How Ironic! This is the very state that allows people to openly carry legal firearms into the Airport. Yes, remember the guy who escorted his wife with a semi-auto rifle with a 100 round drum into Atlanta's Hartsfield-Jackson airport? This man was merely on his on porch, on his own property, minding his own business. Exactly how his wife stated. A call isn't *proof* of anything. The cop had *no* RAS against this particular man for him to produce his actual ID or to ID him. He didn't legally have to even give his 1st name. The cop needed to do his job correctly & go "investigate" the *area* first. No, careful with this. Arrest warrants aren't search warrants but they normally allow the police to enter the residence of the subject for the purpose of making the arrest. And if they happen to see something when they do, that could also be fair game.

The law maybe different in this state but in pa ,one of the most effective ways to get a corner drug dealer arrested is if a resident calls 911 and tells the dispatcher that one of the drug dealers fired his gun and then describe the dealer . in pa ,courts ruled that this cops reasonable suspicion to search the dealer and make him provide i.D . . often the drug dealer will have an illegal gun or drugs on his person so he can be arrested and jailed . so in pa the 911 call DOES is enough for cops to have reasonable suspicion. Its too bad if that's not the law in other states
@@iang8169 That's a different scenario. The drug dealer is in a public place, and a 911 call often (but not always) includes the name and location of the person making the call. You CAN make an anonymous 911 call, but the Supreme Court has ruled (multiple times in fact) that an anonymous call does not meet the requirements for reasonable suspicion. There must be other corroborative information that provides reasonable suspicion that a crime was actually witnessed taking place. If you don't know who is providing the information or where they are, then you have no way of knowing if they're making a false report. That's why it is ALWAYS recommended that you give your name and location if you call 911 to report a crime, assuming you want them to be able to make a lawful arrest. That said, you better be 100% sure that you saw what you think you saw, because you will be open for a lawsuit if you provided false information.

"We received a call" is not an accusation under oath. Cops should come when people call. But they have no statuatory authority or Constitutional authority to demand anything. They have no evidence, none. You do have the right to face your accuser in court when the time comes. Regardless "a call" is not evidence. It's merely grounds to ask questions. It is not grounds to demand anything, not ID, and not to demand that anyone answer questions. Everyone has a 5th amendment right not to answer questions, and until the courts rule that cops have to stop "demanding" answers to questions, the cops are going to keep violating our rights.
Not to mention an ID isn't going to help you find out if a crime has been committed or not. They know the house they got the call to, wtf is an ID going to help? Nothing. They wanted his ID because all cops are trained to get everyone's ID and run their names for Warrants. The problem is the law only allows them to ask and these ignorant cops always take it past that and threaten to arrest people over it. My brother and ex were put through the same thing. They threatened arrest me and my parents and followed and stalked us everywhere we went. Neither of them have a record, been arrested or broke the law besides smoking alittle weed. This happens everyday all over the US! Its terrifying! "On his own property" is really irrelevant. Its sensationalism. If they DID have a right to get his ID, it wouldn't matter if he was on his property or not. Getting his ID was not necessary to their investigation because when they asked for it they had no reason to believe or even suspect he was guilty or about to commit a crime, but they did have his first name and address. Knowing that they could easily find out who he was if they were so inclined, but they weren't.

Qualified immunity only exist if no constitutional laws were broken that any reasonable person would know of. In this situation many constitutional laws were broken so qualified immunity would not hold up in court in my opinion.

I can't believe that not only did he unlawfully demand is ID, he went ahead and stole his wallet from his pocket without his permission. The sargeant said "they can ask for ID." The part they do not acknowledge is. We can say No. They can approach you randomly and ask question. We can refuse to answer any questions and walk away freely.
@@DARKMATTER_7 Maybe so, but there may be judges (at least ones who aren't automatically trying to protect cops) who could perhaps have a problem with a cop expressing himself in a manner that fools a random citizen into thinking that he's obliged to present his papers or face legal consequences. Even if the cop is not directly saying so, not making it clear that the request is completely optional can mislead people into giving up their rights.

Andre have you heard about this particular case where this woman was stopped by a police officer where the woman was accused of road rage? The thing is I am not quite sure if the road rage story is or was true or not, but here is the flip side of this story. The police car was parked on the train tracks. I mean right smack in the middle of the train tracks. The female white officer put the woman in the backseat of the squad car. The officer never ever moved the squad car. A train came along and hit the squad car. The woman that was in the backseat of the squad car lived, but she has permanent brain damage and she had 9 broken ribs. The police officer was indeed fired and they have it where she can never ever be in law enforcement again anywhere at any time. She can't even be a commissioned or non commissioned security guard. She didn't receive any jail and or prison time. The judge only gave the former female officer 30 months probation and that's it. And the female officer was on the stand in court crying, weeping, and apologizing. She knew exactly what she did that evening and she knew exactly what she was doing. Regardless if she was in a road rage incident or not, why in all of God's green earth would anyone park right in the middle of a train track in the first place? This woman has extreme severe permanent brain damage. And all the former officer received was 30 months probation. That 30 months probation will come to an end, but permanent severe brain damage last longer than 30 months. That former officer should be in prison. If this former police officer hadn't been a cop she would indeed be in prison right now with probably no probation and or parole.

They didn't have the power to do this so its not an abuse of power. Its just a plain old crime. The other officers should be fired for not arresting the officer illegally cuffing people. That depends on what the paperwork said. The judge cannot be held responsible if the cops outright lied to them on on the warrant application though that would be another charge against the cops.

As far as it would appear; all of those places are doing just fine. They don’t want to get rid of it because it protects the corrupt; not because “people would quit”.

It’s time that police departments across the country train their officers that they have no right to demand someone’s ID because “they were called there”. Not one state in the country has such a statute on the books - because that statute would violate the U.S. Constitution. This is ridiculous.

Dont you know about the four tiered justice system? A: elite, above the law B: normal people who can afford a lawyer so can get justice C (most people are here!) normal people that CAN NOT afford a lawyer, hence CANNOT get justice IN ANY WAY. D: persecuted class, like Julian Assange, Milo, Alex, Trump, who will get life in prison for farting the wrong way, even if they are squeaky clean. 'the law suit will be glorious' do you know how much money the state has to defend themselves? They can just stretch out the process, appeal where they can, who will pay the lawyer costs for the citizens during that period? Hmm? It's really sad that someone can call and accuse someone just because they don't like them. Then the police come and treat him that way over a phone call. These Police are way out of bounds . I hope they sue the hell out of this department. This was totally retaliatory because he made a complaint . And cops wonder why they are hated so bad, this is a prime example.
neighbors calling the cops on neighbors happens all the time. cops mission is to arrest someone, that is why they are ID hungry. Nazi germany rewarded karens for calling gestapo on neighbors. There was a case, a pastor was watering his neighbors garden, they were on vacations. A neighbor called the police. Pastor explained what he was doing, cops arrested him.
For the same reason that red flag laws are dangerous. Anyone can report you and you lose your property and potentially your freedom without due process. A clear violation of the Constitution. Red flag laws have already been abused.
When a black person wants be a thug they join gangs like the Bloods or whatever, when a white person wants to be a thug they join the Police or Army. I think a lot has to do with around 20% of pigs being former military. They view everyone and every situation as a possible terrorist threat. That mindset doesn't leave them and has been drilled into them as they're trained as an occupying force. This all plays out into the others around them and in their training. There is a reason pig forces look like military units now. The P.T.S.D of these officers must be off the charts only to have them take it out on their own citizens.
I should have been a lawyer. There’s no shortage of cases like this. It never ceases to amaze me how confident these cops are in spite of their ignorance. I love the interview room. Copsplaining at its best. These idiots are a danger to society.
@Duganoz They are confident because they know nothing will happen to them, to their pension, or certificate. No reprimand, no loss of job and probably a promotion. Union/qualified immunity.
They know who they can push around. They wouldn't try anything like that in a rich neighborhood because they would have the money to pay lawyers to sue them. You get as much justice as you can afford in the USA. Regular people pay all the taxes and the rich get all the rights and benefits.
It's not too late to become a lawyer if you have the intelligence for it, I'm not that good academically or I would definitely go for it, we all have to do our part to get the situation correctly before more people get victimized and killed by the police

That DA should go to jail! Those cops should all be fired and banned from ever being a cop again. That's crazy. Those bad cops give all cops a bad name.
If 1 in every 100 people who watched this video called that department and complained in a clear but calm manner, it would be very helpful towards making the point that they are the ones breaking the law. Hopefully the local media will cover it, followed by a civil rights lawsuit, followed by the firing of the arresting officer and the corrupt tyrant lieutenant at the end.
You guys are still too focused on trying to fix law enforcement or make some of them seem to be better than they really are!! Our justice system has ruined so many innocent lives it cannot be fixed!! They have killed over 5,000 INNOCENT civilians in police chases since 1980 alone, that 5,000 funerals of innocents caused directly by law enforcement wanting to chase people and speeding through our streets!! They do not stop crime they just show up afterwards to make the revenue off of your circumstances!! We definitely need to figure something else out!! At this point in our country law enforcement 10 times worse for us than the other criminals are, because not only can law enforcement put you in a cage for an arbitrary law but they can kill you for that same arbitrary law!! I'm more worried about law enforcement where this country is headed and everyone else should too!!

Why do people think of law enforcement as anything but the government? Look at all the corrupt stuff the politicians get away with and we are supposed to trust that cops are doing everything they should?! Ya right!! I wish everyone could think freely about this without any pressure from other peers saying cops have to be liked/respected simply because they are a cop!! Some of the worst people I went to school with are all in law enforcement now!!
I hope he gets an amazing civil rights attorney. This was hard to watch for many reasons. And kudos to this whole family for knowing the law better than the police department!
