A cops extent of investigation is to get the ID of the suspect. Speak to the individual who called, watch and observe. Officers lack the brains to do anything beyond simple tasks.

In NH the lawyers and chiefs DAs ect. Are all buddy buddy, my lawyer took my money and wouldn't defend me. Cops banged on my door for 2 hours then broke into my home for a "welfare check" all because I ran into my own mailbox and my neighbor hitched about it.. only way to win is money, and lots of it to fight these tyrants

Once violated, your rights can be upheld by courts of law; directly or on appeal. When that happens, legal precedent is set, (like Terry v Ohio) and training will now follow those guidelines. Without clear guidelines from the courts, or precise language in the written law, you get interpretations of the law, which vary from state to state, even county to county (assuming you have those), or town to town. Recently, active members of the auditing community have gotten action taken against officers, where the internal review simply slapped a wrist, and wagged a disapproving finger.

That was my first thought as well! At 4:34, the cop absolutely dismantles his own argument. Anyone working security would know that a garage door open in the middle of the night is suspicious and should be investigated, just in case. But, if you find someone inside with a calm demeanour, wearing PPE, lights blasting and with obvious clues that the person has been working on the vehicle (i.e. light under the car, tools scattered around said light, hood open, etc. there's no way in hell that it's an actual robber.

When opening my gym, I was there late as hell. It’s a super stressful time. There are dozens of things to do and you wonder if you made a good decision. If some ignorant cop comes to me with this, I’d lose it. He was great for keeping cool.

My ONLY counter argument could be they suspected him of removing car parts from the vehicle that may not be his (like in a chop shop). But they ran the plate which dispelled that suspicion.

@@RavenNMonsterAgreed! Even if they thought he may be steeling parts from the car they need reasonable suspension and probable cause that he was in the commission of a crime and/or a warrant. They had absolutely zero except he was working inside of a business which a lot of businesses owners and their employees do routinely. Even if was late at night there’s nothing unusual about them working on into the wee hours of the morning to make things happen.

I got stopped at 2 a.m. as I drove away from my business. The cop told me that he suspected that I was burglarizing my business. Then he ran my tags, found out my name, and asked if I had any connection to my business. I told him to turn around and look at my building which had my full name in giant lighted letters on it. The city paid me $5,000 for the illegal stop and apologized. The cop was transferred out of my jurisdiction. It turned out that the cop was pissed at me because I chased him out of my parking lot late at night several times previously -- according to IA.

I lived in Fridley Mn from 97-06 anyways I just got done Deejaying a wedding just got done bring my speakers into my parents house, crazy knock at the door so when I answered they told me if I didn't let them In to see if there was a gang shoot out about to take place. I couldn't stop laughing. So my pops comes to the door and they want my id etc and they ask my dad the same question we heard there was going to be a gang shoot out ( SMH ) my sisters ex boyfriend called them and told them that. The whole force plus some of Ramsey co cops too. Smh over a hear say 😮😮

This reminds me of the African business owner who were doing inventory overnight and the cop came because it was “suspicious” that people work overnight. I’m in Australia and work nights. I’m a small female. I had two big male cops follow and harass me when I went out for food. They wanted to know what I was doing and who I was. I said check my number plate if you have to as I just got out of my car. Then they started asking for proof the car was mine. They watched me get out of the car and lock it. They said that me being out at night was suspicious. I asked why them being out at night wasn’t suspicious they said they are working I said me to and I’m sure you stop for food just like I’m doing These police are just out for power nothing more.

the only defence i can give them is the "concerning" factor. its unusual to may be there but not illegal. but they dont think they just take actions without actual thinking. They are at the adress & can look up who owns the property/store & call them to verify. why make things so complicated. giving ID to the cops doesnt will change anything. its like with the ID they know if hes working there, but they wont. & calling the owner in morning wont do shit since at that point he will be long gone anyway if it turns out to be a stranger. such stupid excuses.

This is by far the best channel for this kind of content. The length to which this gentleman goes to site and explain certain laws and quoting several different cases concerning the specific laws the video is pertaining to is incredibly helpful and informative and educational. Everyone needs to see these videos and they should be used in training for all law enforcement. Thank you for all the hard work and all the great content. I know far more than I ever did about my rights and certain laws that police try to enforce on a daily basis and that could affect my every day life. When someone gets arrested and charged, their life gets turned upside down and in many cases, for no reason... Thanks again, cheers.

@@surfgreen60the damages are the violation of the 4th amendment. Point blank period. No physical damage need to happen. I just got $52,500 and never had handcuffs on and had one hearing for less than 60 seconds. My suit was 1st, 4th, and 14th amendment violations.

The cop just explained precisely why you should always refuse to ID. "If this place gets burglarized, I know who to talk to." If someone, anyone, commits a crime, any crime, in the general area you will be the first (and only) suspect. If you give cops your ID, you better be sure you have an alibi for every second of your time for the 5 days before and after the encounter.

Yup, and there is no rhyme or reason. I've had 2 "mistaken identities" and both were hysterical. One suspect was 5'7" to 5'9" with blondish hair, I'm 6'4" with dark hair, but I was walking down the street, so it must have been me. Unamusingly, even after warrant checking me and ruining my early morning by holding me initially at gunpoint, instead of going after the dangerous criminal he was chasing, the cop decides he wants to sift through my backpack for 10 extra minutes. Real hero right there. The other, I was working from home and went to pick up a pizza I ordered online. Even though I was walking TOWARDS the place the cop was all up in arms about someone passing a fake card, he couldn't just come into the pizza place that I was right in front of and watch me pick up my pizza, he had to waste 40 minutes of my time and lecture me...And make me late to a meeting...Again, for the crime of walking down the street.

@@GJT-bq3hr lol my only mistaken ID experience- i was 15 years old, with just swim trunks and a towel because me and my 2 friends just got out of the pool. We were walking thru the parking lot without a shirt, dripping wet, and the cops stop us for a call for “people breaking into cars that match your description” my friends were white and 15 or 16 too, but one friend is 6’3 or so and he really stands out. When we heard them say over the radio “we’re looking for 3 black males ages 30-35 stealing items from cars” I couldn’t believe how dumb the cops were. They still kept us their and gave us hell about not having ID’s (but we were swimming in my buddies apartments pool). Then they act all surprised when they get hate as if they didn’t earn it…

Cops are notoriously lazy and hate doing any actual work. When they say "investigate", they don't mean actually investigating, they mean assaulting whoever happens to be withing arm's reach, and they most certainly will never bother to look for a second suspect. 😒

@@SmartLittledrewthe phrase break and enter doesn’t necessarily include physically breaking items, more like breaking the threshold of or breaking the permission you don’t have to enter. No destruction is needed at all. Entering without permission is all that is needed. I’m getting the impression they teach recruits they are the boss of everyone.

I used to work for old navy when I was a teenager. We routinely had to work overnight for inventory. Never had a cop ask why I’m coming in and out the store at 3 am.

I once was working in my garage at 12am due to my car part coming in late and I needed to have the car ready for the morning to go to work. Police came and literally held me for an hr asking why I'm working late in my own home. They were upset because I had my headphones and didn't respond to them immediately. 😂

Right? I would have said, "There is a Ring camera right here. The owner is alerted every time someone comes in or out. Don't you think he would have called you if there was a break in? Using the garage at my place of work to fix my car, which I've explained to you and is evident by what you see, IS NOT A CRIME. nor is there reasonable suspicion that I'm about to commit a crime. Therefore, you have no right to stop and identify me. Leave or this will be a lawsuit."

I made the mistake of getting into a political argument with my dad and things weren't the same after that. Years later, there was a race to set a new home run record in pro baseball. I wasn't a fan, but he was. We were able to discuss it and grow closer after that. Now that he's been gone for 15 years, I realize how stupid I was and I thank God for the opportunity to mend fences. Frankly, I think a lot of the time they are just obsessed with getting their paperwork filled out “right.” They seem to feel there will be a problem if the write on the report form something like, “I spoke to a man who stated he was fixing his car and that he was authorized to be on the premises. I asked him if he would identify himself and he refused. As we had no probable cause to believe any crime was committed, we then ended our investigation.” I think it’s just a case they have it flipped on what they are supposed to do and/or they’ll get heat from supervisors for not getting a name to put on the report. And the latter may very well be the case; and if it is, then the problem is with the supervisors too. For whatever reasons, I just think police are not regularly taught that it’s ok to write “person refused to identify themselves” or maybe the less inflammatory “I did not obtain identification,” (but perhaps that makes an LEO feel they neglected something) on the report form in cases where they have no right to demand identification. Anyway, this situation seems to me an example of LEOs just wanting a name for the form; because I don’t think they had any suspicions after the door was answered.
