​@ailsaustralia Yes, thank you! Please create a separate video on this issue because it is a clear injustice with the pending applicants. We never expected that Australian Govt institution will take such a baseless and unjust decision. They must have put the limit on their website if they needed specific skilled graduates. Students were waiting for months and years and they just capped 476 without thinking about the applicants who fulfilled each and every visa requirements and gave their precious time for this opportunity.

Anti immigration campaign is extremely clear what they're saying behind all this changes

That’s that s39 is designed for. And fun fact, 476 visa had the legal framework to cap and dispose of applications as back as 2008. They just decide to use it now in order to sunset 476 visa, indicated in their explanatory statement. I don’t think DOHA would use s39 on 189/190/491/186 today but they might consider if they design new PR visas.

@@estellebright2579 well a little information for you, the legislative instrument is based on Article 85 (and not Article 39).

@@hamzaamjad699 Imma quote the actual wording from the explanatory statement. The instrument, Departmental reference LIN 23/089, is made under paragraph 85(1)(a) of the Migration Act 1958 (the Migration Act) for the purposes of section 39 of the Migration Act and paragraph 476.226(a) of Schedule 2 to the Migration Regulations 1994 (the Migration Regulations). And here from section 5 of said legislative instrument. For the purposes of section 39 of the Act and paragraph 476.226(a) of Schedule 2 to the Regulations, the maximum number of Subclass 476 (Skilled - Recognised Graduate) visas that may be granted in the 2023-2024 financial year, between 1 July 2023 and 30 June 2024, is 3,735. Section 85 gives minister the power to determine the maximum number of visas of a specified class or specified classes that may be granted in a specified financial year. Section 39 sets out a prescribed criterion may be the criterion that the grant of the visa would not cause the number of visas of that class granted in a particular financial year to exceed whatever number is fixed by the Minister, by legislative instrument, as the maximum number of such visas that may be granted in that year (however the criterion is expressed). In the same explanatory statement, it also says there is a criterion that visa applicant must satisfy for the grant of the visa, and that criterion states the grant of the visa would not result in either the number of Subclass 476 visas granted in a financial year exceeding the maximum number of Subclass 476 visas, as determined by the Minister in an instrument in writing for the paragraph that may be granted in the financial year. So, in short, DOHA uses s85 to set the limit and uses s39 to link back to a prescribed criterion that existed in 476 visa primary criteria to limit the number of visas that can be granted this financial year, and any remaining undecided applications are taken to not have been made.

They can only do that in specific circumstances. If any evidence comes up after visa grants then this can cause cancellations but they cant do it just to reduce numbers

The Australian population is concerned about the housing crisis, and they are putting pressure on the government to solve this problem. The anti-immigration campaign and visa cancellations will be implemented until this crisis is resolved. Unfortunately, there is nothing we can do. They are right in giving priority to Australian problems rather than immigrant problems.

From what I see, DOHA just grant visas at whatever order they prefer, with no restrictions on who should be granted first. This month they bulk grant 190/189 and next month they bulk grant 491/186 or whatever. I’m waiting too. Don’t lose hope.

@@estellebright2579 i can understand but what's more frustrating is the unpredictability. How hard it can be to streamline the realistic processing time? Or at least give accurate update. People keep renewing pcc and wait for s56 medical request and more 2 3 months waiting.

@@IKARIS87 those who can vote barely care about visa applicants. Those who are suffering cannot effectively voice their displeasure. It’s an unfortunate situation with few ways to mitigate.

@user-pg9vc8ds5m What he told me is there's not more post work permit, and the students are going to try new student permits that for sure will going to be denied because the visa hooping. Also, there's the students' visa under 35 will be denied to give priority to the skill demand. Let's be honest. There's a limited number of people they're going to allow to migrate to Australia and there's not PR for everyone this is sad but is the only solution to the house crisis

@@katchreinberger679yeah but current students who are going to be over 35 when they graduate came to Australia under 485 current requirements. so cutting them off is very unfair because they didn’t come to Australia just to study and left the country, need professional experience. government can filter new student visa but doing this to current students is really unfair.

@user-pg9vc8ds5m agree, and unfortunately, if they try to go to other countries, they will need this course validation . Maybe study again. I agree with you the priority must be who is already inside and located in the country and especially who spent thousands of dollars in universities. But I feel like Australia don't care they're doing and changing the law all the time and always to prejudice immigrants

Hard to say without knowing the figures but yes if the number of grants are reaching the planning levels then things will slow down
