485, 482, 407, Bridging visas, visitor visa holders, watch out! The new Genuine Student Requirements have been released, and it will be harder for those visa holders in Australia to get offer letters. It will begin on the 23rd of March. Universities are already meeting to discuss stopping offering places to those in Australia on Visitor visas, Temporary work visas, Bridging visas and the 485 visa!
Also, the GSM Points tables on the departments' website have misled many applicants regarding Partner Points. The department's response to this incorrect information demonstrates that applicants cannot trust the information the DOHA publishes.

@@ailsaustralia with GTE they wanted to be convinced that a student will return and that is why the Govt wanted to know links to own country, family etc. but... but...now they want the applicant to be honest and state if they wish to stay in the country into the future but in GSR they want the applicant to assure they will return. Amazing contradictions!

Hi Karl I am glad to share this good news that last week i have received my 190 visa grant after 11.5 months from the visa lodgement. @@ailsaustralia universities were on hold for this policy and not allowing students to pay fee and also not issuing Coe's. I hope so now they will work smoothly and allow students to pay a fee and give them Coe's so they can proceed for a visa.

As someone working in the higher education sector, I see firsthand how these new rules for international students are negatively affecting enrollments. This has dealt a big blow to universities' revenues and will ultimately impact the Australian economy, which relies heavily on this industry.

So thats mean people who currently hold any temporary visas such as 485 visa or 408 visa will not be able to grant any student visa if they willing to study qualification which relate to critical sectors such as teaching or nursing?

Does DOHA expect anyone applying their visa to be a competent unlicensed migration agent/lawyer before they apply, because their website is untrustworthy? Not everyone wants to spend $808.08 AUD per year just to lodge a handful of their visa applications, or at least the life-defining ones (189/190/491/191/186/820/309). Regarding the "time of invitation" thing, the only reference I can find regarding partner points and state nomination "time of decision" is within their migration policy, which is not available to the general public. Why DOHA laying rule landmines to unsuspecting visa applicant is anyone's guess, but that is the wrong thing to do.

How does this work for my dependent? We are currently preparing the subsequent entrant visa for my partner, however, their is no questionnaire in the application process. Instead we are asked to upload the "letter statement for genuine student dependent requirement".

Dear Karl, people are assuming that the 190 quota allocated to this financial year is almost exhausted. So the ones who lodged in 2023 April and onwards would have to wait until this July for the new FY quota. Could this be a reality?.

Hey Karl, the planning levels for the 190 visa were set around 30k, as per recent FOI data the backlog after Jan is already more than 30k. We do hear the pressure is on to reduce the planning levels. So if they keep levels below 30k now, how do they cope with the backlog next year?

Planning levels for this coming FY year will probably be the same or a little less than last

by issuing fewer invites next financial year. This is one of the likely actions DOHA would take. We hope this is not the case but with the score change imminent, it is hard to not believe DOHA giving as few of these, according to Clare O'Neil, "low bar PR", while they work on a new points test table. Fingers crossed they issue good 189 invites next FY but I would not hold my breath for it.

Next year invites would get grants in 25-26 ... I doubt pts score will change much... 491 and 190 seat allocations will increase...189 rounds should happen next FY in good numbers

Hy Karl, I have a query. I am an electrical engineer my occupation comes under Engineer Australia and my spouse has a degree in BS biotechnology which comes under vatassess, if I access her degree through vatassess and she scores 50 each in PTE. Then can I claim 10 points in my EOI?

I am writing to seek clarification and information regarding the recent legislative instrument issued by the Department of Home Affairs, specifically the Migration (Institutions and Disciplines for Subclass 476) Specification 2024 (LIN 24/015). Given the issuance of LIN 24/015, I have several inquiries regarding the processing of Subclass 476 visa applications: 1. Will the Department of Home Affairs process previous applications that were affected by the capping on 22 Dec 2023? 2. Does the Department of Home Affairs resume processing Subclass 476 visa applications after the capping of this subclass through this legislative instrument (LIN 24/015)? 3. Is the Department of Home Affairs planning to open a new intake for new applicants for Subclass 476 visas and process new applications? 4. If eligible, can previously affected applicants (whose applications were impacted by the recent capping) reapply for a Subclass 476 visa? 5. Furthermore, does LIN 24/015 signify that after the repealation of the capping of the 476 visa on 30 Jun 2024, the Subclass 476 visa will open again for new applications including primary and secondary applicants?

Below is just my personal opinion. 1. I don't think so, especially for those applications which are deemed invalid. 2. I highly doubt it. The cap is the cap and they are unlikely to raise it. 3. They have stated in migration strategy they will abolish 476. I don't see it opening a new intake for 476, which would otherwise directly contradict what they have announced a few months ago at that point. 4. Only if DOHA is ok to accept new applications, which I have a hard time seeing it from happening. 5. Given there is no update of any sort between LIN 24/015 and the one they repealed IMMI 14/010, I would not choose to believe DOHA would open 476 again in 2024-2025 FY. What I think is the likely outcome is they repeal the previous legislative instrument with LIN24/015 but makes no change to its content because otherwise the old one would expire before DOHA can finalize all the 3735 subclass 476 applications they decide to process and grant/refuse during the end of financial year 2023-2024, meaning case officers would have no in force legal basis to assess applications against prescribed criteria. In short, they just "renew" that legislative instrument.

In section 39 of the migration act, do they mean if a grant is not given in a particular year, the application can be forgotten? When the following is said: (1) In spite of section 14 of the Legislation Act 2003 , a prescribed criterion for visas of a class, other than protection visas, may be the criterion that the grant of the visa would not cause the number of visas of that class granted in a particular financial year to exceed whatever number is fixed by the Minister, by legislative instrument, as the maximum number of such visas that may be granted in that year (however the criterion is expressed). (2) For the purposes of this Act, when a criterion allowed by subsection (1) prevents the grant in a financial year of any more visas of a particular class, any outstanding applications for the grant in that year of visas of that class are taken not to have been made.

We (my wife, 2-kids and myself) lodged in our Visa July, 2023 for 491from offshore but all the points was from my wife alone at invitation - being the primary applicant. No English test report from me expect the letters of English proficiency from the two different higher institutions i passed through. We haven't heard anything from immigration but I'm bothered by this report. Please, we need your advice on what we can do to avoid any delay on the Visa approval. Thanks 🙏

Regarding the false misleading information from department of hopeless affairs website. Its across the board. So my wife and have lodged a child support visa offshore for our daughter who is over 18 but under 25. Full-time student and is financially dependent on us. Now knowing the bs complexities when it come to this type of child support visa. We are using a very good reputable immigration lawyers here in Melbourne. At the time of lodging the application I was chosen as the financial sponsor for my step daughter. As it states on the DHA that a step parent or legal guardian of an adopted child can be the primary sponsor. Then my lawyer noted to me. A question on the 47h sponsor's form. That says " only a biological parent can be the primary sponsor" See how that contradictics the website. What a joke. Anyway my lawyer changed the sponsor to my step daughters mother. Thank god and that's why you pay money to a good immigration lawyer.

@@dhavalvelariya considering PCC is a mandatory document (from my memory) you must submit during the 190 application process, I would guess DOHA system has made it easy for case officers to spot missing critical documents and send out s56 fairly quickly without processing it further. We would not know for sure how they would process each visa applications exactly but s56 doesn’t mean much for your 190 in my opinion.

@@failedrift no one knows when these reforms are expected to happen, but when it does happen, all uninvited EOIs will very likely adapt to new points test system just like what happened in 2018 when they adjust partner points to "not disadvantage single applicants", and all uninvited EOI got their points updated automatically.

However, I have deferred my course to May 2024 due to the age restrictions. I am confused whether i shud move to Australia or cancel my visa and stay here in Bhutan. State invitation is not the same as DOHA invitation, and that is also separate from actual visa grant. Migration planning level outlines how many visas they are going to grant each FY, not how many invitations they are issuing. If you need more proof of that, consider the 8 Dec 2022 invites of 35000, which shoots over the planning level of around 30000, and that’s on top of two big rounds of 11000 in Aug and Oct of the same year, totalling 57000. If we also count the last 189 invitations issued on May 2023 (7353), that’s about 65000, double the planning level. 190 works the same way, but add state and territory government as the extra step.

Gathering data from invitation rounds make it more confusing and difficult to draw specific conclusion. Therefore, I am looking for ceiling of visa grant (PR) per FY, if such information is available

@@phubdorji7465 Karl had a video talking about what visa subclass is included in each visa category mentioned in the planning level. In a nutshell, Skilled Independent is about 189. State/Territory Nominated is for 190. Regional is for 491/494/887/187 (last 2 I am not 100% sure). I suggest you watch that video if you are interested in that topic.

Yes do not get married when your skilled visa is processing. Last year my 190 visa got rejected because of marriage and updated, I lost 10 points and got refused so.

What if an onshore student awaiting for a study visa outcome, and they have been granted a BVB to travel outside Australia. Question what happen if Applicants student visa refused when they are offshore on a BVB: 1.Can you return back to Australia within 35 days period? 2. Does your refusal have appeal right? is there anyone having their visa application waiting time as long as over a year?especially those applicant for 491,if you already waiting over a year for your visa to be granted,you still have to wait at least another 3 years for your 191 application. That is how home affair stealing our lives. Home affair should change the game for 491 visa,the 191 visa should be eligible for 491 visa holder who get nominated for 3 years instead of having their visa granted for 3 years

those 491 applicants already live,work,or studied in regional area for years but still wasting time on waiting for visa to be granted. Think about how many years it takes for an oversea student to have 191,could be 6 to 10 years in this situation. And given that 491 visa applicants are who really make contribution to regional area but do not get benefits of permanent residency,this just prove that Australian just want foreigners as poor servant to them rather than build this country a better place

@@xuyanyue7459 yet still, it is MUCH better than applying temporary visas one after the other to maintain ongoing residence. It has a clear pathway for permanent residency and you just need to do the right thing. 189 and 190 both are extremely competitive and is generally not an option for some extremely popular occupations such as some IT ones and Accountants. For some people, 491 could be their only hope for Australian PR. I am not saying 191 not counting regional residency during 491 processing but only after 491 grant is fair, but while you were waiting for the visa grant, your BVA/BVC has no condition, meaning you don't have to live in regional before your 491 is being granted. I totally agree there should be a change to this injustice, but I am just addressing the issue from the other perspective.

Actually,not only hot occupation is competitive,every occupation is competitive except for childcare and nursing and few other occupation. In this case,the clear pathway you mentioned is everyone spend 2 years to go to study childcare. And this is happening, people go after welcomed occupations but go to other industries after PR is granted. Keeping sending a lot of easy PR to those so called “in demand occupations” is a cure worse than the disease. I’m just putting childcare as an example here, it is been years for people studying childcare to have minimum score of 65 and get PR. Have Home Affair ever seriously investigated how many people leaves their nominated occupation after PR is granted? I don’t think so all their decision is a result of drinking coffee and reading reports from nowhere. They never doing their research. If Australia really needs a lot of babysitters, the child care should be put on so much restrictions as 491 visa doing: if they not working in nursing or childcare, no PR after 5 year. At least this can make some change. Again, I agree with you on PR is competitive. But restrictions should be put on those easy PRs, instead of putting on people that can only get a 491 because of limited allocation number to 189 or 190. And you mentioned that bridging visa has no condition of where applicants can live. But where to live is not a problem, maybe the applicant love regional areas. The time for people can really get a true PR is what it matters
