Constable Denise Paul Hatch said she would enforce lawful orders. Does she contend that the previous order wasn't lawful? Was she engaging in an act of civil disobedience?
Appliing for a stay doesn't stay the writ.The stay has to approved by the presiding Judge after a hearing. The hearing isn't delayed because a stay has been applied for.
When the stay is filed it halts any writ until the stay is approved or denied by the court. The department that showed up to evict the woman in the first place has a lawsuit against them for theft which was filed weeks earlier and in response to that lawsuit the constable revoked their authority to do a job which is within the bounds of the work of the constabulary. There's a LOT more to this story than what these short news clips are showing.

You are mistaken. The COURT ORDER explicitly states, "TO ANY CONSTABLE OF MARION COUNTY," not "TO ANY LAW ENFORCEMENT AGENCY IN MARION COUNTY." The responsibility for enforcing eviction laws falls solely on the Sheriff's Department, as it is the designated law enforcement agency for this purpose. IMPD may assist in the eviction process if requested by the Constable or the Sheriff's Department.
She can be human being by letting the "mother and four children" stay at her own house, not someone else’s house. She cannot abuse her power because she thinks she is being kind. She can be kind with her property, she can give up the everything she owns but she cannot be kind with someone else’s property.

Sounds like the Constable is more for the people of the community than the courts are. Making two disabled children homeless is a pretty high reading on the Cruelty-o-meter! Area must have high crime rate too, if the courts are this heartless.
I didn't understand the attorney's explanation of the constable losing income earned on a per-action basis. How could she lose income if she was declining to provide the services?
There's nothing wrong with being concerned for someone at some point. Consequences must come for bad decision after bad decision. Kids or not if you have kids. You should make better decisions.
Constable should no longer be used. It's ridiculous we don't need a person to do this service outside of normal Sheriff deputies who's JOB it actually is to do this. It is the JOB of every Sheriff in the state of Indiana to serve ALL warrants , processes from the court and all orders of the judges of the county they are in....and to hold ALL property tax auctions. YOUR SHERIFFS ARE TO BE DOING EVERYONE OF THE ITEMS I HAVE LISTED , not the CONSTABLE. Sheriffs are the ONLY LEO officials ELECTED to do this work and they know it...the Sheriff is the HIGHEST LEO in ANY country to include state police.
Yes and no ever state constitution is different. Some steaks out constables some steaks at Marshall’s. It differs! No excusing her behavior but laws varies state to state. If anything there should be a revision of laws there.
She should be voted out. She’s not doing her job. Plus I saw an earlier RU-vid video that showed her stealing a bunch of broccoli. She tried to return her broccoli because it had gone rotten. She had no receipt so she talked to someone in produce dept. and when told no receipt, no return , she said I’m taking it and walked out the store. She was wearing street clothes and her badge so she could intimidate people in the store, told the off duty cop/security guard that she was a law officer and that she was taking it anyway! She just walked away with it! She is arrogant and uses her position to do what she wants. Get rid of her.
I think this was the reason why women historically weren't in this position. She allowed emotions to interfere with her job. She should recognize that and step down.
She's been constable 6 months & the community hates her. They said she doles out favors for her friends. She's about to be fired. She's been charged with contempt of court over this incident. Alot of complaints against her are being investigated.
And disobeyed a court order. People historically done like it when LEOs pick and choose what laws/lawful orders they enforce. Ya can’t have it both ways.
Evictions comes ever 28 days in certain states, however you can fall on hard times, get behind, try and catch up. Look for another place, however whatevers your faith it can happen to anyone.

She switched up real quick she’s an idiot. Her lawyer is an even bigger idiot for embarrassing herself by taking on this case smh. If she felt so bad let her move in with you or pay her rent or get her room, or find a family that will help, or reach out church’s, or ask the community to get involved that’s what I’d do, don’t allow her break the law and use your title to help her break the law. And They don’t just evict you same day, they give you time to pay, than you get notice to go to court, than you’d get additional 1 to 2 months notice. And for mother if she can’t take care of her kids. GIVE THEM TO THEIR FATHERS or fathers family, they are no better or safer with her. She needs to give the kids to a parent who can raise them and get on her feet and try get them back later if she’s doing better. Why let kids struggle with a mother who can’t raise them, oh because you love them more? BS, does kids need structure, discipline, security, provision, 2 or 3 meals, mental peace and safety.
