going through crim proceedings atm in Melbourne too. i find it absolutely crazy that someone can walk in to the cop shop and based off their word of mouth with NO EVIDENCE or PROOF of what you are ACCUSED of and you can be threatened with remand and have charges against you. its bullshit and the courts are corrupt its all a big game, no wonder it takes so fkn long with proceedings its all money based. the cops investigating me at the moment have been trained and their boss when they were recruits is the step father of the person against me. The way I see these charges it's not in your favour to have these charges heard by the magistrate that you have said knows you personally i remember back in the 60s and 70s the exact thing used to happen all the time obviously he's well and truly dead and buried now in my opinion id be getting your solicitor to magistrate shop so you can get a fair trial if you're on the receiving end of this judge your a dead man walking hopefully that doesn't happen it's definitely not in your best interest to have your case heard by this magistrate
All convictions pretty much lead to when you get out to be a prohibited person so the fpo would stand on that case alone. But you can get an fpo with no convictions as welwells and or offences not in relation to a firearml and can be given by the officer doesnt need a court to sign off. The police would need to prove its your silencer via a witness statement that can be contended. Video evidence of you having possession of it and not you passed out in a video with it in your hand, you with a gun that has the silencer on it. It would have to be proved beyond rssonable doubt. To defend against this you would ger a clean skin person no tattoos a mobile phone and interview people on the street fom 8 different age groups. Ask the same scenario if this was handed in to a police station and they said it was yours the interviewee on the street interview shiuld you be cgarged on that if it wasnt yours. This gives a resonable doubt from multiple peoplemultiple age groups and races that the genersl public would believe that you need more evidence the someones word. You enter this as evidence if the general publics perception on the matter
My honest opinion your fucked if you stay under this magistrate and you need to try get a different judge and failing that take it to the higher court, yes it opens you up to longer sentence but if there’s truly no evidence and was handed in as you say, it will be thrown out. You need to get highers ups eyes on this case to bring about unbiased legal justice
Yeah, if they were your mouthpiece previously and have a family connection, sounds like the Magistrate absolutely has a conflict of interest, but I'm no legal beagle... Have you spoken to your mouthpiece about it, if so, what did they say? Also, no DNA, no prints, tipping all they have is a witness, which if they had a silencer and "handed it back" to the coppers, are they a crook and did the coppers offer them a deal to reduce charges if they gave up a name? Also, have you asked your mouthpiece if there is a statute of limitations for firearm offences - acknowledging you are absolutely innocent and these are false allegations, I'm curious if someone did commit a firearms offence when they were running a muck, can they be charge for it all these years later? Sorry about all the questions, just some food for thought... But don't answer them on here, especially the ones about the alleged charges, coppers would 100% be watching your videos. I'm not a solicitor, but apart from the premise that the Law must maintain impartiality, how did the DPP justify the laying of serious charges if the item in question wasn't found at your address? Obviously the person that has handed the item in has an axe to grind and is trying to stitch you up. Was it a mate or acquaintance that has done it. It must be somebody that was close for them to proceed with the laying of charges. Especially with a lot at stake. Is there any chance that the person that took the item in recant and admit to wanting to cause you harm and distress?

It would be a stressful pickle to be stuck in.....even if the Magistrate moves aside it is unlikely that it'd make a whole lot of difference as they'd all pretty much float around in the same circles. They'd talk shop just like the bores in every other workplace. It'd be good grounds for an appeal though if a conviction was recorded. From what I can remember you live in a regional area, no? A small pool of Magistrates. Despite that, everybody is entitled to the same presumption of innocence until proven otherwise. It'd be impossible to prove that it belonged to you I'd have thought. Some Wally wanders into a Police Station and says 'hey, this belongs to Joe Bloggs, you'd better charge him'.....and that is the sum of it? Logic says that it wouldn't stand a chance of securing a conviction. Nobody would be safe if that was sufficient grounds for a conviction. Any junkie that was about to get pinched for something would be able to throw somebody else under a bus on a trumped up charge if that was an acceptable precedent. In the meantime perhaps that 'wayward friend' could be encouraged or persuaded through other channels to admit to having spun a web of fibs as some form of malicious payback or something....Good luck with it all. I'd look into commencing some sort of course that could potentially lead to getting a job in the field of helping to divert young offenders away from the misery of a life of crime.
