the river and if you are on it and not the owner, you are trespassing. Many kayakers use these non public navigable waterways thinking it is legal and it is not.

@FruityDickens depends on state. Some states water is owned by state including river banks up to high water mark. In those states if access river legally can walk/fish whole length of the river as long as stay close to shore. Other states water is owned by state but not bottom of the river. Can only float on top of water through those areas. I lived on amazing wild fishery river in California. We'd get huge trout that'd come up from big lake to spawn and some would stay after snow melt. Occasionally would catch 35in range. As water dropped in summer most bigger trout would concentrate in deeper pools. Over a decade I spend at least a few days a week walking endless miles fishing or dog walks. Down river from us there were dozens of houses near river over 5 miles or so. Didn't have an issue a single time. Got to know a few people on first name basis. I can certainly sympathize with some private property owners if they are having problems in the area. But fuck assholes like this guy. Being all threatening and totally unreasonable with a couple young kids even when they were being respectful and offering to leave.

I don't believe he can actually "own" any part of the river. I own property that ends at a river, and I can not tell someone to stay out of the river. I've had many people fishing from my little river beach, I usually ask if they caught anything good, ask them to please not leave trash for me to pick up, and wish th good luck. IF he REALLY has a shooting range as he said, you would have heard it, I think he was full of bullshit. Probably some overgrown spoiled wealthy jerk, who was never taught respect.

Actually, as I just mentioned in my own comments, you CAN possess parts of a river, through commercial river rights. Consider a marina or yacht club. They don't "own" the river, but having commercial river rights does allow you to put out docks, a marina etc. and have unwanted persons removed.

I know it's completely different but I got "attacked" by a similar man here in Sweden. I live next to a lake, own fishing rights to that particular lake and once during a sunny summer night (midnight sun) I got approached by a very upset man who arrived around 01:30 in the morning. He said " HE KNEW THE F*CKING OWNERS" and told me he would call the police if I didn't leave. Knowing I was fully in my right to fish there I called the police first. They arrived in a cruiser after a while and the man spent a good 15 minutes ranting some made up story about how I "illegally fish and abuse the nature" around that lake. Then the police turned to me... Showed them my ID, pointed at my house literally next to us and proved my rights with some papers on my phone. The angry man who had been lingering in the background flipped out and called a bunch filthy names, one which would translate to "f*cking homo gypsy satanist c*nt"... Police arrested HIM for various reason and I spent a good 30 minutes showing pics of pikes, perches and zanders I've cought in the lake to the leading officer. Turns out he was a massive fishing nut. Just like me. So that officer now fishes in my lake and that's justice to me. This happened last year by the way.

This didn’t happen in Alabama, but in Alabama, that is a mixed question. It may or may not be the same in NJ. In Alabama, you can be in a boat on the river (even if he owns both sides the river), and I suppose you can walk up the river near the bank if it isn’t too deep or fast. But, you cannot get out onto dry land without trespassing. The rock cliff is not the river. Even if he owns the whole part of land under the river, in Alabama you have the right to be on or in the water without trespassing. You can not step on the shore. Rivers are considered “waters of the United States.” Anyone may boat on any navigable waterway. In Alabama you often do own to the middle of the river, but sometimes rivers erode or silt in a shoreline, so it isn’t necessary the center of the river today, but what was the center of the river when the federal government issued the patent (title to the land to an individual). You’d have to be a surveyor to figure it out. That said, unless there is a sudden and dramatic shift in the course of the river/creek, most people maintain the shore as the line.

You are not allowed to block access to any waterway if there is any sort of access that is reasonable. FYI, the reason why many states have riverbed rules is because of minerals. In California especially, because of gold, you cannot access the riverbed on somebody's private property, a landowner owns land underneath the water. This is to prevent somebody from swimming down to the bottom of your property and collecting your gold. You can be on the water all you want, but you cannot enter somebody's private property. The ignorance of many of the comments is ridiculous. Read the law FFS. Yes, if the river is deemed navigable then you have a right to navigate a boat through private land that the river crosses. BUT, you must access the river from another public location. You are trespassing if you set foot on the private land by docking your boat or by crossing the land to access the river. If the waterway is not deemed navigable then you have absolutely no rights to it and are trespassing by being in or near it on private property. End of story.

I am kindof a grumpy old guy but with these two young men I wouldve made friends. Probably wouldve watched them fish while I fished, and told them if they wanted to fish til dark I would give them a ride back to their car. Very respectful young guys and they had right to be sceptical about this guy. And did right not showing id or giving specifics on where they were parked. If the survey pins go to the waters edge on a black water river or lake that is recognized as private even if it floods a couple times a year.

For non tidal waters in NJ, you can float through private property, but not wade on the bottom or anchor. However, you can walk on the bottom, or even the bank, to navigate an obstruction, like a dam or fallen tree.

Depending on what state you are in and depending on what land the guy owns and depending on if that is considered a navigable waterway. That said in Mississippi if you own land that stretches from one side of the river to the other side of the river then you own the land under the river even though it is a navigable waterway that is why it's perfectly ok to canoe down a river but not to use an ATV because the ATV would be considered trespassing. You have no right to be on the banks fishing on someone else land and depending on how you got there makes all the difference because most don't sweet people on the banks within 25-30 feet of the river fishing but would have an issue crossing vast amounts of their private property to get there. @@nunliski You are allowed to navigate on the river that goes through private land but you cannot cross or set foot on the private land at any time. You have to access the river from a different public location. The warden would arrest this goof immediately for trespassing. And the ruling applies only to navigable waterways. If it's a small stream you are trespassing if you set foot anywhere in the water or land.

@@NYSeaNile if the water is surrounded entirely by your land you can indeed own the water, however this is in IN. There are people that have private access to parts of rivers in IN as they own the land on both sides. However If you are in the water and accessed it via a public access point then they can’t tell you to leave their area

Yeah, I don’t trust these guys to not blatantly ignore posted signage since I’ve seen dude fish in a decorative community pool/canal. I likewise don’t trust people to post signs in places they legally shouldn’t do it. All this said, the guy was a complete and utter asshole. Just tell them to leave, if you’re in the right. What’s the point of playing Detective Getoffmylawn? Plus he kept referring to his posse and looking up their IDs and “shooting ranges”. He was trying to be threatening waaaay beyond what was justified for a couple younger dudes fishing, and I’m probably older than he is, I’m no millennial. If all of that is really this guy’s property (I’d love to get the full story on that acreage), he has a pretty significant area. I wonder if he bought it just so he could enjoy threatening people? .

I’ve been dealing with a guy like this for the last few years at my favorite spot. His land ends about 50 feet from where I fish and he’s come over citing all sorts of this and that about state laws, etc. I finally had it and contacted the rod and gun club that manages the lake/brook. Since then, I’ve seen him angrily traipsing around his property but that’s about it. The worst part of it all is that he’s *FILLED* the woods with “no trespassing” signs…practically every other tree and it’s really robbed the area of its natural beauty. There’s nothing worse than aggressively territorial residents…

If it's their land they can be as aggressively territorial as they want, some people work very hard too become land owners. I'm sure you'd rather see a over abundance of posted signs than a trashed river.

@@generalfranco9399 No, that is absolutely not true. That does *not* give them the right to harass you when you aren’t on their property, aren’t breaking the law or causing a disturbance. That’s how many aggressive land owners behave…there are countless stories. How can you possibly defend unreasonable land owners and how did this become a conversation about littering? That has nothing to do with fishermen…fishermen have always been at the forefront of conservation.

Even if the river runs through his land the US department of agriculture has made it clear you don't own that water. Farmers don't like it but they can't do anything about it.

Depends on where you are I know in Texas private property under the water is owned and if you can touch bottom walking you are trespassing and some places they own the water also.

Yeah I was thinking the same thing. After the first question asking some personal information I would have told him to carry the fuck on and if he wants to go and get his buddy jim the game warden or whoever he wants to then he can. As you age you tend to have less patience with bullies and rich people who think they own the world.
