long history of back and forth in the courts. We will watch as
Mom’s attempts to establish child support after a recent
switch in custody, then an attempt to limit Dad’s custody
after a messy public squabble with their daughter that may
have crossed a line, and a motion to hold Dad in contempt
for not paying his child support on time.

How in the heck can you hit your child in public twice, leave a mark and call it parenting? If a man/woman did that to another person they would be arrested for assault. Yes the child was in the wrong for her mouth but the dad was 10x in the wrong for his actions. And how after 10yrs of your children living with their mother do you NOT know her address? I’m calling BS on that one.

I really dislike Commissioner Nelson. He must have a very sore foot from always kicking the can down the road. Attorney Gilmore does a good job representing her client. Mom seems well versed in procedure and decorum and articulate, too.

I don’t usually support people choosing to go pro se, but in this particular case, looks like dad has started to make a ton more money, meaning a) life at dads is significantly different than at moms, b) of course he can afford a good lawyer. In the first hearing, his attorney tries to argue that his income and the facts about his growing business should be repressed? That’s nonsensical. Furthermore, of course he’s going to try and hide his income in this situation. I know the attorney has a job to do, I get that, but to complain about her being pro se at the second hearing is a bit much. I also get that it’s her job to defend her client but like, you’re just harming the children at this point.

Yes mom was being petty and daughter deserved a good slap being so disrespectful. Mom should have backed the father as she will get a much bigger slap from the rest of the world if she doesn’t get her behavior under control. The court did not help this situation at all. As for dad child support; I really don’t agree with the way child support is done but dad was playing games with the money for what ever reason.

Ridiculous that law enforcement considers hitting your child in the face discipline. If an adult hits their partner that’s a crime, but if an adult hits a child it’s fine as long as it’s their kid. Not okay!

I haven’t watched this yet, but I remember the cops telling my dad that it was fine that he hit me in the face, but it was inappropriate to spank me since I was 16 years old at the time 🙄. It makes absolutely no sense why kids are treated that way.

I don't necessarily disagree, but the fact that if would be a crime if done to an adult isn't a great argument. We expect parents to restrict their children's freedom of speech, assembly, movement, and religion. We allow them to ground their children, take away their possessions as punishment, and be made to do manual labor without compensation -- things that would be considered false imprisonment, theft, and enslavement if done to adults.

I think it's kind of crazy how many people are defending dad on this. I don't think any kind of violence is a good way to teach a child, but even for those that do it seems like they'd recognize that there is a huge difference between slapping a child in the face in public and a spanking in private. A slap to the face is a reactionary move based on anger to my mind. To justify it by saying the child used terrible language seems to totally infantilism the adult who should be able to have self control.

I think both kids deserve to be raised in homes with equitable income (same as if the family had not been dissolved). The only way to do that is for dad to give an amount to mom to ensure that delicate balance. Without funds from dad to mom, the daughter will have fewer opportunities for after school activities, any necessary educational supports, etc. when compared to the “richer” environment of her brother. This also plays out in other subtle ways (clothing and food purchases and other basic needs).

In that case, if the child wants to participate in extracurricular activities, paid school outings etc….the dad should pay half the cost directly to the organization. Mothers use child support to avoid paying for any extra expenses for the children and often to benefit themselves while denying the child “luxuries”. I think, when child support is ordered, the money should be kept in a separate account and an exact accounting of how that money is spent on the child should be required. That would prevent parents using child support to benefit themselves and not the child/children. That money belongs to the CHILD, not the parents.

Wow! My alimony is court ordered to be paid by the first of every month. However, my state gives 30 days until it's considered "late." So, if my ex-husband decides he wants to f around all month and not pay me, which he's done every single month, he can and there's not a damned thing I can do about it! So why even make an order if they aren't going to enforce it? I wish I had the ability to force him to pay me according to the court order!

Why aren’t siblings together.. kids always lose out in divorce/separation. Parents arguing and children having to split their lives between parental homes is very de-stabilising for kids struggling to adjust to family breakdown.

I think people forget that we don’t have the backstory. she could’ve been the main breadwinner when he was trying to get his business up and going. Also, now that he’s making significantly more money each child is entitled to have the same type of lifestyle in either Home. It’s what makes it fair. They were post to have equal opportunities. That’s why she gets child support though. She only gets probably two years of child support.

The judge did well figuring out the father was in the wrong and was purposeful in his contempt. I think his lawyer told him Not to show up to court anymore and that he was not helping his case. The fact that he slapped his daughter twice in the face, shows his bad temper. The mom did well keeping it all together and fighting her exes lies to court. Kudos mom

Commissioner consistently kicks the can as Y'all have said. Very frustrating. Judge Evans, I feel is one of the most gracious and respectful judges as far as how he speaks to anyone in his court. That ability does make a difference in the behavior of nearly 100% of those I've seen in his court. When someone's bad, uncouth or they think they do not have to respect the court his patience and ability to float above and not provide the obvious or normal reaction is masterful. I think he has too much patience every now and again but with family court i get being careful but he does deliver resolution un like Commissioner who just waits till it gets to a judge. Daught should not miss the opportunity to have Ms Winkles involved in her life. She rules.

As someone who is a compliance specialist for businesses paying state taxes I can tell you that many business owners haven’t a clue what’s paid out of their business checking accounts! If they hired a bookkeeper it’s even worse, maybe they are the ones writing the checks late 😂😂. I do not like the mothers smirks like when answering like to her daughters own attorneys. I know this is a procedural question, but why does the court allow motions to be set for hearings without the opposing party having a chance to respond? Where I live, you file the motion and the court sets the hearing date for a time when both parties have had sufficient time to respond. It just seems to be a huge waste of time having court hearings that ate just going to be continued.

I agree. Normally I think claims of mothers playing those sorts of games are significantly overblown, but I don't trust Mom on this one. (The general truth is that _both_ of them are probably terrible parents, just different _kinds_ of terrible parents.)

I don't know who's right, but Mom is well spoken compared to most other pro se litigants we've seen in these type of disputes. She certainly holds her own compared to the attorney.

Playing devil's advocate: Allowing the daughter to decide whether or not she will see her father isn't appropriate. . She must apologize for what she said and Dad needs to apologize for smacking her. Sounds to me like only her pride was injured. Police didn't feel that the girl was being abused. Lots of growing up needed by all parties in this case.

Because he makes significantly more money, so the calculations are essentially both children should be paid the same. The child living with mom gets money because dad makes more

Why is he paying support when they each have one child? What am I missing? The mom is shady and I believe she IS abusing the system. Nelson was wrong for stopping visitation. Edit-Sounds like mom is doing a ‘great’ job raising the daughter. For her to speak that way to an elder shows that she has no respect for anyone. If you want to act like an adult then you’re going to get treated as such. Parents should be able to discipline their damn children! I think mom wants both kids for the child support. She’d receive a couple thousand dollars every month.

What the heck, slapping a 16 year old hard in the face IN PUBLIC, IS assault, not parenting. I don’t care if she was nasty to the gf. You don’t know what the gf said to her either. You ground a minor child, you don’t beat them.
