My former boss wanted me to sign one of these non-compete agreements, but the catch was he didn’t have one written up. Me, having a previous job as a paralegal, wrote up one that was completely unenforceable and signed it. My boss was completely unaware of this and signed it too. So when I quit and he tried to enforce the non-compete, he was told that there’s no way he could enforce it by his attorney. Needless to say, he was furious about this. Just goes to show, don’t be an ahole and try and suppress your employees and you won’t be made a fool of. 😊

Someone enforcing a noncompete clause changed my life as a single parent in a sort of remote town when I was laid off by the company, and then couldn’t be hired by anybody else as a speech language pathologist because of noncompete. I had to leave the support system that I had, and move 1000 miles away to set up a new life that I could afford like the old one.

Years ago one of my daughters was trained in medical transcription and was applying to a firm with one of these non-compete agreements. She would have had to apply to some other employer at least 50 miles away within 5 years. Her dad & I advised her not to go with that firm, and thank goodness she listened to us.

Heres a radical thought. Create a great place to work and stop worrying about all these ridiculous non-compete things. And also, workers who have more disposable income from better pay can... shocker..... spend that money in the economy, which is.... good for businesses.

I used to work for the IT dept at Ryan LLC about 10 years ago. I'm 0% surprised by this. They were shady as hell when I worked there.

I had to sign a two year non-compete to work for an after school program. I was lucky to clear $1400 a month.

People learn things at any job and that’s just reality. This TRAP stuff is like a corporation claiming monetary compensation for having “given” you something that literally everyone gets in any life experience. They might as well charge you for the air you breathed while working because it was in a building they owned.

The corporate billionaires will sic their dogs on you. if you try and stop them from stealing from the people. I pay 4 times as much as I should for home wifi, because there is monopolies.

I was being interviewed by HR and they were concerned that "our competitors" might gather some of our source code from the trash, I grabbed his arm and said "REALLY, because if they do they would never get 100% and they would have to WORK to catch us and when I was hired we were 20 years behind, if we can get them to work feverishly to try and catch up... would be an unattainable success... It is a vacant lot now...

When I learned to drive semi I trained through Schneider National. This was 1996. We were required to sign an agreement that we wouldn't drive for another company for 6 months. I thought that was fair.

I was a subcontract yoga teacher to the government and i had to sign one a decade ago... Fortunately it gave me enough work to make a living back then... I don't know about today, but those yoga contacts dropped 30% since 2011 making it completely impossible if an nda was required now, you'd have to be a pt teacher and do unrelated work if that is still required.

You said it perfect when it comes to company’s non compete policy. I personally my current company forced me indirectly by giving me a good sign on- bonus when I needed for my mom’s surgery. They let me signed a 30 mile radius non compete for 2 years after leaving them!

The irony is, Governments at all levels are training grounds for private industry. Go work for the government for a handful of years then take that training, experience, and talent and work in private industry and earn a nice living. Private industry relies on the government as a resource to train employees and there are no NDEs involved. (I've seen it firsthand over the course of the past thirty plus years.) That corporations turn around and use NDEs to suppress labor and wages is hypocritical but not unexpected.

I worked as a dog groomer at Petsmart and had to sign a non compete that I couldn’t work anywhere within 10 miles of my location for like 3-4 years because they didn’t want the business that could generate to follow me and leave them. They figured a 10 mile distance would stop customers from seeking me out because it was an inconvenience. Which would inhibit me from making the same commission and tips from those requests that would follow me to the new place. I had a store manager actually bring charges on another groomer that went to the Petco like 2-4 miles down the road and Petco decided not to hire them because they didn’t want to deal with the legal things that would come with hiring that person. And they definitely threatened to make people pay back they’re “grooming school” which is they send you to another store and have a district area trainer teach you for a month if you’re lucky enough to get dogs booked for the academy then you go back to your home store for 200 dogs while your salon manager trains you. I think they wanted to pay back atleast like 10k if you left before your 2 year contract was up

The vast majority of companies know that all of these non-compete agreements are completely unenforceable and never even attempt to do so. It's all just kabuki theater.

Does anyone know how the no compete ban affects independent contractors? I’ve read through the entire thing, and it seems to only help employees or former employees of a company. I signed one 15 years ago that said I couldn’t do any work for clients if this company for two years after my association with them ends. Now it has been reworked to in perpetuity, even if the company changes their name or ownership. I’m no longer getting work through them, but I have written for literally thousands of their clients over the 15 years before. Between that and generative AI, my freelancing prospects are shrinking fast.

have a non compete (medical) hate it. but it does bring up if I quit my admins and care team are basically unemployed. whomever replaces me if internal would need to rehire them if external my company wont keep them 8 months which is the average time it takes us to recruit for a person in my capacity and then that person takes another 3 to 5 for credentialing. We throw around 150K in terms of recruiting and credentialing cost which then again... maybe we should focus on employee retention not through non competes and maybe that will change now but yes me quitting is 4 or 5 people out of a job after my 60 day required notice.

Use-it-or-lose-it for laws is indeed a working concept in some jurisprudence. The term is desuetude, used for a circumstance in which a long, long time in which a law is not enforced is grounds for a court not _allowing_ its enforcement. That said, while it is applied in Scottish and English law, it is not in American law, probably at least in part because our laws like our country aren't old enough. WE get cranky about 19th century laws getting resurrected for use like Comstock or Arizona's 1864 abortion law, while desuetude would be something applied to (e.g.) 17th century ones. We don't have it quite as a legal principle for courts but we do both have a political tradition of looking askance at the sudden renewal of laws written in very different times, and an expectation that plenty of long-standing policies should be reaffirmed in (e.g.) budget votes yearly.
