Ginny, can I file an appeal if EDD sent me a letter for overpayment because I quit my job with no good cause according to EDD. I quit due to covid and school closures, there was no one to care for my kids.
Hello Ginny, I was recently disqualified from receiving benefits after my phone interview was was done and when they came to a decision. They said I might have to pay back the money i received from Unemployment (thousands of dollars). If I was not eligible to receive unemployment money since the beginning why did they approve of me to receive unemployment money. This is not fair and feel cheated becuase they changed their minds and want every cent back :(
An EDD worker disqualified my whole account just because I left the country for 13 days, when all he or she needed to do was just not pay me for those days... Now I've got to go through appeals.
Isn't the EDD legally required to tell claimant why they are denying pua income verification, particularly if you have submitted something official like tax documents?
Hi Ginny I wanted to share this inside information so you can share it with your viewers. I successfully uploaded my document for proof of work and received by mail that it was acceptable to the Edd. Before I submitted though, I reached an experienced claims specialist on the phone who told me **that anyone who submits documentation from 2020 will be denied. She said the documents should only be from the year 2019. I read somewhere online on their OWN site, a reference to the timeframe bracket being from 2019 to 2020, yet this is what she said. Prior to her telling me this, I'd planned on submitting documentation from 2020, thinking that they preferred something more recent and closer to when covid-19 broke out. But that's what she said so that's what I did and it worked. Hope this helps anyone who still needs to submit or needs to resubmit and/or appeal: again, stick to documentation from 2019.
I mailed them my response one year ago and they finally got back to me saying I need to do the phone hearing. I moved due to a new job and as I no longer have access to all my schedules to prove my case, I am worried how I can prove my case without physical evidence. I am planning on writing my statement via mail as I can not take days off and gave a very detailed explanation in the best of my ability. They said I was fraudulent in filing a report. I only filed for EDD when I didn't work the 40 hours and following company HQ... Do I still have the chance to win my case? What if I lose? Do I just pay back or is there a big fine? Because this is not fair.
Hi Ginny, I am wondering who is checking how EDD works? A lot of times they not competent and doing very bad job. How we can get attention to this problem? I believe a lot of people getting terrible treatment by them in most vulnerable times ( being sick). Would be nice together send letters to authorities.
Hello Ginny, I have an issue with IHSS monies I earned taking care of my sister in law IN HOME. I thought I did not have to report these "wages " to EDD since they are considered "benefits " not wages...or so I thought... EDD says the law has changed and I owe them money for not reporting these "wages" for 14 weeks. I am also having to pay penalties for this as well. I am waiting for the letter telling me how much I have to pay back. Still I think they are wrong but cannot find anything online to support that. Do you know anything about IN Home Support Services wages and how/if it should be reported to EDD? Thank you in advance for any information. You have helped so much over the last two years. @@aracelybarajas81 I do but the wages line is "0" because i take care of my sister-in-law in our home. That's why I'm confused. If the w2 is 0, how can the EDD consider that as wages??
Hi Ginny. I was disqualified for PUA in oct 2021. Recently got done with the hearing and was approved. Than I was disqualified again because they say I’m eligible for UI. Truth is in the 2 yr backdate starting Apr 2020, i have W2 after Sep 2021 until now because I was working on and off since than. Do u think I should ask EDD for a 1 yr backdate instead of 2 because starting Apr 2020 and 1 yr forward I had no job or W2.
Hi Ginny. I submitted all my documents for my PUA for federal requirements last Nov 29, 2021 & got an email from them Dec 5 stating that they received all the documents I sent. But until this date I have not receive a letter from them saying that if I’m disqualified or approve. What does this mean? Hope you can help me. Thank you.
I received a notice ‘from EDD via US mail instructing me to go to another doctor for a second opinion.and was instructed to fill out a form with an appointment date to see the new doctor and mail the form within 7 days and I did. Now i got an email within Edd webSite like this DE 2517-07, Notice of Determination - failed to submit to medical exam’. And disallowing benefits for not sending the form. My appointment is at the end of this week and it looks like EDD. Has not received the letter yet. What should I do. Edd website is giving me the option to appeal however i submitted everything requested on a timely manner. Please help.
Ginny I have an important question, I had a change of address so I do not know if my documents were approved I'd like to know if anyone received any notification or approval or denial through UI online this would help me and take alot of worry away, of course I can't get ahold of the EDD to find out and Id rather not bother with the office

I only got one letter from Ed after submitting my documents it stays the documents I submitted stated pua claims met legal requirements and further action is required at this time does that mean I'm clear is when I submitted my documents I didn't get to submit all of them and I have not heard anything from them since this was March of March 15th
In 2020 I left a company because I felt I had no other options due to their horrible COVID-19 practices, or should I say lack of. It was already a difficult company to work for. I informed EDD I left due to not feeling safe at all from the practices the company wasn't performing. An employee was exposed to COVID (didn't know it yet), came to the office the next day, found out about the exposure and told us she was getting tested. Upper Management (CEO) didn't inform anyone about this, didn't do any preventive measures such as cleaning and what not of persons desk until a week later. Then it was decided it was time that I should go and finally go and clean her workspace. It was also decided that when any employee who quit (which was many), who were allowed to work from home, it would be my responsibility to clean all the returning equipment and materials. I was also supposed to clean the interview room, chairs, desk, door handles when interviewees would come to the office. There was never a concern for my well-being. I had living at home with me my mother-in-law who had a stroke the previous year and was very frail. There was also no concern for her safety if I were to bring home any germs to her. The EDD person inquired if I expressed my concerns and I said I didn’t as I was afraid of retribution. It was a very hostile work environment. I felt I didn’t have any other options than to do what I did. I have already received all of my benefits from EDD (2020-2021) and they are just NOW (7 months later) saying I don't qualify. I would have to pay back thousands of dollars upon thousands. I don't know what to do. I am beyond sick with worry and just desperate with worry, suicidal desperate. What do I say to win this appeal?
I’m kinda in the same boat. Just got a letter that I have to pay back like 8k back. Ridiculous. They said I didn’t have good enough reason to quit my job. Now I’m just gonna appeal and see what happens.

Last I heard, they’re about 6 months out for even getting a hearing. Call your appeals office. Hopefully they can help. I am here looking for the office information of my appeals office to hopefully call and get pushed through
The EDD will always rule in favor of your employer in any case of eligibility questions.. they will basically take your employers side and call you a liar even if you have compelling evidence to the contrary

About to do same thing. I worked large project, started worked not even 2 weeks it shut down for snow storms and then I went back and worked 7 solid months and they wanna give me 141 a week. I tried to cancel they said oh uou don’t need to, this was before I rec a payment, then they send a payment which I didn’t want and now tell me oh too bad Nothong we can do. My previous employer said I was absent without permission which was untrue so the previous employer is lying i have all documentation this is so wrong. When I worked there they would find things to say about employees for example saying dishonesty etc so they don't have to pay for unemployment
I happend to log in to my edd account today and saw a message i have a phone interview next week? I never got anything in the mail regarding this interview with information they claimed they sent me? Anyone else get an interview date? Is this where they determine if we qualify again since the year is up for most of us? Also I haven't received any benefits since it ended in September.
I'm just waiting for my date, unfortunately I can't afford to hire Pershing law a attorney I was but after finding out the fee I applied myself praying this is resolved and I won't have to pay back the unemployment I received I'm still unemployed do to an injury so I'm not sure what will happen

I filed an appeal because I was denied MEUC benefits because they stayed my docs validating I earned 5K or more. I finally had my appeal hearing. I called the appeals office and was told decision has been made and they refused to give me results over the phone. If you win your appeal, when would funds be deposited on to the card? Is there a back door way to get your appeal results?
Only letter I got from edd is that I should should be getting another letter soon with a court date but still haven’t got it I sent my appeal in January
@@ginnysilver she asked what happens if you don't file the appeal not what the appeal is for. If you dont file, its as though you agree with the decision made. whatever that decision is is what will happen. if they say you owe money..youll be responsible for that
I got disqualified because my identity. I appeal right away. I sent 3 copies of my w2's, copies of my passport, passport card, I,D, SS statement, all pages of it. I Learn if the interviewer is bi-polar and gets its stupid attitude, don't talk back. By the way, initially I got send a check and got disqualified after, because apparently they didn't know who I was. It makes me think, how stupid this department is, Their sending money to people they dont know who they are. Also don't rely on their website they never update your account, never rely on mail correspondence, It's always better to talk them through phone or make an appointment. If you have to sent paper work, send it through priority and make them sign of on it. They loose people's letters, including appeals forms all the time and say they never reived it. Keep your priority mail receipts so have proof that you sent all of what their asking for. I'm still waiting for a appeal interview, it's been over three month, they own me 33k. I not given up. IF COULD GO BACK TO WORK I WOULD.

Got an Overpayment Notice in the mail like 3 weeks ago. They said This is from 2020 because I “quit” according to my job. Which I never told my job that back in May 2020 when quarantine was over. I said I couldn’t work at the time as schools were still closed so no child care. So They put me on leave. From then on I never contacted them nor they me. Schools stayed closed for almost a year I think. Idk. Lol. So EDD sent that notice 3 weeks ago that I owe 7k. And this past week all of the sudden all my banks send me weird notices of accounts being closed, on hold, or needing verification. The BOA prepaiad card from EDD had 5k and 4 cents left in it and today I see the 5k is gone. And by Bank Of America. Yet they left the 4 cents…? At this point idk If it’s EDD, IRS, or if I’m being hacked? Most likely EDD but aren’t they supposed to send a another letter after 30 days of the overpayment Notice so you have info on how/where to pay it back..? Why leave the 4 cents in the account? 😂 I don’t get it.
