Luckily in oklahoma you can't be. It's technically legl, how ever you can only do it. If you can prove that the cops absolutely knew you wasn't guilty and did it anyway. Like in this case they pulled up they wrong guy. So they thought they was doing the right thing even though they wasn't. The law doesn't let you resist that you can only resist if they absolutely knew they know you was innocent and they did it anyway which is really hard to prove. Making a mistake is not covered. They all lie, regardless if they're male/female, white/black/hispanic/asian. At my trial, the detective (black female) testified that she contacted me 3x & talked to me, when nobody from any police dept has contacted me. The judge didn't give me a chance to speak. All of us were on Zoom. I was in county jail, judge on zoom, detective on zoom, my lawyer on zoom, my microphone was muted (i think). Don't know what law she was breaking by not contacting me, but the judge seems to know & just gloss over it. My case was against my ex-roommate who screw me over rent money & money that I loaned him.

It's not the false arrest that is the issue for me... Mistakes happen all the time!! However, it's the unfair and sinister approach they take after the fact instead of holding themselves accountable. The sergeant whose job it is to teach cops and make sure they do their jobs to the best of their ability is helping them to ruin this man.. We're gonna have to change both absolutely immunity for prosecutors and judicial immunity for judges, on top of qualified immunity for cops. Our justice system is designed such that no one can be held accountable.

It's not that they falsely arrested him that upsets me, it the fact that after they realized they had the wrong person, instead of releasing him and letting him get home to his kids, they started making up reasons to arrest him to cover up their mistake. Just to clarify a cops priorities in descending order are: officer ego, officer safety, your compliance, how to get fake overtime, feeling badass when they "get the bad guy," covering up for each other, avoiding liability (would be higher but they get indemnified even if QI is denied), what to have for lunch, what RU-vid videos up watch while pretending to watch traffic, if they should switch suppliers of illegal steroids, actually catching criminals, literally everything else, and finally upholding your rights. Following the law does not appear on the list, because they don't even bother trying that.
They can't admit they're wrong or they could be held liable. As long as they keep lying saying they believed they were justified, qualified immunity still applies.

Absolutely false arrest and malicious prosecution. The driver provided his ID. The officers should have properly checked his ID before escalating. To try to scheme to make something up after they falsely arrested the driver is despicable. Dismissal of charges and a lawsuit win is not enough. The officers must held personally held accountable.

We have the natural right to resist an unlawful arrest, it was recognized as a right under common law before this nation was ever founded, and recognized by our US Supreme Court in Bad Elk v United States. Then the system decided it didn't like that right, and they've made it a crime. Our right to be secure in our person is a right to resist unlawful arrest. Internal affairs is the police version of human resources, they only check for policy violations, and almost always find their officers innocent. Then the DA uses their "investigation" to not pursue criminal charges on the cops.

In Texas it is illegal to resist a lawful or unlawful arrest. Also the arrest isn’t unlawful if a court finds the mistake to be reasonable. It is a defense to resisting an arrest in Texas if the force is excessive. It looks like the initial force was reasonable when he first started resisting. It’s not clear to me about the later force used…because the situation was so chaotic.

That’s false. In Texas it is unlawful to resist a lawful or an unlawful arrest. There is an affirmative defense that one was resisting excessive force…but it is unlawful to resist an unlawful arrest in Texas.

@@Robett-r4l That's not how it works in practice. Resisting arrest by sufficient force that it can actually succeed gives the police the right to execute you. Should they have that right, especially in the context of false arrests, ego-driven escalation tactics, and insufficiently explained arrests? Absolutely not.

There should be steeper penalties for false arrests and prosecutorial misconduct. Both should carry heavy fines and jail time. Otherwise these people have to much power there’s no balance. There’s nothing to make a cop think twice before making a wrongful arrest.
Almost all cops will quit if qualified immunity is removed. Any that stay will all be in court over frivolous lawsuits. What really is needed is for immunity to be striped when it is obvious malicious misconduct occurs.
@@adamstull2436 I believe the major problem is that police are used as "revenue farmers" instead of law enforcement. They are looking and fishing to escalate a situation like a tail lamp out into a major drug bust. Normal citizens get agitated at this behavior and resist, leading to unnecessary confrontation.

Remove qualified immunity and make lawsuits come out of police funding/pensions. They'd take much more consideration for their actions. Frivolous lawsuits aren't the issue with removing it. If the cops all did their jobs properly, there'd be no lawyers to contest them. And if there were still somehow, sure waste time in court and lose if the job is done right.
Initially it was mistaken identity, after that it was malicious persecution. They knew the guy was an innocent law-abiding citizen, but they arrested him and prosecuted him anyway.

It's simple, because the criminal justice system is corrupt. Some many of us have been brainwashed to believer that its fair and impartial. Nothing could be further from the truth. The CJS was created out of classism and racism and doesn't even come close to being fair. Take the part which says "innocent until proven guilty." Well if you're assumed innocent, why are you charged and go immediately to jail? If that's assumed innocent, what would be the case if you were assumed guilty? It would be laudable if it wasn't so tragic. Next there's the constitutional right to a speedy trial. This case happened years ago. You call that speedy? What would be slow waiting decades? Are you starting to see all the lies in the system. There's a lot more but this reply would go on for pages.
They sound so disappointed every time they say he’s not a felon and that his record is clean. The one officer even said, “Not convicted” when his sergeant asked if he was a felon. Which is crazy. So the answer is no. No he is NOT a felon. The two options to that question are yes and no. There is no, “He’s an unconvicted felon.” This implies that everyone is either a felon, or just not convicted yet. Wtf kind of logic is that?

Well that would be a start. Just keep in mind that judgement for a million doesn't get him that. Remember, all judgments are fully taxable and at the highest rate. So Uncle Sam will be there to take over 40% off the top. After that you have lawyer fees of 33 1/3, and other expenses. That mean whatever the judgement amount victim will lake home less than half that. They've also held this case for years and he's been unemployable for that time with a family and 4 kids. These cops literally destroyed this man's life and he may never recover. A half million won't come close to fixing that.

Why on earth, do the police always double down when they are caught red handed? Our taxes go to pay the lofty sums of money that these hooligans put our municipalities in line for.
