Australian Immigration News: The Big Lie to International Students: DOHA's new info on the 485 visa 

To date, my friend has spent 3.5 years on his PhD and paid 85K AUD as a tuition fee, and now they are saying no 485 PSW visa because he started PhD at 33 years of age. This country seems like a privately owned company. Shame on them.

So the people who helped them during the pandemic were mostly migrants who worked in retail, aged care etc. were the experienced ones. That is, they are at such an age that most will be removed from the system. Other countries celebrated them and gave a solution to their state but here in Australia we are deprived of hope. Great just great. We contribute in the economy too and to the workforce. Don’t treat us as if we are nothing.

It's ridiculous. When I started my Masters degree, it was supposed to be 3 years. They then extended it to 5 years, and now they're talking about reducing it to 2 years. What the hell? In a period of less than a year, they changed it twice. They should at least honour students who have started their course BEFORE this announcement. A 5 year work visa gives employers more confidence to hire on yearly contracts as compared to 2 years!

Since the age limit was announced, I have been frustrated, hopeless and depressed... as if the lights went out in my life... I hope that the government will treat us fairly, as we are students who spent a lot of money, time, tears and efforts to study here after the same government promised us that it would offer us an extended postgraduate visa... It is psychological torture for us.

People above 35 are the ones who have family resposibilities and take the risk of quitting well paying jobs and try to fulfill their dream of educating themselves hoping to gain some Australian experience , not giving them 485 when its clearly mentioned on the immi website based on which they took the decision is great injustice. They need to 1st fix the website saying anyone coming on student visa after this particular date turs 35 cannot apply for 485 ,so they can take right decision.

Thank you for your video, Karl. As a current Ph.D. student with a debt exceeding 40k for my previous degree here in Australia, I will be severely impacted by this measure since I am 38 y/o. The department of home affairs has no idea what they are doing, kicking out researchers after giving away tons of free covid visas, It is so contradictory. I won't even have time to do a skill assessment without a post-study visa, so 'offering' other pathways is indeed an insult. Your video, at least, provides a small comfort, and I don't feel so alone in this situation.

Hi Karl, I'm a regular in your comments, and I'll keep commenting until there is a pathway for skilled accounting graduates already working in their field (but with less than 2 years experience). Firstly thanks again Karl and team for pursuing the 485 age limit query with the Immigration dept. If at all they go ahead with the age limit for the incumbent students then I presume they would have a large problem at hand as in with the large number of effected students.

Thanks Karl for taking up this issue and bringing out their plan. I hope they give age limit exemptions to those who already got their student visas granted as they would not hv applied for student visa had they knew this age change for 485 upfront. Don't know why dept is running up and down, just like a head cut chicken. They give extensions and then after six months they are saying extensions will be stopped, they have invited 2 years worth of 189/190/491 visas last year and this year and then it's all got dried up (wa closed their program yesterday). 476 is another U turn. 191 salary was a big confusion that you have taken it up and sorted out. Why are they unable to decide firmly and decisively, what is the right thing to do considering the country, economy, migration, education sector and students? It's full of chaos.

Hi Karl, I came to Australia in 2019 for masters program in IT, studied full time paid all the fees to the university completed the course in timely manner even though there were covid crisis across the world. Worked as an essential service employee for one of the Australia's largest fmcg companies paid all the taxes on time while being a student visa. After course completion Worked for 2 government agencies while being on 485 visa as a Business analyst but still Australian immi and government doesn't recognises the skill and hard work done by me. I have put my eoi in 2023, wa government kept changing the rules and regulations hence no pr till now. Some of the suggestions irrespective of whosoever is in the power (labor or liberal) 1. Government should have adopted single window policy by giving direct PR to all the candidates who did courses and paid taxes during 2019-2021 during Covid crisis especially onshore ones should have been the high priority. 2. If we trace back to 2021 Canada and New Zealand gave direct pr to all the people who were working and helping during Covid crisis. Whereas Australia had closed had shut the doors and were sitting ideal doing nothing. Not only me Many of my friends are also stuck in the same boat since 2021 waiting for pr.

That sounds about right...take what you can get and then let them go.... We spend over 100k in the last year to prepare our way to PR, 320,- a week for "free" state school education for our daughter. 16k for health insurance from the same supplier as we already booked and payed in Germany with way better conditions for less than 5k for the three of us.....to now live in such mess.... I think I buy a yacht and do a lap around the world to find such a nice place, but where I'm actually welcome. Love the country and most people but this government has big issues.

What’s about this Australian government? Those young ones who are doing diploma and degree with very less tuition fees are getting post study work time, and the ones who are doing masters and phd paying huge tuition fees and already above 35 age are not getting TR visa. An excellent video Karl - I had been telling clients that from a legal perspective, generally a new law can't take away a right already obtained, and changes like this are usually grandfathered or transitioned to allow those already in a pipeline to continue. This news is very disturbing (and as you say the PhD students are worst affected - they are more likely to be closer to 35 or past it ) by the time they finish their PhD. So kicking those we most need the hardest (meanwhile the dodgy college Advanced Diploma in Hairdressing and Beautician sneaks through). I'm exaggerating of course but its very annoying - Owen HARRIS - Accredited Specialist in Immigration Law.

They themselves should consider the age factor to represent the country. If 35 years above is considered a debt then these sort of decisions also should not be given by the same age group people because it seems they are not capable of a rational decision either. And ofcourse as the title says This is A Big Lie by the ministers and the Govt.

What I’m failing to understand is how the government can legally implement this age change onto existing student visa holders when the current 485 visa application page states: “temporary visa that allows international students to live, study and work after you have finished your studies”. And then goes to mention eligibility up to 50 years underneath. Surely there must be legal repercussions for stating that word “allows” and then taking it away from students that signed up based on that condition? Thanks so much for all your help.

Hi Carl, Why DHA is most of the 2023 lodged visas other than the 2022 lodged non priority once. Because Ministerial Direction 105 has mentioned as "All other skilled visa applications are assessed in order of date of lodgement" after the priority occupations.

They should not apply the age limit to those who are already here…. They can apply it if they want to the incoming ones at least they have the chance to rethink to go on or stop. I am curious about how with the current high rejection rates for student visas we can justify charging such high processing fees (and also the insitutional application fees) when the criteria for how they will be evaluated are not made public. Instead of wasting their time and money shouldn't students be advised up front whether they have a realsitic prospect of approval and within a reasonable/fixed time..?

I still think that there would be some pathways who are already enrolled and near completion of their degrees, particularly PhD candidates who are older and a talent pool.

Thank you for your effort and the great work you are doing for the students! Post work visa was part of our study package and it should be honoured. If anyone applies knowingly afther the rule is implemented, then it is the individual student's choice and its his/her fault and the Australia governemnt can enforce. But those who have come here before the announcement of the new rule with age limit, they did not have a choice and its not their fault that they chose to study in Australia. So, the new rule must only apply (if at all) to those who apply for studies after the new rule comes into effect in mid 2024. In my experience, age limit is bad especially for the PhD applicants as people with solid field experience applying to PhD would be mid to late 30's and therefore Australia will loose out on many skilled and experienced PhD candidates.

191 processing time is getting long .some months ago it was only 15 days now it taking more than 3 months .we are living in regional around 3 years and still waiting for more months it just really frustrating.I hope it don’t become like 887 visa 😢😢

I see lots of court case if this were to be implemented. It is highly probable that those making these laws were never international students, so does not know how tough it is. Implementing this law would see an exodus of international students out of Australia and people outside will not come in, so the government will loose that industry. I hope they stop this. So it says the applicants who lodge after the implementation of new age cap will be affected which means exisiting students and applicants who lodge before age restriction implementation will not be affected.

When I started my studies,I was eligible for six years in a 485 visa. after 6 months, Now I have zero. what is the meaning of this? We are spending thousands of dollars and paying due taxes. We are highly qualified and can serve Australia for many years to come. Seems like Australia values Afgan refugees/asylum seekers over international students. This government is doing great harm to the reputation of this country. It is not the way forward. Carl, can we take any legal action/appeal against this government's unfair decision?

I have some queries, I hope you will clarify it. I'm a toolmaker and having 80 points for 491 visa & 70 points for 190 visa including state points. As of now, I lodged EOI for South Australia on 17th October 2023 as a Offshore for 491 Visa. Still I didn't get any response from the SA state. Do you advise me to wait or want me to lodge one more new EOI & ROI for Victoria state as it's open for my occupation and I too interested to work over there ? Why I have been selected SA and waiting till today is because that they may invite early because it's a regional area. Please correct me if I'm wrong. I would really appreciate your help on this! Students over 35y brought significant amount of WORK EXPERIENCE with them, they could be the ideal fit to the crucial positions across industries if they receive the work rights. They are the assets of this country not the liabilities. This wrong move will worsen the on going skill shortage crisis.

And still they don't run even a proper 189 invitation for all majors and keep graduates who already have all documents especially Australian job experiences submitted , as a priority to end this limbo ! especially or the population of onshore graduates who have no idea at the end what is their difference to offshore applicants? or what they should leave so labour government stops bringing offshore applicant a new migrants ? it is such a mess and such an embarrassing

Really ????😮😮 But what happened Karl if I finish my Diploma in Earlychildhood... which kind of Visa can I asked for after that ? I am 42 years old ... Post Graduate visa is which one exactly? The 485 ? Right ? What happened for Student's who are more than 40 years old and have a Certificate 111 and Diploma without Masters Bachelor...

What’s even worse is that anyone currently on the 485 visa over the age of 45 is unable to get Permanent Residency. There are no pathways to PR after getting this visa and worse is that you can’t even get a decent high paying job on this visa anyway. If you do your research most people on this visa are in low paying jobs after paying over $150,000 for a degree biggest disappointment.

Hi AILS Heartbreaking and very unfair indeed. It also send out a message that one should set on a career at a young age and stick to it. Some individuals only realise in their 30s what career paths they choose to peruse, and some do so because of financial reasons.
