Couple Says Squatter Keeps Them From Moving Into New Home 

This is absolutely unacceptable. He needs to be evicted. I don't blame her for being so upset. Imagine paying a mortgage for a property you can't live in.

It’s not his house, he’s not paying rent, so he’s not being evicted. He’s trespassing. This is disgusting.

This is ridiculous! How can the property owners have no rights to their own property? Why is this law allowed to continue?

That man no longer owns the house and is simply trespassing on that couple’s property. He should be evicted because he’s the one trespassing, not the couple who owns the house.

This SHOULDN’T EVEN be a legal battle. Imagine paying this expensive house off, then being forced to surrender it to a thief manipulating the law.

Imagine making payments to the house and having squatters there with laws to protect them. That would drive most people crazy.

This is real estate fraud. At this point, I would declare the house sale a loss. Instead of trying to move in, I would take him and his real estate agent to court for real estate fraud to get back the amount of the down payment and the mortgage you paid for. This is ridiculous that California doesn’t give victims of squatters any rights to their own house.

There's gonna come a time when we will have to take matters into our own hands bcuz the justice system isn't there. These people paid for their new home with their hard earned money and this is what they have to put up with. Very very unfair!!. SMH.

The government would evict someone living under the bridge, but won’t do anything if they live under your roof. Their priority is in their best interest.

I actually feared this. I bought a home in Texas and the pervious owners had not communicated with me at all about their move out or wanting to do a lease back. I arrived at the home Friday night before our closing Monday. They had not packed a single box. My realtor said they legally still owned the home and they technically did have to be out of the home. The home was still packed with their stuff. I grew concerned and told my realtor I would not sign the closing documents without a final walkthrough the day of ensuring they were out. The previous owners were livid at me. They had to pack an entire home by themselves in two days. There realtor would help them pack, and I would later learn they did not have money for movers nor truck. They literally took the light bulbs out of every light. Left me trash, broken furniture and a weight set....Parts of their RV septic system. They did remove the bulk of their stuff. I signed the documents, as it was bad enough to notice but my lease was ending on my home. I fully believe they were not planning on leaving either out of a necessity or simply didn't care about my needs.

The fact that the man won't leave, utterly ridiculous.

Update: squatters left last week and they’re moving in now. Good for them.

As a real estate agent, this is why we insist on being sure there is a checklist. What about a final walkthrough prior to closing? That would have confirmed and verified the previous owner vacated the premises. As soon as closing papers were signed and the mortgage loan was funded, the new owners could have changed the locks immediately. Never close without a final walkthrough! It should be beyond an eviction at this point. This man should be arrested and physically removed from their home!

Nothing a black eye won’t fix.... I delt with this exact situation a couple years ago when buying my house. I called the police and they said there was nothing they could do at the time, but after they leave if I was to force my way in and just happened to be attacked by the previous home owner I would be able to defend myself without prosecution. Guess what? I had my property within 24 hrs.

Isn't it up to the Bank that foreclosed due to non-payment to execute eviction of previous owners? Sue the Bank and the Real Estate Co, they enabled the squatters to stay and they defrauded the new owners!

I would relocate him to the hospital, he could stay there as long as he likes.

I don't understand how can they not throw him out, he's not paying for the house in any way and was in fact given money for the property. He doesn't fall under the no eviction, hes not being evicted from something he doesn't pay money for! I hope they sue the hell outta him.

Two years ago, during the closing of my house, the real estate agent, the owner and myself found squatters in my soon to be house. It was a young man and his girlfriend. They said they rented the house from someone on Craigslist. It took the owner a month of going to court before the marshals finally came to get them out. Even though he was a scammer, squatters seem to have more rights than the home owner.

I wouldn't even want to live in that house after all of this. Having these memories of stress in a new home, is something I would pass on. Feel really really bad for them.

If that happened to me I'm rounding up my buddies and forcefully breaking in and dragging them out by their hair.

This happened with my grandmother a long time ago in Lake Elsinore. Nothing was ever resolved out of it unfortunately and she has passed.

I have heard of people going on vacation and coming back home to squatters. Then they can’t get them out. The squatters have the right to live in someone’s home for free???? I thought that was breaking and entering and trespassing???🤔😱. I just don’t get it!!!

As this problems persists in several states the new way to deal with squatters is to deal with them yourself. Don’t call local law enforcement. Just man up and kick them out, if they get violent show them greater force. For instance having a gun on you but not brandishing it and waving it in their face. Just let them know you have it and will use it if things escalate, tell them to get out or face serious life consequences.

There is NO FREAKIN WAY that I would be paying a mortgage on a home that I wasn't or couldn't live in! This is the craziest mess I've heard all year!

Car theft, and even less, evidently is more of a crime and treated as such, than stealing a home. Homeowners should never have to endure these long drawn-out stress inducing and expensive sideshows. Situations like this have their complications, but one party can produce legal recorded documents resulting from the transfer of the property, and one party ... cannot. However, as in this case, it's the legal owner that can't step foot on the property. How can we in 2021 not have an expedited, as in days not years, process to resolve this matter. Clearly the previous owner sold the property. People such as the new owners need a working legal system.

He should be charged for 14 months of back rent, damage to the property, falsifying documents and anything else they can think of. I personally would of gone thew the window if the front door wasn't an option and force him out.

For 1/2 that amount you could have paid me to go there and personally remove this thief for your home! 🤬 There's nothing in the law that says you must allow him back in once he's out! It's a legal nightmare. They will have to sue him after he's finally out, and they'll win that, but he'll pull bankruptcy or something else to avoid paying.

When selling a home, if all i's were dotted and t's crossed, he's trespassing if the house is sold. I'd have sale of house canceled as he didn't vacate and he can now be responsible for all payments, including the ones he fraudulently had this couple pay. Outrageous.
