Anxiety Disorder and Social Security Disability: Winning Strategies for Your Claim

Severe, unrelenting anxiety disorder can make it all but impossible to hold a job. Stress caused by a reprimand from your boss, chatter from co-workers, or complaints from an unhappy customer can overwhelm you to the point where you lose the capacity to get through a workday.
If you are extremely sensitive to stress to the level where your anxiety level leaves you non-functional, you may have a viable and legitimate claim for Social Security disability benefits.
As I discuss in this video, anxiety cases in Social Security disability claims can be difficult because there are no objective tests like an MRI or CT scan that allows your doctor to “see” your anxiety. But long term treatment records and support from your doctor in the form of a functional capacity evaluation or a statement that you meet Listing 12.06 can be enough to convince a judge to award benefits.
Many of my clients who struggle with anxiety also struggle with idea of starting the process and applying for disability. Often, knowing how the process works can reduce your stress level.

I am too depressed/anxious angry to hold a job... (anxiety attacks at work, or not being able to go to work due to anxiety attacks, sometimes lasting weeks) but not so depressed where I'm going to attempt suicide. So I'm in a weird limbo... I just want to be independent and stop relying on my abusive family which also causes anxiety....

What if my social anxiety is so bad that I can't even go to a doctor or almost can't even leave the house? Currently I have someone doing anything outside of the house for me like going to the store or anything else. It would be very very difficult going to a doctor and I would completely freak out if I had to appear in front of a judge in order to get disability.

Agreed. You need a psychologist/psychiatrist and your physical medicine doctor to explain how the anxiety and your other problems prevent you from working a simple job.

I need help. I am 20 and have had severe anxiety since I was a child. I have worked in the past but that was only when I had someone put in a good word for me from working there. I dread interviews and do horribly at them, my anxiety is so bad I can't even talk to people. I didn't talk in class or to any students when I was in school, barely made it through high school. Currently living with my fiance and can't keep a job due to my anxiety and not being able to communicate as good as regualr people to my coworkers and customers. I stutter, shake, sweat and cant bring my words together, anytime I try to talk to someone it comes out as a mumbled mess that I cant even understand. Then this makes people think I'm stupid or retarded and it hurts my self esteem even more and my anxiety. My anxiety is so bad that sometimes when a stranger or someone I'm not 100% comfortable with talks to me I'm too busy worrying about being judged and dreading having to reply that I end up not understanding what they said. My mind will literally forget how to understand english which makes me freak out more. Its to the point now where I can't even go outside without my heart racing and shaking. I get anxious on the sidewalk! Thats how bad it is. And honestly I barely ever leave my apartment and have literally no freinds. I'm extremely lonely and get really depressed because I need a job but can't keep one, if I find a job where they don't fire me I end up quitting because my coworkers always treat me terribly because of my issue. I need to get ssd or ill be homeless becaus so currently don't have a job and wont be able to get one that I can do if I even get past the interview. My issue is this, how do I get accepted if I can't afford to pay for an attorney and to get screened. I am literally broke but if I don't do this I will be homeless. I heard it is basically impossible to get approved unless you have money lying around to pay for this. Not only that but they would want me to appear in front of a judge! Ive had to do that before and only got through it because I only had to say one word, but this time id be expected to answer questions and explain my case. Which is impossible, its really shitty to expect someone like me to be able to do that and to have thousands of dollars laying around. What can i do in my situation??

I had my hearing and have been out on long term disability for 2 yrs, for bipolar, anxiety, and depression and Adhd/Add . As anyone who understands you have good days and can have bad days that last for a day to a week to a month, so on. I am showing improvement however, I still have bad days and won't leave the apartment sometimes for a week. When I say improving I mean I am not "all over the place in my conversations. The judge denied me at hearing because I got drunk in 2015 and will have a beer or two on a Friday night (if I feel like it). He disregarded my psychiatrist notes, disregarded my sisters letter who I see a few times a week and have moved less than a mile away from her out of her concern. She handles my finances. He stated she was not medically trained. Not a single person can believe this. Not my primary, not my psychiatrist and not a single person that i know. The unfortunate thing is that I had a neurosychological evaluation shortly after the hearing and the assessment supports my psychiatrist and adds more issues. It is unbelievable. No one wants to be on disability. I feel I had a little pride in myself when I worked. I certainly made more money. I paid into this system and know people that are scammers and get approved and here I am preferring to be capable of working and get denied. I wanted to climb over the desk and choke the judge at the hearing, he was demeaning, insulting and sarcastic, but all I did was cry. He said that my condition is due to substance abuse. That is stupid. My condition may caused me to fall off the wagon not the other way around. I did tell the stupid judge (and I say stupid instead of what I would rather call him) that I would not go out and shoot up a school full of kids, I would not kill myself, but if I did not wake up tomorrow that would be fine with me, almost a blessing. My lawyer said two things in court, he told me to calm down (because I started to raise my voice as I got more and more angry and as I said, I cry instead of physically lash out, I have to) and he said I could not work in a warehouse (which is also stupid because I have documented advanced degenerative disc disease, however this information I didn't have until after the hearing, which also states from an mri, that it appears that I may have fractured my hip and a verterbrae within the last 10 yrs) I used to drink a lot and would fist fight with men.) anyway, the other thing my lawyer said was she can't work without constant supervision. No, I can't even bring my groceries in from my car. I just don't understand. I don't. I am so depressed. I hate court and courthouses. I hate that the laws are twisted and turned and interpreted to the point where good people are screwed and the bad people win. Or the person with the most money wins all the time.

Alyce I am going through the same with my Legpain and Depression. I'm 57 but feel 87. I'm too young to have these Problems but they are there and hamper my Quality of Life with the Pain I have. Heck, I want to work 60 to 70 Hours a Week like I used to 10, 20 Years back, but I can't any longer. I can barely walk the next Day after I put in only 5 or 6 Hours at Wendy's. I only can work 1 or 2 Days a Week now. And even then I dread the Pain in my Legs after 1 Hour of standing. Believe me its tough. I have Goodays and Bad. I've been dealing with anxiety for as long as I can remember and some days I can't even go to the store without having a panic attack. I'm almost 19 now and I've never held a job because just thinking about it also gives me a panic attack. I was first hospitalized at 13, again the same year, I believe, for a suicide attempt and last year for self harming/suicidal thoughts. I've been seeing different therapists and doctors for 6 years, does that make for a good case? Since I have all of that history?

Hi Trez. I hope the hearing went well. Most SSD lawyers work under a contingency fee where we get paid 25% of past due benefits with cap of $6,000 if we win - no fee is no past due benefits.

Social Security Disability videos I was medically retired(Chapter 61 discharge) 4 years ago from the Army for PTSD(70%) and got SSDI within 3 months of applying, my only problem is the added stress of not knowing how long i will be on it and having adjusted living standard. When it comes to PTSD and the symptoms of it i feel it just depends on who during the review gets your file and it's like rolling the dice, i go to VA appointments like 6 times a year and i know that my discharge is suppose to hold a lot of weight in CA courts but man i hate the stress !

Trez Whaley Did you get your SSDI? Also Social Security Attorneys are supposed to be capped. Not to sure what the amount is but I think it is$5,000 and only get paid if you win your case.

I am starting to look into this. I am 26 years old. I am young and even embarrassed to be going through this at all. I have had anxiety and depression for about 4 years now. I was diagnosed with pospartum depression after my son(even though depression started shortly before seemed to have made it worst) and I was giving zoloft but never felt normal again. Now my son is almost 2. I still have not been able to get a job. I have gone to the emergency room due to suicidal thoughts and was giving hydroxine 25mg also didn't seem to be enough. I was prescribed lexapro for anxiety/mood disorder. Still no results. So I am going to start with a new psychiatrist this week. I hope to see better results.. I feel helpless I don't know how I can work when Its a struggle to even get through the day or make it to the supermarket or go out for long periods of time). I have ocd with using the restroom SEVERAL times a day. Not only can't i control this I can't concentrate for long period of time or focus I get tired or loose energy. Its just overwhelming. I also have heartblock and needed to get surgery for a device implant. And it has not helped at all with making me feel less tired along with everything else.

Janice, I have to tell you that getting approved at age 26 is going to be an uphill battle. Not impossible, but difficult. I would continue to seek medical treatment for your various physical and mental health conditions - both to get better and to build a record. If you can try to work, I would do so (failed work attempts can be strong evidence). At some point I would interview disability lawyers in your area for their perspective about your chances at disability.

I’m sorry you are going through all of that it really sounds rough. I would like to recommend meditation. Many people would tell me to try it but I just never thought it could help. I am doing so much better now because of it. You could download the app Calm and it takes you through different meditations. Even if you just meditate 10 minutes a day it helps. Good luck!

i am a 48 years old. i have had ulceritive colitis/Chrons for 16 yrs. in 2011 i almost died. i had all but 8 inches on my lg intestine taken out, hoping for a resection. but i still have ulcers in my small intestine. i do have a ostomy. which i hate. anyway , i have in the past applied for disabilty and was denied. but never appealed. i had to work. lost alot of jobs because of it. so i applied again and i dont work because i now get dizzy really fast and headaches all the time and clumsy as hell. not to mention the other side effect you get having Chrons. I have gotten representation thru Myers. so i dont know whats going to happen. i am guessing its still early. i have been watching your videos and they are quite interesting and inform-able. im hopeful. but thank you for all the videos you put on here. i was told about your videos by disabilty digest.

Honestly I'm getting worse waiting , I just got another pill Aripiprazole which makes 4 for major depressive disorders & I'm waiting for a hearing with other issues hiv sense 1987 plus several others and 56 plus the condition of our country depresses me badly I fill hopeless , not as much crying spells ; just wanted to vent & my mother's not well ....just venting Thank for your help !

What if you have avoided the problem all your live with no medical history, no work history. I only have relatives that know the truth. I’m 34, never have had drivers license, the last time I worked was when i was 16 & 17. Those 3 jobs were all in one month. I quite trying after that. But how would i pursue this with no paper trail?

What if I have been approved before but I need to restart my benefits and I haven't been seeing my Psychiatrist in years. He only perscribes my meds because he doesn't take my insurance and is semi retired and I have not been able to afford therapy after the cost of all my meds. Will proof of my meds be enough?

I have multiple diagnosis for Mental Health issues, was denied at hearing. I am appealing, however my question is what do I do if the judge states that they "don't give much light to" my doctor's notes that I have a disability and cannot work? They stated that one of my physicians is a Nurse Practitioner and not a doctor-but the county was helping me due to low income and that was who I was assigned to. I have two suicide attempts, self harm attempts and 3 mental health hospital stays. Now I have to wait as long as two years for appeal. I have an attorney, but not sure I trust them. They have not called when they said they would (twice), and today I received a note from SSA stating that they are approving my attorney's request for "extra time" before they make a decision on my case. Not sure what that is about!

I used to be normal was able to go to school but then one morning I woke up feeling nauseous thought it was a stomach virus or maybe something I ate didn’t reason with me but then everyday getting up for school I kept throwing up every day to the point I lost weight and wasn’t able to function anymore I had to get homeschooled and ever since it started my life has been complete torture I suffer from severe anxiety I gag I get knots in my stomach heart starts racing can’t sleep certain nights from discomfort tightness in my stomach it’s made me depressed I never had a job before and unfortunately can’t work Bec it’s so severe I get physical symptoms every single day to the point I got suicidal I never attempted but just get thoughts of being dead. If my anxiety was more manageable or gone for good I would of been a massage therapist possibly but the thing is I get physically sick from my anxiety idk what to do anymore my life feels like it’s over I’ve had this anxiety for about 7 years now if not more and it’s a horrible feeling

What if anxiety disorder just started because I was thrown into a job that I basically cannot physical do. I had to be sent to work at a plant from an office because I have no seniority in a job I have been working in for 2 years and 10 months. I am not coping at all. I am afraid of the men in this plant because they stare at me too much, some even follow me around. My hands and feet are numb because of repetitiously working on a machine that is faster than I am and I can't keep up. My supervisor lost his temper the other day because I made a mistake on a machine and I have only been in this plant for a month. I am sleepy because I am on a night shift that I did not ask for. I have high blood pressure that is no longer under control and my doctor is mad about it. I have sleep apnea and I have orthopedic issues from the military and find it hard to stand all day long. Every time I have to go to work I get sick of the stomach and it starts to burn. I have never suffered from heart burn the way I do now and I barely eat now.

I've been diagnosed with Bi-Polar Disorder, depression, severe anxiety, panic disorder resulting in panic attacks and anxiety attacks, Obsessive Compulsive Disorder, Trichotillomania, and Misophonia. The concept of trying to hold a job scares the absolute hell out of me considering I also have severe social anxiety and will literally "blank out" when overwhelmed. Going out in public is a struggle, so how will hold a job? On good days I have to shower every 11 hours 50 minutes and on bad days it's 5 hours 50 minutes. There's some days where I need to shower every 3-4 hours. I have Misophonia often called selective sound sensitivity and that in itself is horrifyingly debilitating. When in school if a student across the classroom was chewing gum, that was all I could focus on. Which has conditioned me to bring ear plugs everywhere I go as trigger sounds are unbearable. And they're as simple as chewing gum, mouth noises, repetitive tapping, etc. I don't think I can wear ear plugs in a work environment for customer satisfaction and safety reasons. Due to the misophonia I have a "fight or flight" reaction where I will try to stand the sound for as long as possible, and then either snap and tell the person to stop it rather aggressively or I will literally flee the scene. There's been many of times where I've run out of restaurants because people are scrapping their knife and fork together or chewing loudly. Would I have any chance of SSI being an outlet until I can find a treatment that works? I've been on so many different medications since around age 14 (now 23) and none work or work for very long. I'm not one of those people who want to live off benefits my entire life. I'd love to be able to live a normal, productive life and not have these constant crippling issues. But right now it's just not happening. Should I even bother looking in to SSI or will I be immediately denied because it's not a physical thing? Any answers to these questions would be incredibly helpful. Edit* I went to the hospital once and was unable to breath. I was convinced I wasn't getting enough oxygen and that I couldn't breath. The doctor eventually came in after testing and asked if I was under extreme stress or anxiety, and determined it was a psychosomatic episode caused by anxiety. Would that be worth mentioning and bringing up?

I went to my Social Security hearing today before the judge I'm 54 years old with multiple problems anxiety swollen knee chronic asthma back pain after it was over the session my lawyer possibly told me I couldn't get my Social Security but they would give me a lump sum in 12 years of back pay I don't believe that and I don't want that I would like to have my regular Social Security payments I have been paying social security for over 30 years but I still never got a definite answer on anything now I'm all confused do you have any input thank you I love all of your videos

If anxiety driving is your primary condition that is probably not enough for disability. An SSD judge would likely conclude that you could perform sit down work in a factory or office. Transportation to and from a hypothetical job is not a factor.

Sir, I filed an EEO complaints against my manager and several co-workers due to harassment. It's now being formally filed and being investigated. I'm still working with these folks and I am suffering from anxiety, depression, panic attack and PTSD for many months they regularly bullying me. It was pervasive and intentional. Now, I am having hard time going to work. I'm still doing good with my job because I get paranoid to make mistakes. I get so obsessive of re checking my notes all over and over again before I go home. I have notes from my primary and psychiatrist that I have major depressive disorder without psychosis and situational anxiety. I have no more interest with things that I used to enjoy. I don't take a bath, put make up, exercise. I keep forgetting important personal things. What's should be the first I should do? How about ADA? I'm only 44, I'm still young but I can thrive in a hostile environment.

im 42 years old have had ocd depression and severe anxiety. i also have spinal problems in the low back and neck. i have worked in the restaurant business since i was 14. my spinal problems along with my anxiety are makeing it to where i am terrified to go to work. it is really starting to affect my quality of life and my financial life. people have suggested that i try disability. i am a single father with a 12 year old son. all i want is to take care of him but its getting to where i cannot work anymore and i just do not know where to turn. please give me some advise on whether or not i would have a chance to even pursue such a thing. thank you so much

In order to win SSD, you are going to need strong support from one or more treating physicians who will say that you do not have the capacity to perform the duties of even a simple, entry-level job. It will be very difficult to win if you are still working when you go thru the process and it will also be an uphill battle because of your relatively young age. Ultimately your medical records and statements from your doctors will be key.

I am scheduled for my hearing on Monday of next week for multiple mental issues, PTSD, bipolar disorder, panic attacks and anxiety disorders. I haven't been hospitalized since my early teens for several suicidal attempts but have not been able to keep a stable job all throughout my adulthood. I am currently in psychiatric counseling both office and at home on a regular basis. I also am treated by several medications. Please send me anything that could be helpful for my hearing over the phone. I do have legal advocate representation.I am know 56 yrs of age and have tried to work but lasted a week at my last job in 2017 was already denied for benefits and hearing.

Debra, if you have a lawyer or non-attorney advocate you need to consult with that person for specific advice about how to prepare for your hearing. That's what you are paying for.

Co-worker/supervisor letters and records of sick days are helpful evidence, but I think it would be an uphill battle to win SSD benefits without also submitting medical records and support documentation from a treating doctor.

Most everyone applying for only mental gets denied twice then you appeal and hire a good lawyer. Then you wait 2 to 3 years then you get your hearing. I had my hearing over. Two weeks ago. Still waiting for decision. Best thing is make sure everything is documented.

Jonathan, I just had my ALJ hearing and it was due to my depression anxiety and PTSD. I had documents from doctors stating mentally I can not work. I had a pro Bono legal representation and the judge asked the VE one question, could a person with my restrictions, missing 2 or more days a month hold a job in the economy and without hesitation the VE said no, there are no available jobs. That’s it. Hearing was over. I had some substance abuse issues in the past but have shown a record of clean time and successful recovery centers. My ALJ approval rating is 43%. My lawyer is very optimistic. What do you think?

Kayleigh my experience has been that if you don't have on-going treatment with a psychologist or psychiatrist, you are unlikely to win SSD. Unfortunately statements from people around you are not likely to be enough.

Jo Jo, the issue in your case is how your agoraphobia would prevent you from working a simple, entry-level job. YOu don't win based on a diagnosis.

Dear Sir, Why and how can a psychiatrist lye about me to suit social security, who must have pre-set the court hearing beforehand (many signs of that, and I studied on YT) and got no real lawyer help like I have the right to, and the court of appeal have treated me and my case nonchalantly too, so as to weaken and stressing/scaring me, leaving me alone without info, facts and support, so I loose my mental abilities, due to long-term social isolation from severe insomnia due to having been withheld assistence and even proper handling of my case for 10 years! I hav Aspergers and a severe form of Anchylosing spondylitis, and have disability against my will, i e I wanted to get assistence to manage may life and my disease, get to de-stress, sleep, absorb nutrients and stabilize. Then be able to start self-healing work, managing to do constructive Dr.visits and treatment, to se how well I can get. I am struggling to stop the stress-induced sugar addiction, but they scare and pressure me slowly to death (since 30 years!) and I am afraid at the corruption and evil I didn't know we had. I want my life back. One made up I had psychosis, I never did and they can't diagnoxe, can they? One made up refuse to go to Dr, although that's where I go, but they can't treat me in this stress exhaustion and fear of the others. and have asked for communicator to Without getting any substantial help or tretament.Can I refuse the guardian they unrightfulkly put on me, despite that i never shopped too much, it's only to control me and to get the case accepted, what else?He seems corrupt, has not even got in touch properly , and atsrted taking my savings 6 weeks before my case in court has even stopped! If your treating doctor will go on record (in a narrative report or functional capacity evaluation) stating that you have specific and severe work activity limitations you would have a good case. The main issue: how do your medical/mental health impairments impact your capacity to perform the duties of a simple, entry-level job. Hope this helps.

I medically retired from the Army. The Veteran Affairs rated me @ 70% PTSD and 20% of lower back issues. I am now going to see a shrink that they provide. I don’t like talking about my military experience I went through in Afghanistan. But I still have a feeling I was get screwed over by a civilian Doctor that doesn’t know real military war. I feel that way with the VA as well. I can’t seem to trust anyone anymore. I just hope they look at all the facts that the VA found and their diagnoses. Don’t they have to give great weight to their findings? I am also sacred that me being 34 years old will not get me approved.

My experience has been that you should not rely exclusively on VA records when pursuing Social Security disability. SSA will not give controlling weight to VA ratings, and VA records are often not very helpful - it is much better to get statements about your work capacity from private doctors/psychologists.

A good lawyer Can get these records. When you start getting letters in the mail from the government they will send you a list of the records your lawyer has given them. My lawyer got records from my shrinks when I was 18 and I didn't even remember the shrinks name. I'm 44 now.

Can't hold a job, in and out of the emergency room more than a dozen times and have records for everything. I've had a history of this since I was 16 years old. Now 21 years of age. Elizabeth, I am growing increasingly pessimistic when it comes to mental health claims. It seems like SSA will not approve you if you don't have multiple psychiatric hospitalizations, suicide attempts and years of treatment records. I recently got an unfavorable decision from a judge who normally is reasonable. Here is one of the reasons the judge denied my client: "She also admitted to engaging in activities that one would not expect an individual with significant mental health problems to engage in. For instance, she admitted that she read, sewed, took pictures, spent time with others, attended church and attended bible study." Apparently SSA has a list of activities that depressed people should not do! Absurd. I have extreme anxiety and panic disorder, along with depression. Going to work makes me have panic attacks all day to the point of where I couldnt take it anymore and I tried to kill myself. I went to psych. Im 18 and I've worked for about 7 months.. I've had a history of black outs as well, and people are my biggest fear. I cant be around people without panicking and shaking, sweating, etc...im going to be seeing a therapist, and my old boss said when I tried to get a new position in the same place that I wouldnt be good for it because I dont talk and am awkward. The thought of working with people is making me shake just thinking about it. I've been on different meds and I've seen different therapists throughout my life. I cant do it. Would i even qualify if I were to get a therapists help to support me?

My experience is that the strongest mental health cases contain evidence of 1) recent in patient hospitalizations; and/or 2) suicide attempts; and/or 3) unsuccessful medication management; and/or 4) long time treatment records from a psychiatrist or psychologist; and 5) a supportive functional capacity evaluation from your long time doctors.

I had my SS hearing this morning. I think everything went well. The judge asked the vocational expert if I could do my past work and she said no...then he asked if there were any jobs that I could do and she listed two types of jobs. My attorney asked her if any of those hypotheticals would allow laying down for an hour during the day and she said, No....I am hoping this is good. Could you give me your opinion on this?? I have failed back syndrome, bulging disc, Degenerative Disc Disease, SI joint dysfunction, stenosis and some depression. This judge was hard to read.

I think it depends on the judge's practice. If the judge accepts the assumption contained in your lawyer's question, you will win. I would ask your attorney if your particular judge is inclined to approve based on a lawyer's hypothetical.

I went with a large firm in my area...the attorney told me that sometimes you can tell how a Judge is leaning but unfortunately the Judge that I had she described him as very "Stoic" and he didn't give any indication during the hearing. My attorney did say that she has gone before him many times and that he is a fair man but she couldn't tell based on the hearing how things went. She did say that fact that the VE answered no to the first hypothetical was good. She said the fact that there are jobs that I could still do was not great but she said the fact that she crossed the VE and she answered "No" when asked if any of those hypotheticals would allow for laying down an hour a day, she said that was good. Again, I thank you for your response. I love the videos. My attorney did tell me that my medical records are good and they support the fact that I'm disabled but I do know it's up to the judge .....

Do you take clients from rural Iowa by chance? "IF" I get denied after ALJ Hearing? , The 1st 2 denials I couldn't get my Dr's to all send my med records, etc because I owed them money. My 74 yr old mother pd the past due bills so a majority are in. Amazingly my initial records said everything you mentioned in this video to a "T". Major Depression, PTSD, Anxiety, Panic, ADHD all diagnosed by 3 Dr's from sev yrs of therapy. Kicker is I have more than Mental -also have Physical. I had back surgery twice. In order for my insurance to approve the Surgery I had to go thru that Psych Evaluation common for major procedures. (It is a joke of a test in so many ways). I answered completely honestly as well as proven to be competent. That dang test came back saying I have have Somatazation Disorder and a new young Dr adds his new educational jargon to it. Basically stating something to the effect on my chart that means "I (the patient) have a tendency to over dramatize my pain (aka the majority in my head even though they had not even seen my MRIs, CT Scan or other DE medical records going back 15 or even 5 yrs to help make a conclusion about me. *A person with real herniated discs, billing discs, nerve impingment, Osteoarthritis throughout the spine also aided by a Discoid Lupus affecting my body from diagnosis back in 2007, or my Fibromyalgia from a 2005 diagnosis. Obviously a person can't imagine the true back pain issues like this or "exagerate them just to try and get sympathy or potty from others. trust me if I wanted any or whatever else needs somebody I would definitely find anyway other way than having to deal with yrs & yrs of chronic failed back surgeries or the mere fact that arthritis is there for life. OMG? REALLY? I don't see how that test can say all that & more w/out the Psych Dr even interviewing you face to face directly through mutal conversation/therapy for at most a half-hr. Other than the card flipping & moving pieces around, the majority of the evaluation is 900 +/-questions where you sit in a small dark/hot room trying to get through all the answers even though you have severe Narcolepsy. *Very boring hence tiresome*. The Psych exam Dr was someone I had never met before as well as a clinic I had never been. He told me I shouldn't feel obligated to answer all of the ?'s, try to do what I can during the pts where my Narcolepsy didn't interfere or have random sudden sleep attacks. The OCD side of me of course stayed there for 5+ hrs on that portion only to answer every single ??. Probably being my 1st mistake, right? I should have stuck to the 2 - 3 hrs they stated they give someone, since they said it was ok to stop even if all the ?s weren't answered. On my original disability claim I filed for Chronic Pain, Fibromyalgia, Failed Back Surgery Syndrome, Depression, Lupus DLE - my case is pretty nasty, Narcolepsy w/Cateplexy, Chronic Fatigue along with Failed Back Surgery Syndrome (my pain mgmt specialist was the one who stated I had the FBSS several x's at my appts). More to follow on him in a moment. I want to point out that my first two denials used my psych evaluation results stating that I was not credible in regards to that evaluation on the doctor's opinion saying that I exaggerate pain also failed to even list all my diagnosis based on what little med evidence was submitted. Again how can a common patient who has no job a $10,000 deductible, another $5k on top of that for out of pocket + initially have to pay the st 100% of $2,500 ea new calendar yr per household member before A SINGLE PENNY is pd by insurance. How can most afford to pay their Drs when most single wk for yrs that person has an Dr Appt (some wks having 2 appts if biweekly cognitive-behavioral therapy falls in line). We do not qualify for SSI. so if you can afford to pay your full doctor visit and fall behind and they hold your medical records Soma and even some won't even schedule a follow-up visit following a 1 mo back surgery checkup until that bill is paid in full! I just think that's ludicrous?!? They will get pd eventually if they would just be held liable sooner than the ALJ Hearing stage. Yes at this stage you can hire a Representative (Atty or Advocate) to issue a subpoena to obtain records. By then 2 yrs have passed, as in my situation. not being at the follow up with certain doctors over a longer period of time also as stated that you do not look credible or unable to follow suggested plan of future treatment, not seeing too many Drs, etc... Sometimes I think the laws need to be changed quite a bit! Going back to the pain specialist only to find out he is one of those Drs who saw me for over 3 yrs. Even prior to thinking I would ever be in the situation to file for Disability. He informed me yesterday that he doesn't belive in Disability AND he REFUSES to everyone who asks to get involved any little bit with a SSDI case. Even when he is asked for RFCs, stmts or anything other than his office visit record's. (Wonderful to learn this after that many years). I never would have imagined that he would have been somebody who would have helped me especially after all these years. It just tells me that he's in it only in it for the money and nothing else. Again I will explain further... Not to mention I had him send in his records 'sight unseen' in my error. As I thought I had total trust in this so-called medical professional (actually btw he is a PA not a Dr) for 3+ yrs to not be this way. Just yesterday I was at my regular monthly appointment. I asked about the inconsistencies in my reports. The reports say literally the same exact thing every single visit, other than the diff in my weight, BP, occasional med dosage or slight cg. EVERY SINGLE VISIT! He also claims that he does a strength test of my back, knees, hips & what have you....But he hasn't done that in almost 3 yrs!! Why does he say that he doesn't do? Not to mention he makes it seem like my strength is good to top it off!! I had no idea he would ever be this dishonest! I approached him about it today saying he has not done that once in the past 2.5'ish yrs? Why does it say this? I confronted him yesterday about this and he got all defensive with me. Saying "well I'm not changing it now - it is what it is". My polite response back was asking him if today he could notate in his visit notes that somehow that information transferred over a mo to mo even though he never performed such a test showing that I have no limitations with full strength, movement, etc? He shook his head, proceeded to walked out of the office saying "people on disability are just welfare recipients eating away at my hard earned mkney!" OMG I was polite about it , I never raised my voice once. Calmly explained why I was asking this. I don't know what more I can do? Other than the obvious of find a new Pain Mgmt Specialist. I wonder if I have anything to worry about or when the judge looks at the his information, if she will realize that every month is exactly the same other than the few changes I noted above. Maybe he won't be that credible?

very informative videos. my husband and IT engineer doing service management for 30 years got laid off about 20 yrs ago and has ever since not found a long term permanant full time job ever since. he has also chased jobs out of state but since most of consulting jobs are held by indian companies, they have gotten rid of him and placed their own people. this has taken a toll on him and he is in a very depressive state since last year. has stopped eating can barely walk and for a while also when thru a drinking phase to deal with this state. i work 3 jobs now to support the family and its almost impossible to match up to what he made. we are v poor right now. should he try to apply for disability and is there any hope?

my stepfather is a psychiatrist not my personal one but he has seen me at my worst and this has been going on for about a year resulting in not being able to hold a job or daily functioning. is there any way he would have any credibility writing a statement since I haven't seen a mental health professional. He thinks I have panic disorder. I only have multiple hospitalizations and Dr visits. No record of suicide attempts.

My guess is that the Social Security ALJ would give your stepfather's opinion less weight because of the relationship and also because it does not appear that he has evaluated you formally. However, a statement from him as someone who knows you (and someone with specialized knowledge) could help.

They just dropped me as a client because I kept calling for updates and giving them new paperwork as it came in (I believe), but before they did they said 20 hours max. I just didn't believe them because they said they sent in my stuff and SSDI says there is nothing from them so now I have to resend everything again. Yeah I can't keep a job I already had a panic attack at one job they let me go I get panic attacks even just at home for no reason I just feel it all over depression is heavy I just feel tired n unmotivated and drowsy , than I may have a good day energetic happy n next thing know Ill have anxiety just to go to store I'll get Headace n my legs shake alot :( . In a lot of your videos about cases dealing with mental issues you state that the judge usually looks for suicide attempts or inpatient hospitalization. The thing for me is, I would try to do kill myself but I'm afraid I'd mess it up. I will succeed when I first try suicide and from what I've gathered from your videos, it may be my only option. My point in the video is that SSD judges see a lot of claimants alleging disability for depression, anxiety, bi-polar, PTSD, etc. so to stand out you need very definitive medical records and strong support from your doctor. Suicide is never a good answer so please seek help if you get to that point.

what about this womeng takecar my grandchilreng , she have gob her husband is a he work in farmacy, my tuo grandchilreng she put her in s.s. so she cant colict money fr s.s . they only 9 in 8 she only a postrocare , she not eveen amother, for them , she use them .so she cant colict the money fr s. s . we geve her money to three tims ayears, in geveng my grandchilren of midecation , the doctor sycology take the bood teas to them gust make sure they taking the medacatio , she poisong my grandchilren , with medacation, so she cant colict the money to s.s.
