I started out this video assuming I was going to get upset that this guy was wrongfully detained because I’m a conservative and have been following his ads and what he stands for politically. I still might agree with his views, but these poor officers were absolutely as patient as can be with him. They listened and tried to help him find an alternate solution… They had to follow the law as an “officer of the law.” Mr Cook kept pressing and trying to prove a point about free speech and I get it…and I’m glad we have people like him to stand up for these things- But he was trying to go around the law to do it and kept pushing and thats when officers were forced to try and control him. So sad that we ask these officers for help when we are in trouble, but we chastise them for following the law. 😣💙

@@methuseluh1 ummm… 🤔 I get your point, but waaay off in comparison. We don’t have even CLOSE to the same laws and ruiing as Nazi Germany in the 1940s. But way to take it to the extreme so quickly. 😅👍 My only point was that these cops handled this really well. They have my respect. You can choose your own opinion… Just don’t go calling them for help if you wanna compare them to Nazis. THAT mentality is exactly why blue states like Oregon, California, Illinois and New York are drowning in crime. Go live there, if you want to disrespect our local law enforcement. Thats ridiculous.🙄

The next family effected by such tyranny can be yours if your lack of concern or vigilance continues.

Good grief 🤦🏼 He repeats that he was told not to enter USPS property including the parking lot. He was told he was trespassed from the property. With all due respect to his right to run for election, not sure I would vote for someone who doesn’t comprehend the officers’ concise and clear explanations and doesn’t understand that the Rules and Regulations are based on Federal law.

There are zillions of videos online of police officers and government agents misunderstanding (or pretending to) 1A jurisprudence. Could have been the same here. As it turns out, the USPS is a limited public forum barring this specific activity. But it's almost a moral accident that they were right (given that their explanation in the video seems incorrect as to the why).

Much like courthouses, the USPS is not a public forum despite being public property. There are civil administrative codes in place for both that prohibit many activities so that the agencies on said property can function properly.

It was irrelevant that he needed to collect 2,000 signatures from people in his area, or who was trying to block him from being on the ballot or if those people were related. The only issue at hand was can the post office prohibit him from collecting signatures on their property. If he questioned that PO location’s response, then he should have checked it out with the main post office. Most people with average intelligence would know that prohibiting you from doing something on their property not only means inside their building but on their property outside the building. As a candidate he displayed a general lack of common sense and how to address a minor problem once it was explained to him. He could certainly have collected the signatures by moving to the public sidewalk, he was attempting to make an issue out of a non issue. He just had an axe to grind.

From what I know you can’t go into a Government Building or any Building to collect signatures. Youcan go to Apt Bldgs but not Government facilities.

Wrong. Post office is not a traditional public forum, thus subject to time, place, and manner restrictions. In other words-they can trespass you off the property.

I understand both parties’ pov. I understand that this man is confused about why he can’t collect signatures at a post office, as government buildings are supposed to be a designated place to do so. However, these officers said the words, “not on the property or the parking lot”, along with, “on the sidewalk” I don’t know how many times, and I’m too lazy to count.😉 I agree that there does need to be some clarification as to why a post office, a government building, would not be a place to have a public forum. It’s federally owned.. soooo… that doesn’t make it a government building or… what? Serious kudos to these officers for having patience with people who refuse to listen, and they think they’re going to do things “their way”.

You can tell the guy has something wrong with him. His monotone robotic speaking of irrelevant gibberish is a big sign of that. Plus his inability to comprehend a simple trespass warning and his desire to do whatever the heck he wants in the name of freedom or whatever. He's lucky the police treated him so nicely, as I've seen other vids that didn't go down so well for the perp.

On the grass is ok, off post office property. The post office isn’t a traditional public forum therefore subject to time, place, and manner restrictions.

Got to follow the election laws. It is becoming more difficult for the “little guy” as corporate interests control the both the private ground, and the public ground. Don’t think they don’t. This gentleman demonstrates a great point, unless you’re rich or have a rich sponsor, you’ll be campaigning from your homeless encampment.

On a busy shopping marketplace meant for walking shopping tourists outside. Thats where we collect signatures in VT for this purpose.

How in the world do you trespass a senate candidate from federal property? A post office is about the closest to a public square as you can get in most places in the US.

No it’s not. Public business, DMV, USPS, court, law enforcement department is not conducted in the public square. You are confusing public forums (public square, public park) with public access to government buildings. They are not interchangeable. The candidate is incorrect.

@@kmmb8266 No, I am talking about something such as the corner of Main St. and 1st St. USA . A place where people cross paths with others. A perfect place to stand on your soap box and be heard by the masses. Why I said "A post office is about the closest to a public square as you can get in most places in the US." @@-o-The-Duke-o- A corner on a public sidewalk at the intersection of roads is a public forum as would any part of a public sidewalk. Still don’t understand why you think it applies to USPS property. It’s not a public forum although it is publicly accessible for postal business.

Don't come after me, I am new to all this. So, is there a reason that he can't collect signatures at the post office? If the people don't want to sign, they dont have to. Yet they have voting drops at the post office. I don't understand the laws regarding this and why it's an issue. Can someone please explain it to me. I like to understand the what and why so that I can make an informed decision. I live in Utah and do not know exactly how these laws work. Can't he just stand on the sidewalk at the entrance to the post office as people come in and leave? Or would that also be an issue? Thank you in advance for explaining this to me. 1 more questions. Is he no longer allowed to enter the post office ever again? What if he has a postal service reason? I am super sorry in advance that when it comes to law I am not so informed. I would like to be. Also, are police supposed to turn tbe sound off to the body cam in the middle of a situation such as this one?

A USPS is public property, which means they cannot arbitrarily deny him access. All public property is divided into at least two types: limited public forum or public forum. In a full public forum you essentially cannot be barred from any 1A protected activity, which would include collecting signatures. HOWEVER, the post-office is a limited public forum, and certain types of 1A activity can be restricted SUBJECT to neutral time/manner/place restrictions. This means that they can ONLY bar him from collecting signatures if they ALSO bar ANYONE ELSE from doing the same. (In other words, this restriction must be neutrally applied to everyone equally). Hope that clears it up.
